MPD Officers knocked on the apartment door, announced themselves as police, stated they had a warrant, and for the occupants to open the door. Afler approximately one minute of the members knocking on the door and commanding the occupants to open the door, the victim opened the door. The vietim was dressed in a pair of leggings and a bra, MPD members asked for the target of the warrant, who was inside the apartment, before securing him in handcuffs. Another individual was inside the apartment with the victim. An MPD officer ordered the victim to get off her phone and get dressed, Other MPD officers made contact with another occupant of the house The defendant stood inside the apartment at the entrance while other MPD members were interacting with the victim, other occupant and target of the warrant. The defendant requested the victim to sit down, The victim inquired about putting on her clothes. The defendant requested the victim to sit down until the officers were done. The defendant told the victim she could place a cover on herselt if she wanted too. The victim sat down on a sofa bed before another MPD member placed a metal folding chair across the room for the victim to sit on. The victim went across the room and sat on the chair, wearing only her bra and leggings. After a couple minutes, a female MPD officer asked the victim if she wanted a blanket, or wanted to cover up. The victim appeared not to respond to that officer. Another female officer standing next the victim asked if she wanted to cover up. The victim replied, "No. | don't. They already asked me that.” The victim sat in the chair, and crossed her arms, covering her stomach. Choose an item. _LIS. After a period of time, the defendant retumed inside the apartment, The victim was still seated on the metal chair inside the apartment wearing her bra and leggings, across the room from the defendant. The defendant positioned himself inside the apartment, at the entrance with his back to the door The defendant and other MPD officers were awaiting the approval of a search warrant for the residence. The defendant remained inside the apartment with another MPD member along with the victim and other occupant. At approximately 1221 hours, the defendant produced his departmental cell phone and unlocked it. The defendant opened the camera feature and zoomed the focus of the camera to its maximum setting. The defendant discreetly maneuvered the phone to focus on the victim and area surrounding her. The defendant continued to maneuver the phone before taking a photograph of the victim. The defendant ‘opened the photograph and reviewed it. The photograph captured the victim, fram the neck down. The victim was still wearing her bra and leggings. The defendant zoomed in on the picture, focusing on the victim's pubic area. The defendant exited the photo, reopened the photo and then deleted the photo. The defendant then left the residence while other MPD members remained at the residence pending the search warrant. The victim remained inside the residence, wearing only wearing a bra and leggings until approximately 1252 hours, when she asked the MPD officers to leave the location. The victim put a pair of jeans over her leggings. and a white long sleeve zip up jacket as a top. The victim then leff the residence while MPD remained on the scene. This affidavit is being submitted for the limited purpose of supporting probable cause. Your affiant has not included every fact known or conveyed during this investigation. Based on the above listed facts and circumstances, your affiant submits that there is sufficient evidence to believe that the defendant committed a criminal offense. Therefore, your affiant respectfully requests that an arrest warrant be issued for Larry Garrett, charging him accordingly.
