ORDER DENYING DEFENDANT INGERSOLL'S


MOTION FOR SUMMARY JUDGMENT

PRESENT: HONORABLE JAMES W. BOYD


United States Bankruptcy Judge

On March 28, 2023, this court entered a Scheduling Order regarding Plaintiff
Independent Bank's Motion for Partial Summary Judgment. (AP Dkt. No. 212.) Among
other things, the Scheduling Order required all dispositive motions "on an issue or count
not addressed in the Bank's pending motion for partial summary judgment" to be filed by
no later than May 26, 2023.

On June 1, 2023, pro se Defendant Steven Ingersoll filed a Motion for Summary
Judgment. (AP Dkt. No. 235.) The court has reviewed the motion and has determined
that it was filed after the deadline established in the prior Scheduling Order and must be
denied on that basis.

NOW, THEREFORE, IT IS HEREBY ORDERED that Defendant Ingersoll's Motion


for Summary Judgment (AP Dkt. No. 235) be, and hereby is, DENIED.

IT IS FURTHER ORDERED that Defendant Ingersoll's prior Motion to Dismiss (AP


Dkt. No. 220), which the court converted to a motion for summary judgment by order
entered on May 22, 2023, remains pending. All deadlines established in the court's prior
Scheduling Order Regarding Defendant Ingersoll's Motion to Dismiss (AP Dkt. No. 233)
remain in effect.

IT IS FURTHER ORDERED that the Clerk shall serve a copy of this order pursuant
to FED. R. BANKR. P. 9022 and LBR 5005-4 upon:
