ASSIGNMENT:
Following the directions in the box below, locate an article in the publication Canadian
Employment Law Today related to the “duty to accommodate to the point of undue hardship”
under human rights legislation.
Answer the questions on the assignment sheet

Click “ABI/INFORM Collection” (it’s towards the middle of the

Log in as requested
Put “Duty to accommodate” in the top search bar (so you can
canvas relevant articles from many issues of this publication, not
just one)
Locate a recent article (from 2020 to present) on a Canadian case
where the legal issue is whether the employer fulfilled its human
rights duty to accommodate to the point of undue hardship an
employee based on one or more of the prohibited grounds of
discrimination. For full marks your case must fit within these
requirements.

collective agreement, doctor’s notes, written witness statements, functional ability forms,
incident reports, x-rays, job description). (3 in total, not 3 for each side). HINT: you’ll have
to deduce – figure out - what these written pieces of evidence are from the article. This
question is meant to highlight the importance of documentary (written) evidence.
