1.0 BACKGROUND. This Performance Work Statement (PWS) outlines
general duties and qualifications required from service contractors in support of the Exercise BALIKATAN 2022(BK22) internet requirements.
2.1 SCOPE OF WORK. In accordance with the below schedule
of services or supplies the contractor shall provide all labor, materials, equipment services incidental to support the requirements stated in this PWS.
a. The contractor shall provide operational internet in
support of BK22.
b. The Contractor will install and maintain dedicated
International access INTERNET Point of Presence (POP) at the designated locations and period of performance stated in section 3.0 of this PWS.
3.0 SPECIFIC TASKS / DESCRIPTION OF SERVICES.

The Contractor shall install and maintain a 20 Mb Upload/ 20 Mb
Download dedicated international access internet Point of Presence (POP) from 21 March 2022 – 06 April 2022, adjacent to the Haribon Hangar(See Tab 1. Det 1, 13 AEG Commercial ISP Map). The contractor will provide all required POP equipment including but not limited to a modem and router. The contractor provided POP router will provide (5) statically assigned, publically routable, IPv4 address to the customer’s equipment, using UTP Ethernet cabling. The contractor will grant the customer “view” permissions at a minimum to POP router. The contractor will also provide (3) wireless access points (WAP), separate from the POP router, for the customer to use at their discretion. These WAPs must be capable of IEEE 802.11a/b/g/n/ac WiFi protocols, and must be configurable by the customer. All required equipment must be capable of operating between 110v and 240v power. The contractor will not block any port on the internet to include port 500, 50, 51 and 1723. The contractor shall provide 24/7 on call technical support with a three (3) hour on site response time for all outages. The customer shall be responsible for end user support to include installing networking cable and equipment.

4.0 CONTRACTOR’S FAILURE TO PERFORM. If the contractor fails to perform required services within the specific limitations, the government may:
a. Accept the services at a later date without any
extra cost to the Government.
b. Refuse to accept the services if the contractor
has notperformed the required task in accordance with the contract.
c. Procure the missed service, upon such terms and
conditions as the Contracting Officer deems appropriate, from a responsible alternate firm and the contractor shall be liable to the government for any excess costs incurred and to continue the performance as required thereafter.
5.0 PERIOD OF PERFORMANCE. See Section 3.0 for
specific locations and dates of installation/service.
6.0 WORK SCHEDULE AND LOCATION. See Section 3.0 for
specific locations and dates of installation/service.
7.0 HOLIDAY PERIODS. The contractor shall be required to
work during Philippine and U.S. holiday periods unless otherwise directed. 8.0 TRAVEL. The contractor shall be responsible for all of their own travel arrangements to meet the needs of the requirements set forth in this statement of work.
9.0 SAFETY & SECURITY. The contractor and its employees
shall be responsible for ensuring all safety requirements are adhered to and shall not, at any time during the performance of this SOW, place U.S. Government personnel in any danger. The Contractor is required to comply with force protection measures as directed by the U.S. Government Representative identified in paragraph 13.0. In addition, Contractor personnel shall comply with all U.S. Government regulations regarding security procedures, the wearing of badges, access lists, and safety procedures. a. The contractor shall comply with all local government published safety requirements and regulations.
b. Sensitive Unclassified For Official Use Only
(FOUO) access. Contractor shall ensure that personnel hired are able to pass background checks in order to gain access to military installation
10.0 PHYSICAL SECURITY. RESERVED.
11.0 GOVERNMENT FURNISHED PROPERTY. Not Applicable
11.1 PROTECTION OF GOVERNMENT PROPERTY. The contractor shall
take all necessary precautions to protect Government property. All damaged property due to the contractor’s operation shall be repaired, replaced, or restored to a condition as approved by the Contracting Officer and the end user at no cost to the Government. All damaged property shall be corrected within 5 working days by the contractor with materials of like type, quality and finish by skilled craftsmen as required. Should the contractor fail to correct damages, the Government will correct the damages and the cost will be deducted from the contractor’s payment. The contractor shall report all damages to the end user and the Contracting Officer.
12.0 CONTRACTOR PERSONNEL.
a. CONTRACT MANAGER. The contractor shall provide a contract
manager who shall be responsible for the performance of the work. The name of this person, and an alternate(s), who shall act for the contractor when the manager is absent, shall be designated in writing to the Contracting Officer. The contract manager or alternate(s) shall have full authority to act for the contractor on all contract matters relating to daily operations of this contract. The contract manager or alternate(s) shall be available during normal duty hours within (24) hour notice to meet on the installation with government personnel (designated by the Contracting Officer) to discuss problem areas. The Contract Manager and alternate(s) must be able to read, write, speak, and understand English.
b. QUALITY CONTROL. The Contractor shall establish and
maintain a plan to ensure the requirements of the Contract are provided as specified. The plan shall give the contractor an effective means of identifying and correcting potential and actual non- conformance or lack of performance across the entire scope of the statement of work.
c. CONTRACTOR EMPLOYEES. The contractor shall not employ
persons for work on this contract if such employee is identified to the contractor by the Contracting Officer as a potential threat to the health, safety, security, general well- being or operational mission. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges, which contain the company name and employee name in English. The contractor shall not employ any person who is an employee of the U.S. Government if employing that person would create a conflict of interest. Additionally, the contractor shall not employ any person who is an employee of the Department of the Defense, either military or civilian. The contractor shall endeavor to avoid employing individuals with conflicting financial interests within the meaning of the Joint Ethics Regulation and applicable guidance.
1. The contractor agrees to utilize only experienced,
responsible and capable people in the performance of the work. The Contacting Officer may require that the contractor remove from the Government job employees who endanger persons or property, or whose continued employment under this contract is inconsistent with the interests of military security.
2. The Contracting Officer, in writing, may require the
contractor to remove from the work site, area, or base, objectionable employees. Objectionable employees include those employees not properly attired or those employees using profane language or abusing or disobeying base/host country conduct rules or regulations.
d. CONTRACTUAL RELATIONSHIPS. Contractor personnel shall at
all times be under the supervision of the contractor and not under the supervision of the Government or any of its officers or employees. The Contracting Officer will bring discrepancies or noncompliance with the contract clauses, specifications, or SOW to the attention of the contractors’ contract manager, supervisor, or foreman for necessary corrective action.
13.0 CONTRACTING OFFICER’S REPRESENTATIVE. The Contracting
Officer’s Representative (COR) is designated as a representative of the Contracting Officer for the purpose of technical supervision, inspection, and acceptance under this contract. CORs for this contract are identified below either by title of position or by name of individual, organizational component, and the dollar limitation per purchase for each position title or individual. These appointed CORs are the only designated representative(s) that are authorized to sign for items under this contract. List of Contracting Officer Appointed Contracting Officer’s Representative (COR): To be determined at contract award.
14.0 QUALITY ASSURANCE. The Government shall monitor
the contractor's performance. The Government may increase or decrease the number of quality assurance inspections as performance dictates. The Government reserves the right to inspect all of the contractor's performance to ensure services are received. Performance meetings may be held regularly or as requested by the Contracting Officer, or contractor.
15.0 PERFORMANCE EVALUATION MEETINGS. The Contracting Officer
may require the contract manager to meet with the Contracting Officer, LOGREP, end user, and other government personnel as deemed necessary. The contractor may request a meeting with the Contracting Officer when he or she believes such a meeting is necessary.
18.0 ACCESS TO MILITARY FACILITIES. The contractor is
responsible for gaining access to all military facilities. The contractor will contact the appropriate military installation before submitting proposal to determine what fees and applications are necessary.
17.0 POINTS OF CONTACTS AND AUTHORITIES. The Contracting
Officer is the only person authorized to approve any changes to the requirements of this contract and, not withstanding provisions contained elsewhere in this contract, the authority remains solely the Contracting Officer. a. In the event the contractor effects any change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price as a result of the change.
18.0 LIABILITY. The U.S. Government accepts no liability
for the actions of the contractor or his employees and agents.
19.0 PAYMENTS. Payment will be made in Philippine Peso to
the contractor upon submission of proper invoices.
