CENTRE-STATE RELATION
In Indian Union, the constitution of India being federal in nature divides all powers into legislative, executive &
financial relations.
IMPORTANT TO NOTE:
- There is no division of judicial power as the Constitution has established an integrated judicial system to
enforce both the ‘central laws’ as well as ‘state laws.
▪ The Supreme Court has included ‘Federalism’ in the basic structure of India. Though it also stated that India is
not absolute federalism.
▪ India is stated to be a quasi-federal country and classified as “a unitary state with subsidiary federal principles
rather than a federal state with subsidiary unitary principles.”
▪ Moreover, the Indian Constitution does not mention the word “Federation”, rather Article 1 of the Constitution
states India to be a “Union of States”.
▪ India has a quasi-federal structure which means it stated as a Union of States (Cooperative Country) –
has taken ‘partly federal’ & ‘partly unitary’ features. according to Article 1 of the Constitution.

भारतीय संघ में, भारत का संविधान प्रकृवत में संघीय होने के कारण सभी शक्तियों को विधायी, काययकारी और वित्तीय संबंधों में

संघवाद क्या है ? भारत का संविधान संरचना में संघीय हैं िो शासन की सभी
शक्तियों विधायी(, काययकारी और वित्तीय शक्तियों) को केंद्र

▪ इसके अलािा, भारतीय संविधान में "संघ" शब्द का उल्लेख नहीं है , बक्ति संविधान के अनुच्छेद 1 में भारत को "राज्यों का
संघ" कहा गया है ।

101वा संशोधि अवधवियम 2016 द्वारा एक विशेष प्रािधान िस्तु और सेिा के कर से संबंवधत बनाया गया है तदनुसार, संसद और
राज्य विधावयका को संघ या राज्य द्वारा लगाए गए माल और सेिा कर के संबंध में कानून बनाने की शक्ति है ।
▪ संसद के पास 'अंतरराज्यीय' व्यापार या िावणज्य से संबंवधत कानून बनाने की विशेष शक्ति है।
