Consent Election Run-off Election
1. By voluntary and mutual Requisites:
agreement of contending 1. 3 or more participating unions in a
unions certification/consent election
2. With or without the 2. None of them garnered the majority of the votes
participation of DOLE cast.
3. Total number of votes garnered by all
contending union if added is atleast 50% of the
votes cast.
4. Only the two unions receiving the highest votes
shall participate.
5. No union no longer an option
If above requisites are present and no objections
which, if granted, would substantially alter the
results, Election Officer should motu propio cpnduct
run-off election within 10 days between the two
unions receiving highest votes from close of the
election between the labor unions receiving the two
highest votes.
Within 10 days from close of election proceedings.
Re-run Election
Grounds:
1. To break a tie. (With another union or with No Union
option).
2. To cure failure of election.
3. Certification, consent or run-off is nullified due to
serious irregularities committed during conduct of
election (Jurisprudence)
If No Union gets majority, no failure of election.
In case of tie:
1. Election officer shall post notice within 5 days from
certication or consent election.
2. Election shall be held within 10 days from notice.
In case of failure of election:
1. Within 6 months from declaration of failure of election
