ORDER BELOW EXH.1

1] The accused in Crime No. 174 of 2023

registered with police Station Padgha under Sec.354, of
Indian Penal Code, Sec.12 of The Protection of Children
from Sexual Offences Act, 2012, has sought his
enlargement on regular bail.

2] It is alleged by the informant (mother of victim

child, aged 15 years and 11 months ) that on 02.04.2023,
at about 1.00 p.m., when her husband and she were not
at home , applicant came, inappropriately touched and
teased the child and thereby outraged her modesty. On
the basis of such report, offence came to be registered.

3] It is the case of applicant that he has been

falsely implicated in the offence. There is no prima facie
evidence against him. The investigation of the case is

almost complete. They therefore prayed for enlargement

on bail.

4] The State resisted grant of bail as per say Exh.

4 contending that allegations are serious in nature. The
applicant may tamper with the prosecution evidence, if
released on bail. The state prayed for rejection of the
application. The informant however, prayed to release
the applicant on bail.

5] Heard Ld. Advocate for applicant and Ld. A.P.P.

Perused the record. Also gone through the investigation
papers.

6] The record discloses that the victim and the

applicant got acquainted on Instagram and used to
exchange messages. On 02.04.2023, he went to the
house of victim and that time, inappropriately touched
her. Such behaviour of the applicant, a young personof20
years is quiet offensive. But, now the investigation of
the case is almost complete and the charge-sheet is
likely to be filed shortly. The custody of applicant is no
more warranted. No propriety to detain the applicant
behind bar in such circumstances. His enlargement on
bail on stringent conditions will be just and proper. As a
result, the application is allowed. Hence, the following
order :

ORDER

allowed and it is directed that the applicant

Bajrang Mohan Tambe, age 20 years, occu. Student,
residing at Room No.3, New Balaji Nagar, Near
R.K.Palavi, Padgha, Bhiwandi be released on his
executing P R. bond of Rs.20,000/- (Rupees Twenty
thousand only) with one or two sureties in the like
amount in connection with crime No.174 of 2023
registered with Police Station, Padgha for the
offence punishable u/s 354 of Indian Penal Code
and Sec.12 of The Protection of Children from
Sexual Offences Act, 2012, on following conditions.
2. Applicant on being released shall attend this court
without fail on every date unless his personal
appearance is exempted.
3. He shall not commit an offence similar to the
offence for which he is accused or suspected.
4. He shall not directly or indirectly make any
inducement, threat or promise to any person
acquainted with the facts of the case so as to
dissuade him from disclosing such facts to the
court.
5. He shall furnish names, addresses and mobile
phone numbers / telephone numbers of his two
nearest relatives.
6. He shall furnish his permanent address, mobile
phone number / telephone number.
7. He shall keep himself away from the victim
and shall not contact the victim and her family
members in any manner.

8. Humdast allowed at the risk and cost of the

applicant.
