SWORN AFFIDAVIT
I, ELLENA GUTIERREZ y MULDONG, 25 years old, female, single, resident of 113 Sitio
Saudi, Malabanias, Angeles City, after having sworn in accordance with the law, do hereby
depose and state that:
1. I was present at the crime scene when the suspect, Bricks Chester Montemayor,
committed the crime against the victim, Joselito Agustin Santos, and I witnessed how the
suspect’s car crashed towards Bruno’s Milk Tea Shop’s glass window and how the glass
shards flew.
2. On April 17, 2022, at around 3 o’clock in the morning, I was mopping the floor of
Bruno’s Milk Tea Shop because I am a crew in the shop. I started at the front of the store
until at the cashier register in the middle before the kitchen.
3. The same day at around 3:20 in the morning, right when I finished mopping the floor, I
talked to the shop’s security guard, Joselito Agustin Santos, that I am done with cleaning
and I will return the cleaning tools in the back for a bit. However, he did not respond and
was looking at the window.
5. While I was trying to talk to him, a black car with lights in high beam crashed onto the
window. I saw him trying to dodge the car and large fragments of glasses flew all over
the place.
4. I was in the cash register that’s why I was not injured. I was in a state of shock but I
heard noises of pain. It was from Joselito whose knees and body were covered in blood
due to the glass shards stuck in him.
 5. I immediately called a nearby hospital, AUF Medical Center, for help. After 10
minutes they arrived.
6. I also heard the driver of the black car, Bricks Chester Montemayor, cursing “Shit!
What the.” while touching the upper part of his eyebrow which has a small cut. He came
out of his wrecked car smelling and moving like he is drunk.
7. He did not try to help when I asked him for help and was on his phone checking
something. He even wanted to go first in the ambulance car after it arrived.

I executed this affidavit to attest to the truthfulness of the foregoing facts and to support the
filing of Criminal Cases against Bricks Chester Montemayor, suspect, in violation of Article
263 of the Revised Penal Code for Reckless Imprudence resulting in Serious Physical Injury.

IN WITNESS WHEREOF, I hereby affix my signature this 7th day of June 2022 at Angeles
City, Pampanga, Philippines.
