opposing argument.

Counter-Claim
 Types of Counter Claims
COMPULSORY CLAIMS
is a claim made by a defendant
against a plaintiff that arises from the
sam transaction or occurrence as the
plaintiff's claim, and which is forfeited
of not raised in the same lawsuit.
PERMISSIVE COUNTER CLAIMS
is a claim brought by a defendant
against a plaintiff in the situation
where the defendant's claim does not
arise from the same transaction or
occurrence as the plaintiff's claim.

COUNTER CLAIMS
After a bank has sued a customer for an
unpaid debt, the customer counterclaims
(sues back) against the bank for fraud in
procuring the debt. The court will sort out
the different claims in one lawsuit (unless
the claims are severed).

Two cars collide. After one person sues for
damage to his/her car and personal
injuries, the defendant counterclaims for
similar property damage and personal

 What Is Rebuttal?
A rebuttal is when you address and challenge a claim by
disapproving it.

After you have stated your counterclaim in an argument, you

add your rebuttal to why you disapprove it. The goal is to
weaken the main argument with your reasons and evidence.

The Rebuttal is another supporting reason why
your point of view is correct.

You Must use evidence to support your

Rebuttal. Use A quote, paraphrase or
summary with a citation. DON'T FALL ASLEEP ON
YOUR ARGUMENT!

just weaken it.
