ORDER BELOW EXH­  1

1.  The present suit is filed on 18 th March 2016. The plaintiff
absent   since   05/10/2019.   In   response   to   the   suit   summons,   the
defendant appeared and filed written statement and counterclaim vide
Exh. 12.

2. Considering   the   frequent   absence   of   the   plaintiff,   the

notice vide Exh. 21 is sent to the plaintiff by Registered Post A.D. on
05/11/2019, it was returned with postal endorsement that “ always
door lock ”. Thereafter also on 26/03/2021 the second notice vide Exh.
22 is sent to the plaintiff, but the plaintiff did not appear before Court
and proceeded with the suit.

3. Today also plaintiff is absent when called out. Therefore,
it   reveals   that   the   plaintiff   is   reluctant   to   proceed   with   the   matter.
Hence, I proceed to pass the following order.

ORDER
1. The suit of the plaintiff is dismissed in default. 
2. The   suit   be   proceeded   for   the   counterclaim   filed   by   the  
defendant.
