Before me and personally appeared, a law enforcement officer with the St. Johns County Sheriff's Office, and who being
duly sworn, states the Defendant KYLE NATHAN HURTA , did commit the acts stated
in the attached Probable Cause Affidavit. Based upon this sworn statement of facts, | find the probable cause that the
defendant did commit the following crimes in St. Johns County, Florida, contrary to the Florida Statutes and against the

The undersigned certifies and swears that there is probable cause to believe the above-named defendant,
who was positively identified by his Florida Driver’s License between the 21st day of October, 2021
through May 19th, 2022, within St. Johns County, violated the law and did then and there:

1) Possession of Child Sexual Abuse Material (ENHANCED) F.S. 775.0847.2 (15 Counts)

The St. Johns County Sheriff’s Office received a Cybertip from Google, who advised on October 21,
2021, a suspect downloaded one (1) possible image of Child Sexual Abuse Material (CSAM). The
Cybertip provided the name of the defendant, and a phone number, which when subpoenaed is shown as
belonging to the defendant. The image which generated the Cybertip was viewed, and determined to
depict CSAM.

Based on the information received in the Cybertip, and legal compliance obtained from Google and the
defendant’s phone provider, a search warrant was obtained to seize the defendant’s cell phone. Post
Miranda, the defendant stated his ex-girlfriend previously placed CSAM on his phone, which he deleted.
A forensic download was conducted of the suspect’s cell phone, which revealed the following offending
images:

a prepubescent juvenile female, who is nude from the waist down, and whose vagina is exposed
to the camera. The juvenile is observed performing oral sex on an erect adult male penis.

File Description: This file is a color video approximately fifteen (15) seconds in length. The video
is a collage of videos, depicting both pubescent, and pre-pubescent juvenile females engaged in a

; probable cause exists to charge the defendant with fifteen (15) counts of Possession of Child
Abuse Material, a violation of F.S. 827.071.5 enhanced according to F.S. 775.0847.2.
