EXECUTIVE ORDER NO. 12

Series 2020

AN ORDER PROVIDING FOR THE CREATION OF THE MUNICIPAL

TRICYCLE TASK FORCE OF THE MUNICIPALITY OF NAVAL, ITS COMPOSITION AND
FUNCTIONS

WHEREAS, Section 16 of RA 7160 provides that a local government shall “maintain peace and order,
and preserve the comfort and convenience of their inhabitants;”

WHEREAS, Section 448 (3) (vi), supra, provides that a municipality shall “subject to the guidelines
prescribed by the Department of Transportation and Communications, regulate the operation of tricycles
and grant franchises for the operation thereof within the territorial jurisdiction of the municipality;”

WHEREAS, the Department of the Interior and Local Government issued Memorandum Circular No.
2020-036, “Prohibiting Tricycles, Pedicabs, and Motorized Pedicabs from Operating on National
Highways;”

WHEREAS, a concerted and unified effort should be made among officials and employees of LGU
Naval on one hand, and among the stakeholders on another in order to ensure coordinated and effective
response to urban transportation problems;”

NOW, THEREFORE, I, GERARD ROGER M. ESPINA, Municipal Mayor of Naval, Biliran, by

virtue of the powers vested in me by law, do hereby decree and order that:

Section 1. Creation and Composition

The Municipal Tricycle Task Force is hereby created, and it shall be composed of the following
individuals with their respective designations:

Chairperson - Hon. Gerard Roger M. Espina - Mun. Mayor

Vice Chair - Atty. Raymundo Z. Espina - Mun. Administrator
Members - Alquine Cordeta - Head, Road Clearing Team
Hon. Martin Lagat - SB Member
Hon. Camilo Castro - SB Member
Hon. Jeffrey N. Merez - Liga President
Engr. Joemundo Leones - Municipal Engineer
Validators - Dexter C. Narrido - DILG MLGOO
PMaj Michael John M Astorga - PNP COP
FINSP Zardoz V Abela - BFP Fire Marshall

Section 2. Functions

The MTTF shall perform the following functions:

a. Conduct meetings, public consultation and hearings with stakeholders, and conduct surveys or
ocular inspection of the zone or specific area of tricycle operations.

b. Draft, update and cause the dissemination of the Tricycle Route Plan (TRP) to the Municipality
of Naval within 30 days from the issuance of this Order.
c. Oversee the implementation of the TRP and submit recommendations and reports to the
Sanguniang Bayan.
d. Perform such other functions as directed by competent authority.

Section 3. Repealing Clause

All issued orders and directives found inconsistent with this executive order shall be deemed repealed,
revoked, or amended accordingly.

Section 4. Separability Clause

In the event that any provision therein found shall be judicially declared illegal or infirm, untouched
provisions shall remain in full force and effect.

Section 5. Effectivity Clause

This Executive Order shall take effect immediately and shall remain in full force and effect until
repealed, revoked, or amended accordingly.
