Meeting : Lupon Monthly Meeting

Date : January 31, 2022, 2:30pm (Monday)

 The meeting commenced at 2:30PM starting with the opening prayer by Lupon Vice President Billy
Esma.

 Lupon President called to order the regular meeting of the Lupon Tagapamayapa at 2:30pm on
January 31, 2022 at Lupon Tagapamayapa Office.

 Roll call Raquel Bulaong, Barangay Secretary conducted a roll call. The following persons were
present: Attendees’ name attached.
 Approval of minutes from last meeting. Mylene Rafada, Lupon Tagapamayapa Secretary read the
minutes from the last meeting. The minutes were approved as read with corrections.

1. REVIEW OF THE PREVIOUS MINUTES OF THE MEETING:


Lupon President asked the body if anything else was observed on the previous minutes of the
meeting.

1.1 CORRECTION OF THE PREVIOUS MINUTES OF THE MEETING:


OIC Chairman wants to clarify the following:
- Mediation – Mediation is the initial hearing which is conducted supposedly by the
Chairman of Lupon (Brgy. Captain). The Lupon on duty who conducted the hearing on
behalf of Chairman needs to write their full names of the Katitikan form.

- Conciliation - the Lupon on duty who conducted the conciliation needs to sign (full name
with signature) the Katitikan after the hearing.

- Motion for Execution – The Lupon who conducted the hearing on behalf of the
Chairman is required to write their initial on the Katitikan form

1.2. Demand Letter Forms to Vacate and Eviction for Implementation


- Brgy. Secretary requested a copy of the above forms for reference purposes.

3. REVIEW ON OTHER MATTERS ARISED:
A. CYBER LIBEL ON SHARING/COMMENT
 The respondent commented or shared cyber libel they can be punished, the principal
author will also be punished with cyber libel.

  B. VENUE/JURISDICTION ON CASES
 If the dispute property is located outside the Barangay then the case should be filed
where the property is located regardless if the complainant or respondent is a resident
on our Barangay.

C. SIMPLE THEFT vs. QUALIFIED THEFT


 Simple theft - refers to stolen properties with low cost (i.e. cellphone, shoes, clothes) 

 Qualified theft - Applied to domestic helpers regardless of amount.

D. RECKLESS IMPRUDENCE vs MALICIOUS MISCHIEF


 RECKLESS IMPRUDENCE: When the execution of the actions cause damage to
others' property, a fine from an amount equivalent to the value of the damage and a
fine shall be imposed.

 MALICIOUS MISCHIEF: Any person who shall deliberately cause the property of
another any damage with malicious intention.

E. INTRIGUING AGAINST HONOR vs. SLANDER


 Intriguing against honor is any scheme ruin the reputation of a person by means which
consist of some deceit and hersay.

 Slander is communicated verbally with the intent to defame the subject of the
statements. To make a false spoken statement that causes people to have a bad
opinion of someone

F. ESTAFA vs. BREACH OF CONTRACT


 Estafa its simplest explanation is a type of swindling that takes on different forms. Act
of obtaining money in a deceitful or fraudulent way

 Breach of contract violation of the terms of a contract, or failing to fulfill the promises
made on an agreement/contract

G. DEATH OF THE RESPONDENT ON COMPLAINT


 If the respondent is dead heirs or heiress to apply in relation to heirs/heiress estate.
(Judicial settlement of estate)

H. ALARM AND SCANDAL vs. UNJUST VEXATION


 Alarms and scandals are crimes of disturbance. It has to do with bringing disturbance
to public peace. Scandalous acts deemed offensive to good customs, morals and
public policy are considered as crimes of disturbance. Note that the crime is committed
if it is disturbing the peace in public nature. 

 Unjust vexation is broad enough to include any human conduct which, although not
productive of some physical or material harm, would unjustly annoy or irritate an
innocent person.

I. ESTAFA vs. LOAN


 Estafa  the crime of obtaining money dishonestly or by deceived. The legal term for the
criminal offense of swindling.

 Loan act of lending money to another person with the agreement of repayment within
a specific timeframe

J. SLANDER vs. SLANDER BY DEED


 Slander the action or crime of making a false spoken statement damaging to a
person's reputation.

 Slander by deed is a crime against honor, which is committed by performing any act,
which casts dishonor, discredit, or contempt upon another person. It is libel committed
by actions rather than words. Performing acts that will ruin tarnish or destroy a
person’s reputation.

K. INTEREST ON LOAN.
 Interest on loan must be written and will be removed if the amount is usurious to the
Court, however if the case was filed to the Barangay, interest will be tackled whether
written or not.

L. GENERIC CASES TO SPECIFIC CASES


 Harassment/Bullying – Barangay/generic
 Unjust vexation/Slander – specific/court

M. STAGES OF COMPLAINT CASES


 If the issue has not been resolved in the barangay and the complainant will transfer
the case to the court then it must go through the following procedures:
 Ist step ADR – Alternative Dispute Resolution
 2nd step JDR – Juditial Dispute Resolution
 3rd step - Court Hearing

N. PAYMENT ON MOTION FOR EXECUTION


 If the complainant refuse to accept the payment to insist to claim and need both
parties to convince, respondent to pay and complainant need to accept

O. PHYSICAL INJURY vs. SLANDER


 Physical injury means damage to any bodily issue to the extent that the issue must
undergo a healing process in order to be restored to a sound and healthy condition.
 Slander the action or crime of making a false spoken statement damaging to a
person's reputation.

P. DISCRETIONARY PLAN TO EXPLAIN REPUDATION/MOTION


 Follow the procedure to explain both.

Q. ACCELERATION CLAUSE TO BE GIVEN ON THE LATE PAYMENT


 Both parties to agree on the matter.

R. COMPLICATED/IMITATED
 Cases all handled accordingly

S. LUPON CAREFUL OBSERVANCE ON THE FOLLOWING


 1. Lupon on duty to come to work prior to their duty scheduled to review the case to
avoid confusion during the hearing time.

2. BP22 – reiterated that six (6) months duration of the hearing after six (6) months
To file the case in City Court

3. Informed that if both parties arrive or report directly to Lupon Office


hearing can be done even without the blotter report.

T. BPAT/VAWC ON JURISDICTION
 BFAT – to assist the barangay officials in the prevention of crime and the promotion of
public safety. No hearing or amicable settlement to be done. They only have to do
just submit the blotter report to Lupon Tagapamayapa office and the Lupon on duty will
be the one to conduct the hearing..

 VAWC - Respond to gender-based violence cases brought to the barangay. A special


law protecting of women and their children from all forms of abuse.

U. PICTURE DOCUMENTATION AFTER THE HEARING


 If the case has been settled Lupon on duty must take the photos of both parties for
documentation or reference purposes.

V. SERVER ON RESPONDENT’S CONTACT NUMBER


 Lupon President advised the summon server to obtain the contact information of the
respondents when delivering the summon letter.

W. PREFACE/OTHERS TO FOLLOW AND ADHERE


 Lupon President reiterated that every hearing should be implemented. All preferences
to be observed.

X. KP CASES/COMPLAINT SIGNATURE
 Always ask the complainant for their signature on complaint sheets/KP case form

5. OTHER MATTERS:
 Pres Lupon Ric instructed the body that no hearing should be scheduled on February
25, 2022 since it is a holiday due to Edsa Revolution.

 Pres Lupon reminded that hearings should be scheduled not more than one (1) week
by the Lupon on duty unless the client is unavailable on the date suggested then the
client will give the date to schedule the hearing.

 Inform the body that there is a QUARTERLY BEST EMPLOYEE program with
incentive c/o OIC Chairman Kgd. Efren Rodulfo Federico.

6. The next meeting was scheduled on February 28, 2022 (Monday) 2:00PM at Lupon
Tagapamayapa Office.
