Constitutional Provisions on
Natural Resources

The 1935 Constitution classified lands of the Public


domain into:
1.) Alienable and Disposable Lands;
2.) Forest or Timber Land; and
3.) Mineral Lands.

The 1973 Constitution classified lands of the public


domain into seven:
1.) Agricultural;
2.)Commercial/Industrial;
3.)Residential;
4.)Resettlement;
5.) Timber or Forest;
6.)Mineral; and
7.)Grazing lands. 5

Constitutional Provisions on
Natural Resources

In the 1987 Philippine Constitutions, lands of the


public domain are classified into agricultural,
forest or timber, mineral lands and national
parks.

Agricultural lands of the public domain may be


further classified by law according to the uses to
which they may be devoted. Alienable lands of the
public domain shall be limited to agricultural
lands.

FOREST LAND IS NOT DISPOSABLE


If the area covered by the patent and title is not
disposable public land, it being a part of the forest
zone, then the patent and title thereto are null and
void.

“The defense of indefeasibility of a certificate of


title issued pursuant to a free patent does not lie
against the state in an action for the reversion of the
land covered thereby when such land is a part of a
public forest or a forest reservation.”

void when it covers property of public domain
classified as forest or timber and mineral lands.
Any title issued on non-disposable lots, even in

What is Presidential Proclamation?

• Is a statement issued by a President on an


issue of public policy, and is a kind
of Presidential directive.

• An act of the President reserving any tract/s


of land of the public domain for government
use or any of its branches or instrumentalities or
of the inhabitants thereof, for public or quasi-
public uses or purposes.

What is Quasi-public use?

• those lands belong to the State, without being


use for public purposes, intended for some
public service or for the development of the
National Wealth.

III
(1)The President shall have the power to reserve
for settlement or public use, and for specific
public purposes, any of the lands of the public
domain, the use of which is not otherwise directed
by law. The reserved land shall thereafter remain
subject to the specific public purpose indicated
until otherwise provided by law or proclamation;
(2)He shall also have the power to reserve from
sale or other disposition and for specific public
uses or purposes, any land belonging to the private
domain of the Government, or any of the Friar
Lands, the use of which is not otherwise directed by
law, and thereafter such land shall be used for the
purposes specified by such proclamation until
otherwise provided by law.

Public Land Act - Chapter XI, Sec. 83

Upon the recommendation of the Secretary of


Agriculture and Natural Resources, the
President may designate by proclamation any
tract or tracts of land of the public domain as
reservations for the use of the Republic of the
Philippines or of any of its branches, or of the
inhabitants thereof, in accordance with
regulations prescribed for this purposes, or for
quasi-public uses or purposes when the public
interest requires it, including reservations for
highways, rights of way for railroads, hydraulic
power sites, irrigation systems, communal pastures
or leguas comunales, public parks, public quarries,
public fishponds, workingmen’s village and other
improvements for the public benefit.

“The tract or tracts of land reserved under the


provisions of section eighty-three shall be non-
alienable and shall not be subject to
occupation, entry, sale, lease, or other
disposition until again declared alienable under

4. In case the government site has no approved survey, the CENR Office shall issue a Survey Authority/Order/Order to
requesting party or DENR Survey Unit for the survey of parcel of land;
5. In case of oppositions arising from the SP requests, the CENR Office shall fast track the resolution
using the Alternative Dispute Resolutions (ADR) mechanisms; and
6. The CENR Officer shall resolve the opposition or make a recommendation within 30 days from the filing of

What is Special Patent?


Special Patent is a public instrument issued by the
government to confirm ownership over a parcel of
agricultural land (alienable & disposable) by law or
proclamation by the President of the Philippines
through the DENR.

To Whom Special Patent is issued?


a. Republic of the Philippines, its agencies,
branches and instrumentalities;

b. Local Government Units (LGU) such as


provinces, cities and municipalities;

To whom will title be issued?


Title shall be issued under the name of the
Philippine National Police (PNP) and the name of
the police station.

Example:

All patents or certificates for land granted under this Act
shall be prepared in the Bureau of Lands and shall be issued
in the name of the Government of the Republic of the
Philippines under the signature of the President of the
Philippines: Provided, However, That the President of the
Philippines may delegate to the Secretary of Agriculture
and Natural Resources and/or the Undersecretary for
Natural Resources the power to sign patents or
certificates covering lands not exceeding one hundred forty-
four hectares in area, and to the Secretary of Agriculture and
Natural Resources the power to sign patents or certificates
covering lands exceeding one hundred forty-four hectares in
area.

the Local Government Code of 1991, provides
that every Local Government Unit, as a
corporation, shall have the power to
acquire and conveyed real or personal
property.

• The CENRO is mandated to process the application


within one hundred and twenty (120) days to include
compliance with the required notices and other legal
requirements, and forward this recommendation to the
Provincial Environment and Natural Resources Office
(PENRO), who shall have five (5) days to approve or
disapprove the patent. In case of approval, patent
shall be issued; in case of conflicting claims among
different claimants, the parties may seek the proper
judicial remedies.

Definition of Conveyance
The term is commonly used in real estate transactions
when buyers and sellers transfer ownership of land,
building, or home. A conveyance is done using an
instrument of conveyance—a legal document such as
a contract, lease, title, or a deed.

PROCEDURE IN REGISTERING A DEED OF CONVEYANCE


IN REGISTRY OF DEEDS (ROD)
 An owner who desires to convey the land covered by his title
to another shall execute the proper deed of conveyance, in
proper form, and present the same, together with the
owner’s duplicate certificate to the ROD from entry and
registration;
 The ROD shall enter in the registration book the fact of
conveyance and prepare a new certificate of title in the name
of the grantee, the owner’s duplicate of which shall be
delivered to him
 The ROD shall note the date of conveyance, volume and
page of the registration book in which the certificate is
registered, and a reference by number to the last preceding

SECTION 47. Contracts and Conveyances

Contracts or conveyances may be executed


for and in behalf of the Government or of any
of its branches, subdivisions, agencies, or
instrumentalities, including government-owned
or controlled corporations, whenever demanded

as long as the same are not prohibited by law.
