THIS TENANCY AGREEMENT IS MADE ON THE 1st DAY OF MARCH 2023

BETWEEN
MR IWUCHUKWU MBANEFO FRANK of House 1 Road 8c, Ogunfayo Royal
Estate, Ibeju-Lekki, Lagos State (Hereinafter referred to as the “LANDLORD”
which expression shall where the context admits include the person for time
being entitled to the reversion expectant upon the term hereby created)
AND
MR EMEKA TOCHUKWU of 3rf Avenue, Road, 302 Complex, Festac Town,
Lagos State (Hereinafter referred to as the “TENANT” which expression shall
where the context admits include their successor-in-title) of the other part.

WHEREBY IT IS AGREED AS FOLLOWS:


1. The LANDLORD hereby lets the TENANT takes all the TWO (2)
BEDROOM BUNGALOW SELF COMPOUND AT HOUSE 1, ROAD 8C,
OGUNFAYO ROYAL ESTATE, IBEJU-LEKKI, LAGOS STATE (Herein
referred to as THE PREMISES) for the use of the tenant, his servant
from the 1st Day Of April on yearly basis otherwise determined as
provided herein, paying, therefore, a yearly rent value of SEVEN
HUNDRED THOUSAND NAIRA ONLY (N700,000.00) per annum (The
receipt whereof the LANDLORD hereby acknowledges) payable in
advance on or before the 31st Day of March of each tenancy year.
The Tenant shall pay the Landlord the sum FOUR HUNDRED AND
FIFTY THOUSAND ONLY (N450,000.000) which shall be part
payment and the deposit of the next year's rent (April 2024-2025)
within 3 months from the date this agreement was made which shall
be on or before the end of June 2023, subject to the performance and
observation of the covenants, conditions, and stipulations contained in
this

2. THE TENANT HEREBY COVENANT with the LANDLORD as follows:


a. To pay the said rent on the day, time, and in the manner aforesaid
without deduction.
b. To pay rates, taxes, assessment, charges, and outgoing now and
hereafter legally payable in respect of the premises whether payable
by the owner or occupiers, to pay and discharge all electricity bills
and water bills which are made or may hereafter be assessed
charged or imposed upon payable in respect of the premises during
the term hereby assured and to produce upon request by the
LANDLORD or her agent the receipt of such payment made for the
above-stated services.
c. To use the premises for residential purposes only

d. To keep and maintain the interior of the premises including the
doors, windows, fixtures, water pipe, and all additions thereto in a
good and tenantable condition, fair wear and tear exempted, and/
or fittings that may become damaged by the TENANT or his agents
or servants.
e. T permit the LANDLORD and /her agent, servant, or workmen at all
reasonable times during the said term, upon giving the notice to view
the condition of the premises and to execute repairs and work
repaired to be done after the receipt of such notice from the
LANDLORD; to commence and proceed diligently with the execution
of the repairs and work and the cost thereof shall be borne by the
TENANT
f. To maintain a reasonably high degree of hygiene and sanitation on
the premises
g. To keep the septic tank and soak away of the demised premise
properly cleaned (from time to time) and the tenant shall bear the
cost of cleaning
h. To pay and discharge all taxes, township, water, and tenant rates,
penalties, assessment, duties, and outgoing of whatever description
which are or may be imposed or charged upon the premises or upon
the owner/use or occupier thereof to produce such evidence of
payment upon demand by the LANDLORD
i. Not to make or permit to be made any structural alterations on the
demised premises without the prior consent in writing of the
LANDLORD sought and granted
j. Not to assign, underlet, or part with the possession or any part
thereof otherwise than in accordance with this agreement
k. Not to do o permit to be done on the premises any act or thing which
may constitute an annoyance or nuisance to occupiers of other parts
of the building, township, or planning regulations including the
parking of cargo containers, kiosks, or any illegal structure within
or around the premises
l. Not to store or bring upon the premises or its appurtenances any
article of combustibles, inflammable, or any dangerous substance.
m. At the determination of the tenancy, restore the premise to its
original state.

3. THE LANDLORD HEREBY AGREES with the TENANT as follows;

a. Quiet Possession; That the tenant paying the rent hereinbefore


reserved and observing and performing the several covenants,
conditions, and stipulations herein on his part, shall peaceably hold
and enjoy the premises throughout the term without any
disturbance or interruption by the LANDLORD or any person or
agent claiming under or in trust for the LANDLORD

b. External Structural Repairs: The LANDLORD shall keep in good


condition the structure and exterior of the premises.

4. IT IS HEREBY FURTHER AGREED AND DECLARED as follows;

a. The LANDLORD shall not be liable for any Town or Council


Planning Law, Byelaws, or Regulation which may otherwise
vitiate the tenancy hereby created
b. The LANDLORD shall have the right to call for a review of the
yearly rent of the premises as agreed in the agreement.

5. PROVIDING ALWAYS AND IT IS HEREBY AGREED;

a. That the LANDLORD may determine this tenancy and re-enter


upon the premises in the event of any portion of the rent due
being in arrears for FOURTEEN (14) DAYS whether formally
determined or not or if any of the stipulations and conditions on
the tenant’s part herein contained shall not be observed or
performed
b. It shall be lawful for the LANDLORD or any person authorised by
the LANDLORD to at any time thereafter re-enter the premises or
any part thereof and this tenancy shall be determined without
prejudice to the right action of the LANDLORD in respect of any
breach of the convent herein contained on the part of the
TENANT.

6. QUIT NOTICE.
That the TENANT shall be entitled to SIX (6) month notice in case the
LANDLORD is not desirous of renewing the tenancy and without prejudice to
5(a) and (b) of this Tenancy Agreement.

IN WITNESS WHEREOF the parties HERETO have executed THIS TENANCY
AGREEMENT in the manner below and the day and year above written.
