The Complex Case Manager plays a critical role in ensuring that the University meets its legislative and duty
of care obligations in managing and investigating the most serious, sensitive, and complex of Conduct &
Integrity Office cases, including public and protected disclosures (under both the PID and Corporations Acts),
Australian Research Integrity Committee, ICAC, and Ombudsman’s matters as well as other sensitive
matters requiring complex case management, such as gendered violence including sexual misconduct
cases.
The Complex Case Manager reports to the Director, Conduct and Integrity, and may be responsible for
supervising casual and contract staff as required.

Specific accountabilities for this role include:

• Lead, manage and conduct multiple complex and sensitive enquiries and investigations including
assessing complaints, evidence collection, overseeing forensic analysis, exhibit handling and interviews
of staff, students, experts and others.

• Prepare briefs of evidence drawing objective conclusions based upon a fair assessment of the evidence
gathered, and manage and maintain highly confidential information and records regarding complex and
sensitive matters.

• Interpret and apply complex legislation, policy and procedures in relation to managing and investigating
complex complaints and allegations to ensure that UNSW meets its obligations under relevant national
and international frameworks, funding agreements, laws and regulations.

• Develop and maintain best practice models, standard operating procedure (SOP), and templates for all
stages of the management of complex matters.
• Maintain accurate and up-to-date records of cases and decisions in the case management systems.

• Work closely with the Director, Conduct and Integrity Office, advising on complex matters as they arise,
including proactive advice on the risk management of matters, or where immediate corrective action is
required.

• Champion, research, recommend, and oversee the implementation of appropriate courses of action to
address problems as they arise in relation to systemic and organisational issues, processes, and
procedures, and disrupt and deter unethical conduct.

• Prepare regular timely, complex and confidential management briefings and reports on complex
matters to internal and external stakeholders for quality, risk and assurance review, including UNSW
Council and its committees, Management Board, NSW Ombudsman’s Office, ICAC and NSW Audit
Office, TEQSA and ARIC.

• Be a member of, and accountable to, the Gendered Violence Risk and Review Group; a Level 1 Health
and Safety sub-committee on Gendered Violence matters under the management of the Conduct &
Integrity Office.

• Promote a UNSW culture of ethical decision making by staff and students, ensuring legal compliance
by providing strategic, evidence based, advice on the development, review and application of UNSW’s
policies and procedures.

• Initiate, develop, maintain, and report on the University’s eLearning and other prevention and
engagement activities for reporting wrongdoing.

• Maintain the University’s Wrongdoing Prevention Framework, Control Plan and Risk Assessment and
related Policies and Procedures.

• Be the Subject Matter Expert on Wrongdoing and actively assist in implementation of the University’s
SpeakUp strategy Wrongdoing pillar.

• Ensure that eligible disclosers and/or alleged victims are provided with appropriate institutional wide-
support, are connected in with relevant external support services, are made to feel safe at UNSW, and
do not suffer detrimental action in reprisal for raising their concerns, making an allegation or report.

• Initiate, develop, and maintain positive strategic relationships with key internal and external
stakeholders, including managing the relationship and contractual arrangements with the external
whistleblowing/report wrong-doing service, other reporting pathways and service providers.

• Collaboratively work across the Conduct & Integrity Office Management Team, to deliver the Conduct
& Integrity Office strategy, business planning and objectives. This includes representing the Director
from time-to-time at university, state, national and international level meetings as required and assisting
other teams as required.

• Cooperate with all health and safety policies and procedures of the University and take all reasonable
care to ensure that your actions or omissions do not impact on the health & safety of yourself or others.

• Aligning with and actively demonstrate the UNSW Values in Action: Our Behaviours and the UNSW Code
of Conduct.
• A relevant tertiary qualification, or an equivalent level of knowledge, gained through a combination of
education, training and/or experience.

• Extensive experience in managing or investigating public interest disclosures and other complex cases
such as gendered violence, or internal audit function, involving multiple stakeholders in a large and
complex organisation.

• Demonstrated extensive skills and experience in conducting investigations, including developing


investigation and risk plans, securing evidence, interviewing witnesses, experts and others, and drawing
objective conclusions based upon a fair assessment and analysis of the evidence gathered, preparing
detailed investigation reports and maintain accurate records of the investigation.

• Expert knowledge, and application of procedural fairness and the requirements of the Public Interest
Disclosures Act 1994 (NSW), Corporations Act 2001 (Cth), Crimes Act 1900 (NSW), ICAC Act 1998
(NSW), Staff and Student Codes of Conduct, and related policies and procedures.

• Superior emotional intelligence with exceptional interpersonal and communication skills with the ability
to advise and communicate effectively, with a track record of engaging and influencing a wide range of
diverse stakeholders, including presentations and training as well as mediation and conflict resolution
in complex environments.

• Demonstrated superior sound judgment and an advanced level of emotional intelligence, especially in
relation to dealing with highly sensitive, confidential, and potentially controversial matters with tact,
sensitivity, and respect.

• An understanding of and commitment to UNSW’s aims, objectives and values in action, together with
relevant policies and guidelines.

• Knowledge of health and safety responsibilities and commitment to attending relevant health and
safety training.
