n1297 Saravanan Raja Retainer Agreement
This Retainer Agreement is made on 16th May 2023, between “Client” –SARAVANAN RAJA, residing, at
Bangalore, India and “RCIC” UNNIKRISHNAN KONDOOR KOIPRATHU ARAVINDAKSHAN of
Novus Immigration Services Pvt Ltd. located at #84 2nd floor, Brigade Road, Ashok Nagar, Bangalore,
Karnataka 560025.
WHEREAS the RCIC and the Client wish to enter into a written agreement which contains the agreed upon Terms
and conditions upon which the RCIC will provide his/her services to the Client.
AND WHEREAS the RCIC is a member of Immigration Consultants of Canada Regulatory Council (the
“Council”), the regulator in Canada for immigration consultants;
1. Definitions
The terms “Client”, “Council” and “Disbursement” shall have the meaning given to such terms in the Retainer
Agreement
Regulation and By-law of the Council.
IN CONSIDERATION of the mutual covenants contained in this Agreement, the parties agree as follows:
In consideration of the fees paid and the matter stated above, the RCIC agrees to do the following:
a) Advise the client with respect to Canadian Immigration Law on application for spousal open work permit.
b) Advise the client about required documents.
c) Ensure all documentation is in order and meet requirements.
d) Apply spousal open work permit.
e) Handle all correspondence with IRCC on client’s behalf in respect to his/her application.
f) Keep him/her updated on the processing of the application till its expiry or completion.
In the event Immigration, Refugees and Citizenship Canada (IRCC) or Employment and Social Development
Canada (ESDC) should contact the Client directly, the Client is instructed to notify the RCIC immediately.
4. Compliance Clause:
A Regulated Canadian Immigration Consultant is bound by the Canadian code of ethics to not promise a
positive outcome and guaranteed result to any of his/her clients as the same depends on a plethora of factors that
are dynamic in nature. This office represents you in the best possible manner for accruing your optimum
prospects.
5. Payment Schedule:
The professional fees will be paid by the Client to the RCIC in the following manner:
On signing of retainer agreement: CAD $1000+GST
Total: CAD $1000+GST
The prices might vary according to the exchange rate with respect to the date of payment.
(The total offer given to the client is INR 60,000 +GST)
Applicable government fees will be paid by the client as and when instructed by the concerned
department.
6. Methods of Payment:
We accept the following:
● Cash
● Credit Card
● E –Transfer
● Google Pay
7. Refund Policy
The Client acknowledges that the granting of a visa or status and the time required for processing this
application is at the sole discretion of the government and not the RCIC. If, however, the application is denied
because of an error or omission on the part of the RCIC or professional staff, the RCIC will refund all
professional fees collected. The Client agrees that the fees paid are for services indicated above, and any refund
is strictly limited to the amount of fees paid.
In the event the Client is unable to contact the RCIC and has reason to believe the RCIC may be dead,
incapacitated, etc., the Client should contact ICCRC.
a. Refund:
Each client case being unique, we do not compromise on the quality of our service and we put in 100% in
every case to ensure that your application receives a positive result, although the final decision is taken by the
CIC. In case, the application gets rejected due to an error or omission on part of the RCIC, we will refund
100% of the fee charged, without any terms and conditions.
Once the retainer agreement is signed, you could request for a refund within 7 working days. No request for
refund would be considered for any purpose beyond this point. The firm would credit only 75% of the
principal amount, 25% would be deducted as agency charges. If the client faces any issues/grievances which
is attributed to the negligence or erroneous error committed by the RCIC, due procedures will be applicable
and the necessary steps to safeguard the rights of the customer shall be made by the firm.

b. Guarantee/Promise/ Assurances:
We understand your concerns of “deriving value for the money spent”! Hence we categorically mention the
simple fact that you are paying the firm for the legal and representation services it provides for you. Novus is
not a part of any government body (embassy, visa application centers,). We are a Private entity and do not
hold the authority to grant you a visa of any kind. Please note that the final decision on all visa applications
rests with the relevant government department in the respective country. We do not guarantee you a positive
result on your application as the Regulatory body that governs this profession ICCRC - https://iccrc-crcic.ca/
mentions the same as one of the RCIC’s code of ethics. Hence, there is no refund in case of a rejection (ex-
TRV application).
8. Dispute Resolution
Please be advised that RCIC is a member in good standing of the Immigration Consultants of Canada
Regulatory Council (ICCRC), and as such, is bound by its By-Laws, Code of Professional Ethics, and
associated Regulations. In the event of dispute, the client and RCIC are to make every effort to resolve the
matter between the two parties. In the event a resolution cannot be reached, the client is to present the
complaint in writing to the RCIC and allow the RCIC seven (7) days to respond to the Client. In the event the
dispute is still unresolved, the Client may follow the complaint and discipline procedure outlined by ICCRC
on their website: http://iccrc-crcic.ca/FileaComplaint.cfm.
9. Confidentiality
All information and documentation reviewed by the RCIC, required by Service Canada and CIC and all other
governing bodies, and used for the preparation of the application will not be divulged to any third party, other
than agents and employees, without prior consent, except as demanded by law. The Client agrees to the use
of electronic communication and storage of confidential information. The RCIC will use her best efforts to
maintain a high degree of security for electronic communication and information storage.
12. Termination
This Agreement is considered terminated upon completion of tasks identified under section 2 of this
agreement.
This Agreement is considered terminated if material changes occur to the Client’s application or eligibility,
which make it impossible to proceed with services detailed in section 2 of this Agreement.
Pursuant to Article 11 of the Code of Professional Ethics, this Agreement may be terminated, upon writing,
by the RCIC, provided withdrawal does not cause prejudice to the Client.
The Client acknowledges that they have read this Agreement, understand it, and have obtain independent
legal advice and translation prior to the execution and delivery of this Agreement.
The Client acknowledges that he/she has requested that the Agreement be written in the English language.
