CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT, made and executed by and between:

BENJAMIN DUNGCA FABIAN, of legal age,


Filipino citizen, married and with residence and
postal address at fabian street Soliman
Subdivision San Rafael, Tarlac city, hereinafter
called the LESSOR,

-and-

SUPREME SHOOTERS CLUB INC,a


corporation duly organized and existing under
and by virtue of the laws of the Philippines, with
principal office address at the San Jose De
Urquico, Tarlac City, Province of Tarlac, duly
represented in this act by
___________________________________,
hereinafter referred to as the “LESSEE”;

W I T N E S S E T H:

WHEREAS, the LESSOR has the right to sublease the subject


parcel of land as stated in the Lease Contract executed between the
former and the owner of the parcel of land Mr. Lamberto Silva Cruz
Jr., by virtue of his right as a compulsory heir of Lamberto M. Cruz
Sr., situated in Barangay San Jose De Urquico, Tarlac City covered by
TCT No. 310294 with an area of (266,265) SQ. METERS and with Tax
Declaration no.____________;

WHEREAS, the LESSEE is desirous of leasing a portion of the


above-mentioned parcel of land and that the LESSOR is willing to
lease the said premises to the LESSEE for such rental and under such
terms and conditions which may be agreed upon by them;

NOW, THEREFORE, for and in consideration of the above


premises and of the rents stipulated below, the LESSOR does hereby
lease unto the LESSEES the above premises, subject to the following
terms and conditions:

1. That the term of this lease shall be for five (5) YEARS,
starting from April 1, 2023 and until March 31, 2028, subject to
renewal for another or similar period by mutual agreement of the
parties;

2. That the monthly rental rate as agreed upon by parties is
five thousand pesos (php5,000.00) which may increase on a yearly
basis as may be agreed upon by parties

3. The LESSEE shall pay the LESSOR the amount of ten


thousand (php10,000.00) pesos representing two (2) months advance
rental and the LESSEE shall also make a 1-month deposit upon the
signing of this agreement, which 1-month security deposit shall remain
in the custody of the LESSOR until the expiration of the lease to
answer for whatever damages which may be caused to the leased
premises or unpaid rentals the LESSOR may suffer by virtue of this
contract;

4. That the LESSEE shall use the leased premises herein rented
for commercial purposes only;

5. That during the term of the lease, the LESSEE shall defray
all expenses for electricity, water, telephone and other services which
may be needed in the leased premises;

6. That the LESSEE shall not sub-lease the leased premises or


any portion thereof to a third party without the prior written consent of
the LESSOR, and any violation thereof shall entitle the LESSOR to
cancel the lease contract, in which case, whatever improvement which
may be erected thereon by the LESSEE shall be forfeited in favor of
the LESSOR, plus the right to eject the LESSEE and all persons
deriving possession thereof thru the LESSEE;

7. That the LESSEE shall not keep in the leased premises any
illegal items or materials, such as dangerous or any prohibited drugs,
and any violation thereof shall be sufficient cause for termination of
the contract;

8. That the LESSEE shall allow the LESSOR or his authorized


representative to inspect the leased premises at any reasonable time
during business hours but any inconvenience thus caused shall not be
a ground for the rescission of this contract or for action for damages;

9. That it is hereby stipulated by the parties that the parties


hereby agrees that if the property subject of this lease will be purchase
and/or sold to other another person by the owner herein identified
during the duration of the contract of lease, the contract of lease will
be considered terminated ;

10. That the parties mutually agree to comply with their


respective obligations under the contract and in case of any violation
of the terms and conditions thereof, the aggrieved party shall have the
right to file the necessary action with the proper court for the
protection of his or her rights, plus the right to claim expenses,
damages and attorney’s fees.

IN WITNESS WHEREOF, the parties hereto have affixed their
