Section 4.No law shall be passed abridging the freedom of speech,of expression,or of the
press,or the right of the people peaceaple to assemble and petition the government for redress
of grievances.
The freedom of speech,expression or press is subject to the laws agains obscenity,libel or
slander,the laws on sedition as well as the police power.According to Justice Cardozo onced
observed that”the need of successive generations may make restrictions imperative today which
were vain and capricious to the vision of times past.”The words “of expression”as referring to
freedom of speech now appear in our constitution and widens the scope.
In the case of Ayer Production vs. Capulong and Ponce Enrile (G.R. No. 82380) and McElroy vs.
Capulong (G.R No. 82398) both decided on April 29,1988,the Supreme Court denied the
injuction prayed for by Ponce Enrile to prevent the filming of the “Four –Day Revolution” at
EDSA on the ground that it would infringe upon the privacy of Enrile and his family,the Highest
Court saying,”a limited instrusion into a person’s privacy has long been regarded as permissible
where that person is a public figure and information
