CRIMINAL COMPLAINT
Alias: Exzavion Isiah Shepard
Defendant. For Official Use

Complainant, Kevin Steuck, an Assistant District Attorney, being first duly sworn on oath,
deposes and says that:

Count 1: OBSTRUCTING AN OFFICER

The above-named defendant, on or about Thursday, June 1, 2023, in the City of Green
Bay, Brown County, Wisconsin, did knowingly obstruct an officer, while such officer was
doing an act in an official capacity and with lawful authority, contrary to sec. 946.41(1)
Wis. Stats., a Class A Misdemeanor, and upon conviction may be fined not more than
Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both.

Count 2: DISORDERLY CONDUCT

The above-named defendant, on or about Thursday, June 1, 2023, in the City of Green
Bay, Brown County, Wisconsin, while in a public or private place, did engage in abusive,
boisterous, indecent, profane, unreasonably loud, violent or otherwise disorderly
conduct, under circumstances in which such conduct tended to cause or provoke a
disturbance, contrary to sec. 947.01(1) Wis. Stats., a Class B Misdemeanor, and upon
conviction may be fined not more than One Thousand Dollars ($1,000), or imprisoned
not more than ninety (90) days, or both.

Complainant is an Assistant District Attorney with the Brown County District Attorney’s Office
and knows of the above offenses on information and belief based upon:

PROBABLE CAUSE:

The complainant, being duly sworn on oath, swears that he has had the opportunity to review
the police reports from Officers Snyder and Coron of the Green Bay Police Department, and
other documents supporting this complaint referenced herein, which are the types of reports
and documents kept in the ordinary course of business, which complainant believes to be
truthful and reliable because they have proven to be truthful and reliable on numerous
occasions in the past.

The complainant further asserts that based upon his review of the referenced reports and/or
supporting documents, the incidents alleged occurred in the City of Green Bay, Brown County,
Wisconsin.

1. Complainant’s review of the report of Officer Snyder, which indicates, in part:

On June 1, 2023, at approximately 7:08 PM, I, Officer Benjamin Snyder, was working in a
uniformed patrol duty as Unit 2C1, for the Green Bay Police Department, in the City of Green
Bay, County of Brown. I responded to 1521 Shawano Avenue, the Blaney Funeral Home, for
the report of a physical disturbance with approximately 30 people participating in the parking
lot and around the building. While en route, other officers had arrived on scene and were
requesting for many additional units to assist with uncooperative persons.

I arrived at the Walgreen’s across the street from this address, to Officer Heath Hermans, who
then advised me he didn’t need any more help, so I proceeded back across the street to the
funeral home where I briefly spoke with Officer Grant Fischer.

Officer Fischer advised me that a woman with a green purse needed to be taken into custody
due to this disturbance and because she had physically intruded into officers’ efforts prior to
my arrival. After waiting a few moments for other officers to arrive on scene so we could
hopefully better deal with the crowd and the expected uncooperative nature of this subject,
officers began to take her into custody and indeed she was not cooperative and it was a bit of
a struggle. Other officers engaged in that apprehension and I stood in between them and the
crowd to prevent any other subjects intrusion into that apprehension.

One male did come towards and I physically put my hand on his chest and after doing so, he
did not continue to proceed any closer after telling him to give us some space. As I was talking
to this male, another subject wearing a black hooded jacket and red pants was running
towards me and the other officers engaging in that above-mentioned apprehension in what
appeared to me to be an effort to get past me and insert himself into those officers’
apprehension of the woman with the green purse and fight the police off of her. I held out my
arm and put positive pressure against him and he immediately attempted to shrug this off and
get past me. Due to the knowledge that approximately 30 people were involved in a physical
altercation here in this parking lot, and unknown exactly who the subjects were, coupled with
this person who was wearing black and red running towards officers who were apprehending
an individual, I believe that he posed a continued physical threat towards these officers
mentioned and possibly even the individual they were taking into custody. Due to these
reasons, after this subject, who I later identified as Exzavion I. Shepard (05/23/2002), I
immediately attempted to decentralize him and get him to the ground to take him into custody,
after trying to push past me. This became very difficult, due to some of the momentum he had
built up and I was able to maintain a grasp of either his arm, his torso, or a combination of the
two. I attempted to redirect him during this effort to get him down to the ground and this caused
us to spin somewhat. After a slight struggle, I was able to get Exzavion to the ground, belly
down, with his right arm behind his back, and shortly thereafter, Officer Shawna Coron came to
assist me and we were able to get him in handcuffs.

We also had rescue come to the scene to access Exzavion and although I did not observe any
injuries to him, there were moments when he appeared to be unresponsive. It was unknown to
me whether or not this was a medical issue or continued lack of cooperation, but he was seen
by rescue personnel and he denied needing any medical treatment from them.

We then placed Exzavion into the rear compartment of Officer Coron’s squad car where I was
able to verify his identity with a Wisconsin ID card and we then proceeded to transport
Exzavion to the Brown County Jail where he was turned over to jail staff without further
incident.

2. Complainant’s review of the report of Officer Coron, which indicates, in part:

On Thursday, June 1, 2023, at approximately 7:02 p.m., I, Officer Coron, was on patrol in the
City of Green Bay, Brown County. I was in full uniform and in marked squad 52. I was acting
as 2D2. I heard officers being dispatched to a disturbance located at Blaney's Funeral Home
1521 Shawano Av. The call notes stated it was a physical disturbance involving 30 people.
Dispatch asked for additional units to respond. I responded with my emergency lights and siren
as the disturbance was still ongoing.

I arrived on scene and observed multiple people yelling at the officers on scene. I observed
Officer Snyder go hands on with a male and it appeared he was attempting to decentralize the
male. I tried to help control the male with Officer Snyder, but I was unable to. Officer Snyder
decentralized the male to the ground. I felt resistive tension in the male's arms when trying to
put his arms behind his back. As we were trying to get the male under control, there was still a
crowd of people behind us. They were angry and yelling at us. Another officer had to stand
behind us to keep the crowd from coming at us. I was also attempting to call for more officers
due to the large, unruly crowd.

I pulled out my handcuffs and attempted to handcuff the male, but I accidentally handcuffed
one of Officer Snyder's arms instead. I took his arm out of handcuffs and handcuffed the male
suspect. It appeared the male suspect was having a seizure as officers rolled him over. We
requested Rescue to the scene, and they arrived quickly. The male became alert and refused
any medical services. I asked the male for his name, and he told me his ID was in the back of
his phone. He was identified as SHEPARD, EXZAVAION I DOB 05/23/02. We searched him
incident to arrest and did not locate anything of evidentiary value on his person. I seated him in
the back of my squad and secured him with a seatbelt.

Based on the foregoing, the complainant believes this complaint to be true and correct.
