Romualdez Marcos vs COMELEC

FACTS:
Imelda Marcos is originally came from Tacloban, Leyte. She then filed for certificate of
candidacy of the House of Representatives in the district of Leyte. It was being disputed
on the ground of alleging false statement to her residency. It was stated that Mrs.
Marcos lacked the 1 year residency requirement. It was alleged she stayed only for 7
months.

ISSUE: WON Imelda Marcos was a resident of the First District of Leyte to satisfy the
one-year residency requirement to be eligible in running as representative

RULING:
THE COURT RULED IN THE AFFIRMATIVE. The Court stated that insofar as the Civil
Code is concerned - affecting the rights and obligations of husband and wife - the term
residence should only be interpreted to mean “actual residence.” This is different from
the residence as domicile as we understand it in election law. An individual does not lose
his domicile even if he has lived and maintained residences in different places.
