MEMORANDUM OF AGREEMENT
This Memorandum of Agreement is made and entered into by and between the
following:

WHEREAS, pursuant to Republic Act No. 7719 or the National Blood Services
Act of 1994, it is thereby declared a policy of the State to provide for adequate, safe,
affordable, and equitable distribution of supply of blood and blood products;

WHEREAS, the said Act likewise provides the following essential purposes: (1) to
promote and encourage voluntary blood donation by the citizenry and to instill public
consciousness of the principle that blood donation is a humanitarian act; (2) to inform
the public of the need for voluntary blood donation to curb the hazards caused by the
commercial sale of blood; (3) to lay down the legal principle that the provision of blood
for transfusion is a professional medical service and not for a sale of a commodity; (4) to
mandate the Department of Health to establish and organize a National Blood
Transfusion Service Network in order to rationalize and improve the provision of
adequate and safe supply of blood; and (5) to provide for adequate assistance to
institutions promoting voluntary blood donation and providing non-profit blood services,
either through a system of reimbursement for costs from patients, or donations from
governmental and non-governmental entities;

No. 9 s. 1995, the National Council of Blood Services shall be the governing body of the
Philippine National Blood Services composed collectively by the blood centers of the
Department of Health, Philippine Red Cross and selected Local Government Units

wherein the functions of the Blood Center is the collection, testing, storage, issuance,
transport and distribution of whole blood and blood components to blood service
facilities and end-user hospitals under its network;
WHEREAS, the goals of the strategic plan for 2016-2022 of the National
Voluntary Blood Services Program are the following: (1) Attainment of 100% voluntary
non-remunerated blood donation nationwide by 2020; (2) Institutionalized Blood Center
Model; (3) An adequate and sustainable financing for National Voluntary Blood Services

Program and Operation of BSF; (4) A quality management system for the NVBSP and

Blood Service Facilities; (5) Robust, operational and universally accessible Information
Management System; and (6) Rational use of blood/blood products in all transfusing

healthcare facilities;
WHEREAS, the FIRST PARTY is the designated Lead Blood Center in Metro
Cebu under the Philippine National Blood Services duly authorized to collect, process,
test and distribute quality blood products to its network of blood service facilities;
WHEREAS, the SECOND PARTY is the implementing unit of all DOH programs

which includes the National Voluntary Blood Services Program and it is a good source of
safe human blood through voluntary blood donation;
NOW, THEREFORE, for and in consideration of the foregoing premises and for
the terms and conditions herein stipulated, the Parties hereto mutually agree and
covenant as follows:

for this purpose, and upon presentment of the referral document signed
by the Health Officer or duly authorized representative duly endorsing
the patient-residents to the FIRST PARTY.

2. Arrange the schedule and venue for the conduct of the Blood Donation
Recruitment Orientation and Mobile Blood Donation Activities the
MLGUs/BLGUs, in coordination with the FIRST PARTY;
3. Provide a list of pre-listed donors a week before the Blood Donation
Activities to the FIRST PARTY for the latter’s manpower and logistical
preparations;

4. Inform the FIRST PARTY of the details in the conduct of the Mobile
Blood Donation. Any changes in the schedule and/or venue should be
expediently made known to the FIRST PARTY before the intended
dates.
5. Provide transportation services, as may be required by the Mobile Blood

a. This MOA shall not be amended nor modified without the consent of the
contracting parties. Any amendments or modifications thereto shall be

a. The Parties represent and warrant that all necessary actions, corporate,
internal, and other similar approvals necessary for the execution of this
MOA have been duly obtained.

b. They further warrant that the respective signatories herein are duly
authorized for this purpose.

b. For this reason, the Parties shall observe and comply with the provisions
of the Data Privacy Act of 2012 and its Implementing Rules and
Regulations in case the undertakings will involve the personal information
or sensitive personal information.
