AFFIDAVIT OF DEFENDATS

WE, JOEL S. GACITA and IRENE V. GACITA , of legal age, Filipino married and a
resident of Sinili, Santiago City, under oath, hereby states:
1. That WE are engaged in wholesale business of Red Onions here in Santiago
City;
2. That on October 13, 2022, Ms. Joselyn Lopez “ Ms. Celine”, gave the amount of
Three Hundred Thousand (P300,000.00) to Ms. Irene V. Gacita “Ms. Irene” for
the purchse of Red onions in Nueva Ecija;
3. That on October 14, 2022, a closed van arrived in our house at Brgy. Sinili,
Santiago City containing 100 bags of red onions from Nueva Ecija;
4. That on the same day, Ms. Joselyn Lopez “Ms. Celine” arrived to pick up her
order of 96 bags of red onions, and my workers “kargadors” loaded it on a
‘kolong kolong” owned by her amounting to Three Hundred Fifty Nine
Thousand and six hundred twenty five Pesos (P359, 625.00), leaving an
unpaid amount of Fifty Nine thousand six hundred twenty five Pesos
(P59,625.00);
5. That on November 09, 2022, Ms. Irene received the amount of Three Hundred
and Sixty thousand Pesos (P360,000.00) from Ms. Celine to be used in
purchasing Red Onions;
6. That on November 09, 2022, another delivery of Red onions arrived in our
house, and since we are honest in the implementation of our business and we
developed business relations with our clients and so Ms. Irene bought all of
the 104 bags and loaded it on her “kolong-kolong” and is amounting to Four
Hundred and sixteen thousand Pesos (P416,000.00) leaving Ms. Celine the
deficiency balance of Fifty Six Thousand Pesos (P56,000.00);
7. That on November 15, 2022, another delivery of 106 bags of red onions had
arrived, again, Ms. Celine took all of the 106 bags of red onions and sold it to
 various buyers and they picked it up from our house in Brgy. Sinili, Santiago
City, however, there were no payments made by Ms. Celine to us, instead, she
promised to pay the 106 bags of red onions in the amount of Three Hundred
Fifty Thousand and six hundred pesos (P355,600.00) on the following day
which is on November 16, 2022, however, she failed to pay said amount up to
the moment;
8. That, Ms. Celine was the one who is indebted to us because of her following
deficiency , thus, she failed to pay her deficit balance on the October 14, 2022
transaction, the amount of Fifty Nine thousand six hundred twenty five Pesos
(P59,625.00) and our profit share in the amount of Thirty eight thousand and
one hundred fifty five pesos (P38,155.00); her another deficit balance in the
amount Fifty Six Thousand Pesos (P56,000.00) and she did not give us our
profit share in the amount of Eleven thousand three hundred sixty six pesos
and fifty centavos(P11,366.50) in the November 09 , 2022 transaction , lastly,
the worth of the 106 Bags of Red Onions in the amount of Three Hundred Fifty
Thousand and six hundred pesos (P355,600.00), hence, she in indebted to us
in the total amount of Five Hundred Twenty Thousand and seven hundred
forty six pesos and fifty centavos(P520,746.50);
9. WE are executing this affidavit to attest to the truthfulness of the foregoing
and to any legal purpose it may serve.
