1. DISCUSS THE ROLE AND OBJECTIVES OF PAROLE AND PROBATION ADMINISTRATION.

The mission and goals of the parole and probation administration are to promote peace and
social justice. The parole and probation administration is responsible for the safety of
convicted criminals as well as those on probation or parole. The endeavor aims to support
criminal offender reform and reduce recidivism by providing a less expensive alternative to
institutional imprisonment for first-time offenders who are likely to respond to focused,
community-based treatment programs. Through its network of regional and field parole and
probation offices, the agency's role is to carry out these goals by managing the parole and
probation system, supervising parolees, pardonees, and probationers, and encouraging the
correction and rehabilitation of criminal offenders.

Probation was first introduced in the country with the enactment of Act No. 4221 of the Philippine
Legislature on August 7, 1935. This law created a Probation Office under the Department of Justice.
On November 16, 1937, the Supreme Court declared it unconstitutional through People vs. Vera (37
O.G. 164), due to the following grounds:

1. The said act encroaches upon the pardoning power of the executive

2. That it constitute an undue delegation of legislative power, and

3. It denies the equal protection of the laws.

In 1972, House Bill No. 393 was filed in Congress which would establish a probation system in the
country.This bill avoided the grounds for Act 4221 declared as unconstitutional. It was passed by the
House of Representatives, but was pending in the Senate when Martial Law was declared and
Congress was abolished.

Role of Probation in the Correctional System

Probation as defined under Presidential Decree 968, is a disposition under which a defendant,
after conviction and sentenced, is released subject to conditions imposed by the court and to
the supervision of a probation officer. It is a community based program that has the following
significant roles in the correctional system:
1. It promotes a more enlightened and humane correctional system by extending to offenders
individualized treatment programs instead of imprisonment;

2. It helps offenders' reformation, who are likely to respond favorably to the program, and

3. it reduces the incidence of recidivism Parole and pardon are intended to rehabilitate and reintegrate
persons back into society.

The following are the goals of probation:

1. To establish a more enlightened and humane corectional systems that will promote the reformation
of offenders and thereby reduce the incidence of recidivism;and

2. To provide a less costly alternative to the imprisonment of offenders who are likely to respond to
individualized, community- based treatment programs because the confinement of all offenders in
prisons and other institutions with rehabilitation programs constitutes an onerous drain on the
financial resources of the country.

Purposes of Probation

1. To promote the correction and rehabilitation of an offender by providing him with individualized
treatment;

2. To provide an opportunity for the reformation of a penitent offender which might be less probable
if he were to serve a prison sentence; and

3. To prevent the commission of offenses.

Benefits of probation

The following are the benefíts of probation:

1. It justifies the philosophy of men that.

a. life is sacred,

b. all men deserve a second chance,

c. an individual can change, and

d. society has a moral obligation to lift the fallen.

2. It protects society from...

a. excessive costs of detention, and

b. high rate of recidivism of detained offenders.


3. It assists the government in.

a. reducing prison and jail population

b. lessening courts' clogging.

c. lightening prosecutors' load, and

d. sustaining law enforcement

4. It protects the victim by..

a. providing restitution by the probationer, and

b. preserving justice.

5. It protects the family because

a. It does not deprive the wife and children of a husband and a father, and

b. It maintains the unity of the home

6. It helps the offender in...

a. maintaining his earning power,

b. providing rehabilitation in the community, and

c. in restoring his dignity.


PAROLE- It is the conditional release of a prisoner from correctional institution after serving
the minimum period of prison sentence.

Granted by The Board of Pardons and Parole, an agency under the Office of the
Secretary of Justice.
Promote criminal offender reform and reduce recidivism; and Provide a less
expensive alternative to institutional confinement for first-time offenders who are
likely to respond to individualized, community-based treatment programs.

Purpose of Parole

To uplift and redeem valuable human resources to economic usefulness and to prevent
unnecessary and excessive deprivation of personal liberty by way of parole or through
executive clemency.

The majority of confinements end with released supervision. The vast majority of state prison
inmates will be released on parole. As a result, parole is critical in state corrections. Without
it, prisoners would have less motivation to reform while incarcerated. Furthermore, if
prisoners remained incarcerated for the duration of their sentences, prisons would be even
more overcrowded.

THE PROBATION AND PAROLE ADMINISTRATION

Organizational Set-Up

The Probation Administration was created by virtue of Section 18 of Presidential Decree No. 968.
"There is hereby created under the Department of Justice an agency to be known as the Probation
Administration herein referred to as the Administration,which shall exercise general supervision
overall

probationers.

The Administration shall have such staff, operating units and personnel as may be necessary for the
proper execution of its functions.

Under Executive Order No. 292,

"The Administrative Code of 1987" which was promulgated on November 23, 1989, the Probation
Administration was renamed Parole and Probation Administration and given the added function of
supervising prisoners who, after serving part of their sentence in jails are released on with parole
conditions
The Parole and Probation Administration (PPA) is an attached agency of the Department of Justice
which provides a less costly alternative to imprisonment of offenders who are likely to respond to
individualized community based treatment programs

Effective August 17, 2005, by virtue of a Memorandum of Agreement with the Dangerous Drugs Board,
the Administration perfoms another additional function of investigating and supervising first-time
minor drug offenders who are placed on suspended pursuant to Republic Act No. 9165

Powers and Functions

PPA is mandated to perfom the following

1. Promote the correction and rehabilitation of an offender by providing him with individualized
treatment;

2. Provide an opportunity for the refomation of a penitent offender which might be less probable if
he were to serve a prison sentence; and

3. Prevent the commission of offenses.

Mission

To rehabilitate probationers, parolees and

pardonees and promote their development as integral persons by utilizing innovative interventions
and techniques which respect the dignity of and recognize his divine destiny.

Vision

A model component of the Philippine Correctional System to enhance the quality of life of its clients
through multi-disciplinary programs and resources, an efficient organization, and a highly
professional and committed workforce in order to promote social justice and development.
