RE: Joyous Hill Resort (Emilio Dela Cruz) at Brgy. Patag

Dear Sir:

At around 1:30 pm of February 14, 2023, along with the JIT Team and representa tives from
DENR, we conducted an ocular inspection at Purok Mahigugma-on, Brgy. Patag, on the
establishment/resort owned by Emilio Dela Cruz. This is in connection with a complaint with the
following allegations:

1. Said resort is allegedly located at a Special Protected Zone of Brgy. Patag, Silay City.
2. Said resort has no building, occupancy and business permit.

Based on our ocular inspection, hereunder are the facts we gathered.

1. Near the base of the hill where the resort is located, we came upon Mr. Dela Cruz concrete
3-storey residence/rest house. Said residence/rest house has a total floor area of approximately
249.78 square meters.

2. Upon reaching 10.6831415 latitude, 123.1767133 longitude of Purok Mahigugma-on, Brgy.

Patag, we were able to inspect the multi-level facilities of subject resort. List of facilities
inspected are as follows:

 Swimming Pool with an area of approximately 40 square meters (1 st level)

 Kitchen with comfort room constructed of concrete under G.I. roof whose floor area is
approximately 30.92 square meters (1st level)

 Comfort room constructed of concrete, wood, bamboo under G.I. roof whose floor area is
approximately 10.13 square meters (2nd level)

 Rentable Overnight Cottage constructed of timber under G.I. roof whose floor area is
approximately 7.4 square meters (3rd level)
  Rentable Overnight Cottage constructed of timber under G.I. roof whose floor area is
approximately 7.4 square meters (4th level)

 Filtered water facility composed of two blue plastic drums, a water filter, and a 500-liter steel
tank(5th level)

The resort also uses solar powered lighting systems to illuminate the facility at night time.
Upon verification from OBO office, said complex does not have a building and occupancy permit.
However, only DENR, DRRM and or CPDO are the ones that could pinpoint in the map the exact
location of said resort via GPS and determine if it is within the Special Protected Zone(SPZ).
