The percentage of adjustment for the lump sum discount of minus HK$100,000.00 which shall be used as a basis of payment valuation and applied to all unit rates and pricings (except those reasonable rates confirmed in Post Tender Queries) for future valuation of variations is -15.63% and is derived from below:- Lump Sum Discount «100% Discount factor Original Tender Sum - Preliminaries x 100% 3. The Date for Possession and Date for Completion of the Works shall be as follows:~ Date for Possession Within 7 days from Architect's written notification (Tentative Date for Possession to be early August 2017) Date for Completion Stage 1— Field Works: 30 calendar days from and including the Date for Possession Stage2— Field Works and Laboratory Test Works: 45 calendar days from and including the Date for Possession 4, The rate of the Liquidated and Ascertained Damages for the Contract is HK$ 15,000.00 per calendar day for Stage 1 and 2 respectively in accordance with the terms and conditions of the Contract. 5. The payment terms as referred to Clause 19 of the Conditions of Contract shall be as follows: - (a) The first payment shall be made to the Contractor upon the completion of Stage 1 of the Works as certified by Architect/ Engineer. The payment shall represent up to 40% of the total value of the Works carried out. (b) The second payment shall be made to the Contractor upon the completion of Stage 2 of the Works as certified by Architect/ Engineer. The payment shall represent up to 95% of the total value of the Works carried out. (©) The final payment shall be made to the Contractor upon the issuance of certificate of completion of making good defects of the Works and agroement of the final account for the Works whenever is the latest. Employees’ Compensation Insurance policy, Insurance of the Works and Third Party Insurance shall be taken out before the commencement of Works and maintained by you in accordance with the terms and conditions of the Contract. 7. This Letter of Award together with your submitted tender and the subsequent correspondence listed in Appendix ‘A’ hereto shall form part of the Contract hereby awarded. 8. Unless otherwise defined herein, all capitalized terms in this Letter of Award shall have the same meanings as those defined in the Contract. In case of discrepancies found between this Letter of Award, correspondence listed in Appendix “A” and your submitted tender, the one bearing a later date shall take precedence. 9. Unless otherwise expressly and specifically accepted in writing and referred to in this Letter of Award, all tender qualifications are hereby agreed to be unconditionally withdrawn, Unless and until a formal contract is prepared and executed, this Letter of Award together with your submitted tender and the correspondence listed in Appendix ‘A’ hereto, once signed by you, shall constitute a binding contract between you and the Employer. Please signify your acceptance of the terms and conditions of this Letter of Award by signing the original and duplicate copy of this letter and returning the original copy to us within three days from the date of this letter.
