correlated color temperature and color rendering index
were calculated from the spectral radiant flux
measurements taken at 1 nm intervals over the range of

De mi consideración:
El Servicio de Acreditación Ecuatoriano (SAE), fue creado por la Ley del Sistema Ecuatoriano
de la Calidad, como una entidad técnica de derecho público, organismo oficial de acreditación
de evaluación de la conformidad en el Ecuador, que evalúa la competencia técnica,
transparencia e independencia de las entidades dedicadas a la evaluación de la conformidad,
cuya misión es la de garantizar la seguridad y calidad de productos y servicios para el
consumo y comercialización nacional e internacional, fortaleciendo así la infraestructura de la
calidad del país mediante la acreditación de la competencia técnica de los organismos de
evaluación de la conformidad, contribuyendo al fortalecimiento de la matriz productiva del
país.
De conformidad a lo dispuesto en el artículo 9 numeral 4 de la Ley Orgánica de Contratación

Pública (LONSCP), entre los objetivos prioritarios del Estado, en materia de contratación
pública, se encuentra el de “Convertir la contratación pública en un elemento dinamizador de
la producción nacional”.
El artículo 21, literal b) de la Ley del Sistema Ecuatoriano de la Calidad, establece como una
de las competencias del Servicio de Acreditación Ecuatoriano: “(…) b) Cumplir las funciones
de organismo técnico nacional, en materia de la acreditación de evaluación de la conformidad
para todos los propósitos establecidos en las leyes de la República, en tratados, acuerdos y
convenios internacionales de los cuales el país es signatario (…)”.
El artículo 26 ibídem manifiesta: “Los organismos de evaluación de la conformidad de

observancia obligatoria que operen en el país, deberán estar acreditados ante el Organismo
de Acreditación Ecuatoriano – OAE o ser designados por el Ministerio de Industrias y
Productividad, según corresponda, y en concordancia con los lineamientos internacionales
sobre acreditación. El OAE reconocerá como válidas aquellas acreditaciones otorgadas a
organismos que operen en el país, siempre y cuando existan y estén vigentes acuerdos o
convenios de reconocimiento mutuo, bilaterales o multilaterales, entre el OAE y los
organismos de acreditación de otros países que hayan extendido dichas acreditaciones”.
El artículo 31 de la Ley del Sistema Ecuatoriano de la Calidad manifiesta: “Previamente a la

comercialización de productos nacionales e importados sujetos a reglamentación técnica,
deberá demostrarse su cumplimiento a través del certificado de conformidad expedido por un
organismo de certificación acreditado en el país, o por aquellos que se hayan emitido en
relación a los acuerdos vigentes de reconocimiento mutuo con el país.
En las compras y adquisiciones de bienes y servicios de los organismos del sector público,
incluyendo las entidades autónomas, deberá demostrarse el cumplimiento de la calidad de
dichos bienes y servicios con los reglamentos técnicos pertinentes mediante un certificado de
conformidad expedido por un organismo de certificación acreditado o designado en el país.
Los jefes de compras y adquisiciones, los fiscalizadores y los directores de las áreas
financieras de las entidades públicas serán responsables directos en caso de incumplimiento
de lo establecido en el inciso inmediato anterior.
Los productos que cuenten con sello de calidad del INEN, no están sujetos al requisito de
certificado de conformidad para su comercialización.
La forma y periodicidad con la que deberá demostrarse la conformidad, será la misma para
productos nacionales e importados, a través del reglamento.”
El artículo 60 del Reglamento General a la Ley del Sistema Ecuatoriano de la Calidad,

establece: “Los servicios de evaluación de la conformidad que operan en el país estarán a
cargo de las entidades públicas o privadas, debidamente acreditadas por el OAE y por otros
organismos de acreditación con los cuales el OAE haya firmado acuerdos de reconocimiento
mutuoo que hayan sido designados por el MIPRO. Los certificados de conformidad otorgados
por dichas entidades serán los únicos considerados como oficiales (…)”.
El Servicio de Acreditación Ecuatoriano, es signatario de los Acuerdos de Reconocimiento

internacional IAAC/IAF/ILAC y del Multilateral Agreement (MLA) / Mutual Recognition
Arrangement (MRA), motivo por el cual entre sus obligaciones se encuentra las de:
- Reconocer la operación de los sistemas de acreditación de otros signatarios como

equivalente al suyo propio, cuando estos están dentro del alcance que el SAE ha suscrito.
- Recomendar y promover la aceptación de los certificados e informes emitidos por los
organismos de evaluación de la conformidad acreditados por los otros signatarios como
siendo equivalentes a aquellos emitidos por laboratorios y/u organismos de certificación
y/o inspección acreditados por el SAE.
Por lo expuesto y en atención a la Solicitud Nro. 47326193C, el Servicio de Acreditación

Ecuatoriano realizó la verificación del documento del Organismo de Evaluación de la
Conformidad, cuyos resultados se presentan a continuación:
