RENTAL AGREEMENT

THIS AGREEMENT TO LEASE executed on the 1 st June 2023 (First June, Two Thousand And
Twenty Three)
BETWEEN:
1. Smt. Savitri Venkateshwaran, DOB 16/08/1962 (aged about 61 years), Aadhar Card No.
600507798717/PAN No.AADPV5475D, wife of Shri. A. Venkateshwaran resident of K-

2. Shri. Aditya Venkateshwaran, DOB 19/03/1994 (aged about 29 years), Aadhar No.
280094770751/PAN No. APVPV3191H, son of Shri. A. Venkateshwaran(father) and
Smt. Savitri Venkateshwaran(mother), resident of K-141 Brigade Parkside East,
Sarjapura Road, Haddosiddapur Road, Chikannahali, Bangalore 5600035

(Hereinafter referred to collectively as the “LESSOR” which expression shall, whenever the
context so requires or admits, mean, and include, its heirs, executors, administrators and
assignees): OF THE ONE PART

(Which term shall, wherever the context admits or permits, mean, and include his legal
representatives, Assets, heirs, successors-in-interest and in-title, assigns) here in after
referred collectively as “LESSEE”.

WITNESSES AS FOLLOWS:
WHEREAS the LESSOR is the sole and absolute owner of the residential apartment bearing
apartment No. K-141 plus 1 covered car park in Brigade Parkside East, situated at Sarjapura
Road, Haddosiddapur Road, Chikkannahalli, Bangalore – 560035. (Having a super built area of
1144 sq ft) which is more fully described and mentioned in the Schedule below and hereinafter
referred to as the "SCHEDULE PREMISES".

WHEREAS the LESSEE requested the LESSOR to let out the SCHEDULE PREMISES on monthly
tenancy and on the request of the LESSEE, the LESSOR has agreed to let out the same to the
LESSEEs, and the parties are desirous of documenting the terms agreed into writing.

NOW THIS AGREEMENT CONFIRMS AS FOLLOWS:


That in pursuance of the foregoing and in consideration of the rent hereby reserved and the
mutual covenants of Parties, the LESSOR hereby agree to grant, and the LESSEE hereby accepts a
lease of all that apartment no: Block K-141 , 1st Floor, one covered car park in Brigade Parkside
East, and more fully described in the Schedule below and hereinafter referred to as the

“SCHEDULE PREMISES”,

1. RENT:
1.1] The total monthly consideration agreed under this agreement between the Lessor and
Lessee is Indian Rupees. 46,000 (Rs Forty-six Thousand only), the rent including maintenance
per calendar month. The maintenance will be paid by the LESSOR for the duration of this
agreement.

1.2] The rent shall be paid on or before the 5th day of month for which it is due. If the 5thof the
month is a public holiday, it may be paid on the following working day.

1.3] Rent should be remitted or be deposited in Bank account of the LESSOR namely, Shri.
Aditya Venkateshwaran [PAN No. APVPV3191H]

2. DURATION:
That the Licensor hereby grants to the Licensee herein a revocable leave and license, to
occupy the Licensed Premises, described in Schedule I hereunder written without creating
any tenancy rights or any other rights, title and interest in favour of the Licensee for a period
of 22 months commencing from 01/06/2023 and ending on 31/03/2025

The duration of this Agreement of Lease in respect of the SCHEDULE PREMISES shall be initially
for a period of 11 (Eleven Months), commencing from 01 June 2023 to 02 May 2024.

The duration of this agreement shall be initially for a maximum period of 11 (ELEVEN)
MONTHS), commencing from 01 June 2023 to 02 May 2024 and shall be renewed on
mutual understanding by both the parties . After expiry of 11 months an increase of
5% in rent will be made over the existing rent for period commencing 3rd May 2024 to
3rd April 2025

However, if the LESSEE ceases this Agreement or the second Agreement before its entire tenure
(due to reasons of eviction from the society due to non-compliance of the rules of Brigade
Parkside East Management/Society/or any other reason causing harm/nuisance to the society
members ), maintenance charges (pro rata) for the number of months occupied will be
levied and deducted from the interest free deposit.

3. LICENSE FEE & DEPOSIT:


That the Licensee shall pay to the Licensor the following amount per month towards the
compensation for the use of the said Licensed premises.

a) Rs. 46000/-(Forty-six Thousand only) per month for the first 11 months,

b) Rs. 48,300/-(Forty-eight Thousand Three Hundred Only) per month for the next 11
months.

That the Licensee have paid the above mentioned deposit/premium as mentioned above by
remittance of an Amount Rs.2,00,000/-(Rupees Two Lakhs only)

The said interest free refundable security deposit shall be refunded to the LESSEE at the time of
the LESSEE vacating and handing over possession of the SCHEDULE PREMISES to the LESSOR
subject to deduction towards arrears if any such as electricity, gas, cable, telephone, and reasons
due to details mentioned in second paragraph of Point 2 regarding the Renewal.
The LESSEE shall return the flat to the LESSOR, after deep cleaning and without any damages to
the property caused to the premises and fittings, accepting for allowance for normal wear and
tear. However, the LESSEE shall not be liable for the loss or damage caused to the SCHEDULE
PREMISES due to direct or indirect Acts of God, including, lightning explosion, riot, strike,
earthquake, terrorism, malicious damage, impact damage, storm, typhoon, flood, etc.

If in the event of any damage which may have occurred to the general painting of the flat, the
LESSEE shall either paint the flat or the necessary payment shall be deducted from the interest
free deposit.

4. RATES/TAXES/OUTGOINGS:
The LESSOR will promptly pay, during the term of the Lease, all the existing and future rates,
taxes, deposits, cess, assessments, property taxes, and outgoings in respect of the SCHEDULE
PREMISES to the Corporation of the City of Bangalore or any other statutory authority including
deposits to be made for the water and electricity connections.

5. ELECTRICITY/TELEPHONE/ GAS/ WATER/CABLE CHARGES:


The LESSEE shall bear and pay the charges for water, gas & electricity consumed in the
SCHEDULE PREMISES as well as the cable & telephone charges/WiFi charges. The bill/ receipt
copy if any may be handed over to the LESSOR, if desired at the time of vacation of premises as
proof of there being no outstanding regarding the services set out in this clause.

6. MEMBERSHIP OF THE CLUB:


The LESSEE shall bear and pay the charges for the club membership in Brigade parkside East as
applicable to tenants and usage charges based on the club rules & usage of facilities by the
lessees. The club membership is effective from the date of the commencement of the lease and
is co-terminates with the cessation of the lease or vacation of the scheduled premises whichever
is earlier for whatsoever reason.

It is expected that the LESSEE and his family would be using the facilities of Brigade Parkside
East in a responsible manner and in accordance with the regulations laid by the association for
these facilities. As the facilities of Brigade Parkside East society is only for the residents, these

facilities are NOT permitted to be used frequently visiting friends of the LESSEE. Any fines
imposed by the Brigade Parkside East Association, on the said property, due to neglected usage
of resources, by the LESSEE, will have to be paid by the LESSEE directly to the concerned
authorities within the mentioned deadlines. These fine, in no way, can be adjusted with the rent or
the deposit paid towards the said property.

7. INSPECTION AND ENTRY:


The LESSOR shall be entitled to enter upon the SCHEDULE PREMISES with prior notice, once in a
six-month period and/ or depending on any urgency/necessity, to inspect the same and satisfy
themselves that the SCHEDULE PREMISES are being used in accordance with the terms of the
lease.

8. REPAIRS AND MAINTENANCE:


8.1] The LESSEE shall keep the SCHEDULE PREMISES and its fixtures and fittings in good
condition subject to normal wear and tear and shall not cause or suffer any damage thereto. The
LESSEE shall be responsible for all day-to-day repairs and maintenance such as replacement of
bulbs, electrical fuse, and plumbing at his own expense. If any damage takes place, the LESSEE
should repair the same at their cost and shall attend to the routine maintenance of the
SCHEDULE PREMISES. However, the LESSEE shall not be liable for the loss or damage caused to
the SCHEDULE PREMISES due to direct or indirect Acts of God, including lightning, explosion,
riot, strike, earthquake, terrorism, malicious damage, impact damage, storm, typhoon, flood,
etc.
8.2] The flat is cleaned and painted (If damaged), and LESSEE shall hand over the premises back
in same condition while vacating the premises, subject to normal wear and tear over the
duration of stay. At the time of vacating the schedule premises, the LESSEE shall paint the
schedule property with his cost and expense or shall pay the actual to the LESSOR, if any
damages to the painting have been caused. If any damages are not repaired, the LESSOR shall
deduct the cost involved for repair from the security deposit.

8.3] The LESSOR shall be responsible for all major structural, electrical, and plumbing repairs, if
they are not necessitated because of negligence or other acts of the LESSEEs.

8.4] The LESSEE shall not alter or suffer to be altered the existing lock device on the main
entrance door or any other door. If the LESSEE wishes to change the existing lock or any other
lock, then it shall take prior written permission from the LESSOR and provided further that it
gives the LESSOR one set of keys of the new lock and hand over the additional keys to the
LESSOR on handing over charge of the Schedule premises.

9. USE OF PREMISES:
9.1] The LESSEE shall use the SCHEDULE PREMISES for Residential purpose only.
9.2] The LESSEE shall not use the premises for any offensive trade purposes; they shall also not
store any hazardous, explosive materials which may cause the risk of fire and collateral damages

to the premises and the building. The LESSEEs shall not use the common area like corridor for
storing personal effects.

10. BAR ON ADDITIONS/ALTERATIONS, SUB- LETTING:


During the duration of this lease, the LESSEEs, at their own cost, shall be entitled to install
refrigerators, washing machines, and other electrical domestic appliances and telephone and
cable connections without causing damage to the premises. Moreover, The LESSEE shall not
carry out any structural additions or other alterations to the premises without written consent of
the LESSOR.

The LESSEE shall not sub-let, assign, or otherwise part with the possession of the SCHEDULE
PREMISES to or in favor of anyone else. No other person/s shall stay in the authorized premises
in the absence of/in lieu of the LESSEEs without the written and verbal approval of the LESSOR

11. DELIVERY BACK & CAUTION DEPOSIT REFUND:


On termination of the lease period, the LESSEE shall duly deliver back possession of the
SCHEDULE PREMISES to the LESSOR in the condition in which it was leased subject to normal
wear and tear, and subject to conditions mentioned previously in this Agreement, and receiving
in full the interest free refundable security deposit from the LESSOR.
While vacating the premises LESSEE shall provide receipts, if any, for clearing of all dues of
electricity, gas, water, maintenance charges, Brigade Club/Society charges, etc.
While vacating the premises LESSEE shall clean the entire schedule property (including ceiling)
and shall repair the damages (leakage, replace fused bulbs, fixing of
wardrobes/bathroom/kitchen/wooden flooring if damaged, etc.). The caution deposit will be
refunded back to LESSEE by the LESSOR once inspection of the repairs and painting is done to
LESSOR’s satisfaction. In case for some reason if the LESSEE is not able to do the requisite tasks
mentioned in the clause, an equivalent amount for each task will be deduced from the caution
deposit by the LESSOR and the remaining amount will be refunded back after handover of the
flat keys (2 keys to main door) to the LESSOR.

12. NOTICE FOR TERMINATION:


12.1] In the event the LESSEE committing any breach of the terms contained in this Rental
Agreement, it shall be open to the LESSOR to call upon the LESSEE to remedy the breach within
60 days and in case the LESSEE fails, neglects, or refuses to do so, then the LESSOR shall have the
right to terminate this lease notwithstanding the fact that the lease period has not expired.

12.2] In the event the LESSEE failing to pay the rent for TWO CONSECUTIVE MONTHS, the
LESSEE shall be liable to pay interest at the rate of 24% per annum on the outstanding rent and
the LESSOR shall be entitled to treat the same as breach and terminate the lease and shall be at
liberty to enter upon the SCHEDULE PREMISES.
During the duration of this lease, either party (LESSOR or LESSEE) can terminate the lease with 1
months’ notice or with 1 months’ rent in lieu of the said notice. Any notice by either side shall be

given at the address given above to the LESSOR and at the address of the scheduled premises to
the LESSEEs. The LESSEEs are required to furnish his office contacts and address who agree to
update the information when any change takes place.
12.3] This Agreement shall be governed by the laws of India and the courts at Bangalore shall
have exclusive jurisdiction in respect of matters under this Agreement.

13] The parties agree that stamp duty, registration fee and other expenses, if any, shall be borne
solely by the LESSEE.

SCHEDULE

All that apartment on the First (1st) floor bearing No. K-141 Block, plus 1 covered car park in
the building called K-Block situated in Brigade Parkside East, Sarjapura Road, Haddosiddapura
road, chikkannahalli, Bangalore 560035, measuring 1144 sq.ft. of super built up area,
consisting of 2 (Two) bedrooms 1 (one) basement car park and all usage rights of common
areas, common amenities as are available to the residents of the building / apartment block.

IN WITNESS WHEREOF, the PARTIES have executed this AGREEMENT OF LEASE by signing in two
