AFFIDAVIT

I, RICARDO BELTRAN, of legal age, Filipino, married under oath

states that:

1. I am defendant in Civil Case No. 2020-15822;

2. I received the Summons on November 27, 2020;

3. I was in an honest belief that it was not necessary for me to

participate in the proceeding in in Civil Case No. 2020-15822, because the
same property was already litigated upon by the Supreme Court involving
the same property, the same parties involving the same issues;

4. I genuinely believed that it was not necessary for me to file an

Answer to the Complaint ;

5. I continued to receives copies of subsequent orders and notices

from this Honorable Court pertaining to Civil Case No. 2020-15822. I
started to worry;

6. Sometime around January 19, 2021, I immediately informed my

counsel, Atty. Joel Obar about the summons and notices I received.
However, the period to file an Answer already expired;

7. I admit that I am not knowledgeable in the technicalities of law;

8. Moreover, my being a senior citizen who is suffering from

diabetes and hypertension and other related medical conditions which
hinders my due diligence that I often make honest mistakes in life;

9. When the Complaint and the Orders of the Court was explained
to me by my Counsel, I was surprised to know that Petitioners filed a casew
for the recovery of ownership and cancellation of the title of Lot No. 1366-
E that is covered by TCT 20152 OR TCT No. 109-2014000912 with Tax
Declaration no 14-0017-04246;

10. This is the same property as admitted by Plaintiffs in their

Formal Offer of Exhibits in Civil Case No. 2020-15822. It is the same
property already litigated involving the same parties in the case of Beltran
vs Manlan in Civil Case No. 10684 for Quieting of Title, Possession, etc.

11. After having understood the Court’s Orders and Notices

completely, I, Ricardo Beltran, through undersigned counsel, is filling this
pleading.
