- Application of Extension of Time Due to Blockage

Reference is made to the above-mentioned subject and also to our letter EESB/02.3/DID-
SG.POI(F2)/Did-214 dated 29th September 2022 (attachment A).

2. We would like to submit herewith our application of Extension of Time (EOT) due to
blockage by land and crops claim of the neighbouring land. The claimee had block a proportion
of the site/land at chainage CH0+250 of the cul-de-sac parking area. This has eventually
affected our earth filling works for the parking area and also the construction of culvert 5.

3. This event had interrupted our sequence of works and also our progress on site since
September 2022 as mention in all the progress meeting (attachment B). The parking area and a
proportion of the spur road could not be completed on time (attachment C). Thus also affected
the construction of culvert 5 such that the ground, setting out, pilling works and etc could not
commence. The contractor had scheduled the culvert No. 5 works to be co-relation with culvert
No.1 works such that both has similar work activities (example: setting out by 3 rd party license
surveyor and pilling works by 3rd specialist). This is to avoid re-mobilisation or idling cost of the
filling rig and to protect the government interest. Hence, the works on culvert No.1 has also
been indirectly affected by this issue. Culvert No.1 is schedule have be constructed the last as it
is at the junction to the another village. The contractor has put into consideration on minimizing
the affect of this construction on the villagers in-conjuction to the governments best interest.

4. This blockage is the second blockage by the same claimee (as mention on our letter
GSSB/02.3/DID-SG-POI(F2)/Did-127 dated 23rd July 2021) and has affected our work since 29th
September 2022. Although extensive investigation has been made with the Board of Land and
Survey Sarawak, all of the land within the work boundary limit has been compensated. This
however does not include the crop or vegetation claim. Hence, Encik Melayu Anak Lasoh was
not compensated in any kind. This had raise problem to the contractor as he and his family had
made a blockage at CH0+250. Although efforts and detailed explaination has been made by
DID Sibu and Land and Survey Department Sarawak to the claimee that all the land has been
compensated and belongs to the State.

5. However, as this issue does not end with mutual beneficial solution, the contractor has
step in to intervene to help, in the effort to close this issue and to finish up with this project. The
contractor has come to an agreement to compensate the claimee RM15,000.00. A
memorandum of understanding (MOU) has been made between the claimee and the contractor
for compensation on the 7th March 2023 (attachment D).

6. Pursuant to Clause 43.1(d) of the Form of Contract, the contractor would like to claim an
extension of time of 109 days as the event delayed the contractor’s works from 29 th September
2022 until 7th March 2023. The clause describe as below:

“ consequential upon dispute with neighbouring owners peovided the same is not due
to any act, negligence or default of Contractor or any sub-contractor, nominated or
otherwise.”
