OFFICE OF THE SANGGUNIANG KABATAAN

RESOLUTION NO. 01-2021


ADOPTING THE INTERNAL RULES OF PROCEDURES OF THE
PANLALAWIGANG PEDERASYON NG MGA SANGGUNIANG KABATAAN OF
SAN EMILIO, ILOCOS SUR.
WHEREAS, the Sangguniang Kabataan was created through the Local
Government Code of 1991 which provides opportunity for the youth to directly
participate in local governance.
WHEREAS, the enactment of RA 10742 also known as the SK Reform Act of
2015 strengthens the power of Sangguniang Kabataan in local governance.
WHEREAS, in order for the Sangguniang Kabataan of San Emilio to fulfill their
duties and responsibilities as mandated in the RA 10742, set of rules should
be adopted for the efficient and effective fulfillment of responsibilities as leaders
of the youth.
NOW THEREFORE: BE IT RESOLVED AS IT IS HEREBY RESOLVED, TO
ADOPT THE INTERNAL RULES OF PROCEDURE OF THE PANLALAWIGANG
PEDERASYON NG SANGGUNIANG KABATAAN OF SAN EMILIO ILOCOS SUR.
Rule 1.
MEMBERSHIP
Section 1. Composition. The Panlalawigang Pederasyon ng mga Sangguniang
Kabataan of San Emilio shall be composed of all SK CHAIRPERSONs of all
Barangays of San Emilio, Ilocos Sur.
Section 2. Term of Office. The term of office of the Members of the
Panlalawigang Pederasyon ng mga Sangguniang Kabataan of San Emilio shall
be two (2) years which shall commence on such date as maybe provided by law.
Rule 2.
CODE OF CONDUCT AND ETHICAL STANDARDS FOR PUBLIC OFFICIALS
Section 1. Republic Act 6713 provides guidelines on how public officials,
including Sangguniang Kabataan Officials, are expected to conduct themselves.
Section 2. Duties of SK Officials as Public Officials. The Sangguniang
Kabataan Officials are expected to; Act Promptly to requests, applications from
the date of the request or application; Attend to anyone who wants to avail of
her/his services; Submit reports on time; Process documents and papers
promptly; Be accountable on documents signed; Be transparent especially on
the reports and transactions making them available to the public upon request.
Rule 3.
PRESIDING OFFICER AND SK FEDERATION PRESIDENT
Section 1. The Presiding Officer and the SK Federation President presides
during the session.
Section 2. Powers and Duties of the Presiding Officer. The presiding officer
shall:
a) Serves as an ex- officio member of the Sangguniang Bayan.
b) Acts as Chairperson of the Committee on Youth and Sports Development
of the Sangguniang Bayan.
c) Calls and presides over all sessions of the Panlalawigang Pederasyon ng
mga Sangguniang Kabataan of San Emilio and votes in case of a tie,
except when one (1) of the agenda to be discussed involves disciplinary
action against her/him, in which case the highest-ranking SK member
shall preside.
d) Ensures the proper implementation of policies, programs, and projects,
in coordination with the Sangguniang Bayan and Office of the Mayor.
e) Signs all required documents such as financial reports and related
documents and warrants/ checks drawn against SK Funds for all
expenditures.
f) Exercises general supervision over the affairs and the activities and
activities of the SK as well as over the official conduct of its members.
g) Exercises other powers and performs other duties and functions as may
be prescribed by law or ordinance.
Rule 4.
TEMPORARY PRESIDING OFFICER
Section 1. The SK Federation Vice President shall be the one to preside in case
the SK Federation President is absent due to justifiable reason.
Rule 6.
THE SECRETARY
a) Keeps and in coordination with other SK Federation Presidents, prepares
and updates all the records of the SK, and ensures the submission of
these records to National Youth Commission and the proper turn-over of
the data to the next set of SK Officials.
b) Posts a copy of the following official documents and papers on the
panlalawigang bulletin board and in at least three (3) conspicuous places
within the jurisdiction of the province, as well as makes available to any
person for her/his legal use: All resolutions approved by the SK; Annual
and end-of-term reports of the programs and projects implemented by
the SK; CBYDP and ABYIP.
c) Furnish concerned offices, institutions, and individuals with the said
documents and papers.
d) Prepare and keep the minutes of all SK regular session as well as special
session.
Rule 7.
THE TREASURER
a) Takes custody of all SK properties and funds and ensures proper
turnover to the next SK Treasurer;
b) Collects and receives contributions, monies, materials, and all other
resources intended for SK, and issues the corresponding official receipts;
c) Serves as cosignatory in all withdrawals from SK funds;
d) Disburses funds in accordance with the approved annual budget and
supplemental budget;
e) Certifies the availability of SK Funds;
f) At the end of every fiscal quarter, submits certified and detailed
Statements of Actual Income and Expenditures (SOAIE) to SK and SP;
g) Posts a copy of the SOAIE on the panlalawigang bulletin board and in at
least three (3) conspicuous places within the jurisdiction of the barangay;
and
h) Prepares a written financial report of all SK Funds and property under
her/his custody, renders and makes printed copies of this financial
report available to SK federation presidents.
Rule 8.
SESSIONS
Section 1. The SK Meeting is to be conducted every first Thursday of the
month at ten o’clock in the morning at a venue set by the SK Federation
President with the concurrence of majority of the SK Chairpersons in the
municipality.
Section 2. Special meetings may be called by the SK Federation President or
any four (4) of the SK members by giving notice of the date, time, place, agenda
of the meeting to all members which they should each receive at least one day
prior to the meeting.
Section 3. Majority of the SK Chairpersons of in the municipality o constitutes
a quorum.
Section 4. In the absence of the SK Federation President, the highest-ranking
elected SK official acts as the presiding officer.
Section 5. Every SK Chairperson shall confirm a day before the meeting if
he/she can attend the meeting or not. If the SK Official cannot attend the
meeting, a justifiable reason is required.
Rule 8.
PROPER ATTIRE
Section 1. All SK Chairperson shall follow the proper attire as approved in
attending monthly regular session as well as special sessions or meetings.
Rule 10
ORDER AND CALENDAR OF BUSINESS
Section 1. Order of Business. The order of Business of the Sangguniang
Kabataan for every session shall be:
a) Call to Order
b) Invocation
c) Roll Call
d) Reading, consideration and adoption of minutes of the previous session
e) Privilege Hour- The privilege hour is the time allotted for the members of
the Sangguniang Kabataan to express their own views, opinions,
comments or positions on various issues and affairs of public interest
especially concerns regarding the youth. It shall be in the form of
constructive criticism or comment on the issues presented or maybe
about the operation of services of the Sangguniang Kabataan.
f) Question Hour
g) First Reading and referral to committees of proposed resolution,
communication, petitions, messages, and memorials
h) Calendar of Business:
-Unfinished Business
-Business of the Day
-Unassigned Business
i) Proposed Resolutions for Third Reading
j) Announcement
k) Adjournment
Rule 11.
PROCEDURE FOR RESOLUTIONS AND OTHER LEGISLATIVE MATTERS
Section 1. Adoption of resolutions.
a) Legislative actions of a general and temporary character shall be enacted
in the form of resolutions. Matters relating to propriety functions and to
private concerns shall also be acted upon by resolutions.
b) Proposed resolutions shall be in writing and shall contain an assigned
number, a title or caption, an enacting or ordaining clause, and the date
of its proposed effectivity. In addition, every proposed resolution shall be
accompanied by a brief explanatory note containing the justification for
its approval.
c) The Sangguniang Kabataan shall brainstorm regarding the proposed
resolutions, shall be approved by the Sangguniang Kabataan.
Rule 12.
EFFECTIVITY AND POSTING OF ORDINANCES AND RESOLUTIONS
Section 1. Effectivity. Unless otherwise stated in the resolution, the same shall
take effect after the lapse of ten (10) days from the date of its posting.
Section 2. Posting. Copies of the Resolutions adopted by the Sangguniang
Kabataan shall be posted in a bulletin board at the panlalawigan and at least
two (2) conspicuous places such as public waiting sheds and public markets.
The Secretary shall post the resolution not later than five (5) days after its
approval.

Rule 13.
THE MINUTES
Section 1. The Sangguniang Kabataan shall keep the minutes of every session
and meeting.
Section 2. The minutes of the session and meeting shall be signed by all
members present during the meeting showing those who voted for and those
who voted against its approval. Each copy of the minutes must be signed by
the secretary and the presiding officer.
Section 3. The minutes of the meeting shall be read during the next meeting.
Rule 14.
DECORUM AND DEBATE
Section 1. Manner of Addressing the Chair. When a member desires to speak,
he shall respectfully address the chair, Mr/Ms “Chairman”.
Section 2. Recognition of Member to Speak. When two or more members rise
at the same time, the presiding officer shall determine and recognize the
member who is to speak first.
Rule 15.
VOTING AND MOTIONS
Section 1. The members of the Sangguniang Kabataan shall vote in case there
is need to vote.
Section 2. Voting shall be done thru raising their hands and be recognized.
The secretary shall count the votes.
Section. The SK Provincial President, being the presiding officer shall only vote
in case of a tie.
Rule 16.
DISCIPLINARY ACTIONS
Section 1. Any member who commits an act in transgression of the foregoing
Internal Rules of Procedures shall be punished with the corresponding
penalties hereunder prescribe, to wit:
a. For any absence without 1st Offense- Verbal/ Written warning
prior notice 2nd Offense- ( If consecutively done
after the first offense) Petition
-(If not consecutive), written explanation
to be read during the meeting.

Rule 17.
AMENDMENTS
Section 1. The “Internal rules of Procedure” maybe amended at any regular
session by two thirds (2/3) vote of all members of this sangguniang kabataan,
provided that prior notice of such proposed amended is given to all members of
the sanggunian, and provided further that no provision herein which is based
on, or prescribed by, existing laws shall be amended.
Rule 19.
EFFECTIVITY
Section 1. Effectivity. These Internal Rules of Procedures shall take effect upon
its approval.
