On motion presented by Councilor Ferdinand T. Eusbeio, duly seconded, all present members of the
Sangguniang Panlungsod approved the following City Resolution on second and final reading except
Councilor Nemesio S. Yabut, Jr. who voted No.

A RESOLUTION EXPRESSING STRONG OPPOSITION TO ANY MOVE


OF AMENDING THE CONSTITUTION THROUGH PEOPLE’S
INITIATIVE AND FURTHER CONDEMNING THE HIGHLY
IRREGULAR MANNER BY WHICH THE PRO-CHARTER CHANGE
WERE CONDUCTED.
WHEREAS, the Constitution is the highest law of the land and the sacred instrument that binds the
people, as such, any move to revise or amend it must be of good intentions of promoting the welfare
and uniting our people;

WHEREAS, the present initiatives to amend the Constitution is widely perceived as a mere ploy
designed to perpetuate Mrs. Gloria Macapagal Arroyo and cohorts in power deviating from its true
intent and purpose of promoting the welfare and unifying the people;

WHEREAS, legal constraints bar any move to amend the Constitution thru people’s initiative in the
light of the ruling of the Supreme Court in the case of Santiago vs. COMELEC that Republic Act No.
6735 is inadequate to cover a people’s initiative to amend the constitution;

WHEREAS, the highest tribunal also made a categorical pronouncement that Comelec is
“permanently enjoined” from entertaining any such petition until a “sufficient law” is enacted to
implement the law;

WHEREAS, anomalous or highly irregular means of obtaining signatures for people’s initiative were
reported, not to mention the allegations that government agencies are spearheading the campaigns,
which, if true, would render the whole exercise illusory as true and genuine initiative of the people;

WHEREAS, present conditions are not conducive to any move for an honest to goodness amendment
or revision to the constitution.

NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED BY THE


SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF THE
POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, to express strong opposition to
any move of amending the Constitution through people’s initiative and further condemning the highly
irregular manner by which the pro-charter change signature campaigns were conducted.

Let copy of this Resolution be furnished the COMELEC, DILG and other Offices for their
information and guidance.

This Resolution shall take effect immediately upon its approval.
