FUNCTIONING OF PARLIAMENT
• ANTI DEFECTION LAW
✓ Dinesh Goswami Committee -Disqualification should be limited to cases
where (a) a member voluntarily gives up the membership of his political
party, (b) a member abstains from voting, or votes contrary to the party whip
(no-confidence)
✓ Election Commission - Decisions under the Tenth Schedule should be made
by the President/ Governor on the binding advice of the Election Commission
• OFFICE OF PROFIT
✓ 2nd ARC recommendations: The Law should be amended to define office of
profit based on the following principles:
All offices in purely advisory bodies where the expertise of a legislator would
be inputs in governmental policy shall not be treated as offices of profit.
• PARLIAMENTARY PRIVILEGES
✓ The 16th All India Whips Conference -codification of privileges to remove the
uncertainty
✓ NCRWC-Article 105 and 194 may be amended to clarify that the immunity
enjoyed by members under parliamentary privileges does not cover corrupt
acts committed by them in connection with their duties in the House or
otherwise
• RAJYA SABHA
✓ NCRWC -domicile requirement for eligibility to contest elections to Rajya Sabha from
the concerned state. In 2003 this domicile requirement was eliminated
• PRODUCTIVITY OF PARLIAMENT/LEGISLATURE
✓ NCRWC-minimum number of sittings for Lok Sabha and Rajya Sabha be fixed
at 120 and 100 respectively.
• PARLIAMENTARY COMMITTEES
✓ NCRWC- 1.Max no. of bills should be referred to committees

• 7TH SCHEDULE
✓ Sarkaria Committee Recommendations (1998 Report):
1.Residuary powers be transferred from the Union List to the Concurrent List,
except for the residuary power to impose taxes which should be retained in
the Union List.
2. States should be consulted by the Centre before exercising power over
Concurrent List.
• GOVERNOR
✓ Sarkaria Commission-
1.The state assembly should not be dissolved unless the proclamation is
approved by the parliament.
2. Sparing use of article 356 of the constitution should be made.
3. The procedure of consulting the chief minister in appointment of governor
should be prescribed in Constitution itself.
✓ Punchhi Commission –
1. The governor should follow “constitutional conventions” in a case of a
hung Assembly
2. The procedure laid down for impeachment of President, mutatis mutandis
can be made applicable for impeachment of Governors as well.
3. Exercise of discretionary power must be dictated by reason
FEDERALISM
✓ SARKARIA COMMISSION-1.Permanent inter state council under article 263
2.No. of centrally sponsored scheme should be
kept minimum
✓ RAJMMAR COMMISSION-Union should consult inter state council on
decision that affect states.
JUDICIARY
CRIMINAL JUSTICE SYSTEM
✓ Malimath Committee on Reforms of Criminal Justice System- a new Police Act must
be enacted on the pattern of the draft prepared by the National Police Commission.
TRIBUNALS
✓ 272nd Report of the Law Commission of India-selection of members should be
impartial and involvement of government agencies should be minimal.
✓ In case of transfer of jurisdiction of HC (or District Court) to a Tribunal, the members
of the newly constituted Tribunal should possess the qualifications akin to the judges
of the HC
JUDICIAL PENDENCY
✓ The 120th Law Commission of India report -suggested a judge strength fixation
formula AND All india judicial services
✓ 230th Law Commission in its report “reform in Judiciary” in 2009 recommended
1.There must be full utilization of the court working hours and Grant of adjournment
must be guided strictly by the provisions of Order 17 of the Civil Procedure Code.
2.cases of similar nature should be clubbed with the help of technology and used to
dispose other such cases on a priority basis
3 Judges must deliver judgments within a reasonable time both in civil and criminal
matters.
