TENANCY AGREEMENT

(The Tenant)
THIS AGREEMENT is made on the 1st January 2021 between YEON POH OWI I.C. No.600305-08-
6044 of No 23, Jalan Rasa Sayang 1/1, Taman Rasa Sayang, 32000, Sitiawan (Tel:019-5745093)
(hereinafter called “the Landlady”) of the one part and JAYESEELAN S/O MUNIANDY I.C. 720601-
07-5725 of No 589, Persiaran 2J/13,Fasa 2J, 32040, Seri Manjung, Perak (Tel:019-5598197)
(hereinafter called “the Tenant”

WHEREAS :
The Landlord is the registered/beneficial proprietor of the property double-storey shop house known
as No 38(Ground Floor), Taman Sentosa, Jalan Lumut, 32000, Sitiawan, Perak Darul Ridzuan
(hereinafter referred to as “the said Shop house”)

AND WHEREAS the Landlady hereby agrees to let and the Tenant agrees to rent the ground floor of
the said shop house (hereinafter referred to as “the said premises” at the monthly rental and upon the
terms and conditions appearing.

NOW IT IS HEREBY AGREED as follows


1. The Landlady hereby let and the Tenant hereby takes the said premises for a period of
Two(2) year’s commencing on the 1st day of January 2021 and expiring on the 31st day of
December 2022 at the monthly rental of Malaysian Ringgit One Thousand Three Hundred
only (RM1,300.00) per month (hereinafter referred to as “the said rental”) and subject to the
terms and conditions hereinafter contained

2. The Tenant herby covenants with the Landlady as follows:

(a) To pay the reserved rental in advance on or before 10th day of each and every calendar
month;
(b) Upon execution of this Agreement to pay the Landlady the sum of Malaysian Ringgit two
Thousand Six Hundred only (RM2,600.00) towards rental deposit (the receipt whereof the
Landlady hereby acknowledges receipt) which sum shall not be deemed to be treated as
payment towards the rental hereby reserved and the same shall be refunded to the Tenant
free from interest on the expiration of the tenancy hereby created less any deduction for
damages to the said premises or non observance of any of the provisions herein stated;
(c) To pay monthly bills for water, electricity and IWK charges during the term of this agreement
and hand over to the Landlady for safe keeping;
(d) Not to do or permit or suffer to be done in the shop house anything whereby the insurance
against fire of the said building may be rendered void or voidable to the Tenant or occupies of
neighboring premises/other parts of the said building;
(e) Not to cut maim or injuries any of the walls of the shop house or suffer or permit the same to
be done except for carrying out needful repairs;
(f) To keep the shop house and all the Landlady’s fixtures and fittings in good Tenantable
condition and keep the surrounding in a clean and neat condition;
(g) The tenant shall permit the landlady at all reasonable times after reasonable notice during
daytime to enter the said premises to examine the said premises;
(h) The tenant shall save harmless and keep indemnified the Landlady from and against all legal
proceedings, claims, damages, expanses and cost on the account of any act by the Tenant or
breach of any government law or any terms and conditions herein contained;
(i) To use the said premises as lawful business only and no unlawful or immoral purposes to
be carried out including the storage of any explosive or illegal chemicals;
(j) At the expiry of the term hereby created including the renewal (if any) or upon the early
determination thereof by reason of the Tenant’s breach of conditions under this Agreement to
deliver back the said premises free from debris and make good any damage caused to the
said premises or any part thereof by the installation by the Tenant or shall reinstate the said
shop house to the condition according to the original approved plan. Provided that if the
Tenant fails to comply with these provisions after one (1) month of such termination, the
Landlady shall do the reinstatement the cost of this shall be wholly borne by the Tenant;
(k) Not at any time during the said tenancy, to create or permit any gambling, illegal or immoral
activities to be carried on, or other injury to the said premises or any annoyance to the
Owners and occupies of the neighboring premises;
(l) During one (1) month immediately preceding the expiration of this tenancy to permit the
Landlady or any person or persons with authority from the Landlady at reasonable times of
that day, convenient to the Tenant to view the demised premises for the purposed of lacking a
tenancy thereof;
(m) To keep and maintain the glass of the windows, locks, latches and fasteners, fixtures and
fittings of the interior of the said premises and all additions thereto in good and Tenantable
repair and conditions (fair wear and tear and damage by fire, flood or any ACT of God
excepted) throughout the term and in such repair and conditions to yield up the same at the
determination of this Agreement;
(n) Not to tamper with the water and electricity meters during the currency of this Tenancy
Agreement and to bear all fines and penalties to be imposed by the relevant authorities in the
event of any offences being committed by the Tenant;
(o) Not to sublet or assign part or the whole of the said premises without the prior written consent
by the Landlady;

3. The Landlady hereby covenant with the Tenant as follows:


(a) To pay all quit rents, assessments and other charges which are charged or imposed upon the
demised premises.
(b) To permit the Tenant punctually pays the reserved rent and other charges and observes the
terms and conditions on the tenant’s part herein contained, quiet enjoyment of the demised
premises during the said term without any interruption by the Landlady or those lawfully
claiming under or in trust for the landlady.

4. If the rent reserved or any part thereof shall be in arrears for ten (10) days after becoming due
and payable (whether formally demanded or not) or if the Tenant shall commit any breach of
any stipulations herein contained or if the Tenant shall be adjudicated bankrupt or shall have
received a receiving order made against him or shall enter into any composition with hir/her
creditors then and in any such cases, if necessary to make compensation in money for the
breach. And if the tenant is unable to comply with such notice within the said period it shall be
lawful for the Landlady at any time thereafter to enter the whole premises and to remove the
Tenant’s belongings from the said premises and to repossess the said premises and the
tenancy rights shall be terminated automatically

5, If either party desires to terminate this tenancy during the term herein created, she/he shall
give Three (3) months prior notice-in-writing to the other and upon the expiry of the
notice, the tenant shall hand over the vacant possession of the said premises to the Landlady
and the Landlady shall refund the deposits to the Tenant less any arrears of rental, water and
electricity bills and this agreement shall thereafter be terminated and of no further effect.

6. The Tenant hereby allows the landlady to secure all the entrances of the whole premises and
move out all the belongings of the Tenant kept and installed in the said premises If any in the
event that the rental hereby reserved is due and remained unpaid for more than 14 days. The
Landlady shall then be at liberty to rent the demised premises to others thereafter. This
tenancy shall automatically be terminated and no compensation shall be paid by the Landlady
to the Tenant.

7. Any notice required to be served herein shall be in writing and any notice to the landlady shall
be deemed to be sufficiently served id addressed to the Landlady and left at or sent by
registered post to the address herein stated and any notice to the Tenant shall be deemed to
be sufficiently served if left at or sent by registered post to the Tenant at the address herein
stated. Any notice sent by registered post shall be deemed to be delivered in due course of
post it would expected to be delivered to the address to which is sent.

8. All stamp duty and solicitor’s cost’s and incidentals to the preparation and completion of this
Agreement shall be payable by the Tenant.

9. This Agreement shall be binding upon the heirs, representatives, successors-in-title assigns
and administrators of the parties hereto.
IN WITNESS WHEREOF the parties hereto have hereunder set their hands the day and year
specified in Section 1 of the Schedule hereto.
