PREAMBLE
The Preamble contains the overall philosophy of the Constitution. It is like a short statement of the
basic values of the Constitution. Many values inspired and guided India’s freedom struggle and were
in turn nurtured by it, these form the foundation of Indian democracy. These values were embedded
in the Preamble of Indian constitution. They guide all the articles in the Indian constitution.
SOURCE OF AUTHORITY
We, the people of India.
● Meaning: The term means that the constitution has been drawn up and enacted by the people
through their representatives, and not handed down to them by a king or any outside powers.
● Collective will of people: The above words show that the people of India are the source of
authority of the Constitution. "We the people" also explains that the Preamble and the
Constitution is a result of the collective will of the people and not just of the founding fathers.
● Court Judgment: In Madan Gopal Kabra vs. Union of India (1953), the Supreme Court referred to
the phrase "We the people" and observed that the Constitution derives its authority from the
citizens.
SOVEREIGN
The state has the supreme right to make decisions on internal as well as external matters. No external
power can dictate the government of India.
● Explanation: Sovereignty is a political concept which refers to dominant power or supreme
authority. A sovereign state is a country that governs itself within a defined territory. It has a
permanent population, territory, and government. It also possesses the right and capacity to make
treaties and other agreements with other nations based on its own merits and interests.
● India’s position: India is 'sovereign' as it is neither a dependency nor a dominion of any other
nation, but an independent state. There is no authority above it, and it is free to conduct its own
affairs. It is also free to legislate on any subject within constitutional limitations. Being a sovereign
state, India can either acquire a foreign territory or cede a part of its territory in favour of a foreign
state.
SOCIALIST
Wealth is generated socially and should be shared equally by society. Government should regulate the
ownership of land and industry to reduce socio-economic inequalities.
● Explanation: Socialism is a way to organize a society. It deals mostly with the economy, or the part
of society which creates wealth. The main objective of socialism is to treat all people fairly and to
distribute wealth more evenly. Different ideas exist on how the goal of socialist society should be
achieved. But there is a consensus that the government and not individuals should control
property and businesses. If we talk about the socialist economy, the state takes all the decisions
related to the production and distribution of goods and services. Thus, all the factors of production
are state-owned. The idea of a socialist state is to meet the needs of the consumers and to ensure
the maximisation of wealth of a whole community.
● Comparison with Capitalism: In a capitalist economy the market forces of demand and supply
determine all the decisions related to production and distribution of goods and services. Since the
main decisions are determined by market forces it leads to maximisation of benefits of the richest
companies and individuals.
● India’s position: The directive Principles of State policy had a socialistic content. The 42nd
amendment added the term ‘’socialism’’ to the Preamble. Thus, the amendment explicitly
mentioned what was implicitly given in the constitution. Congress in its 1955 Avadi session
adopted a resolution to establish a ‘socialistic pattern of society’ and took measures to achieve
the same.
India does not follow strict socialism i.e. ‘’communistic socialism’’ which involves the
nationalisation of all means of production and distribution and the abolition of private property.
Indian socialism is a blend of Marxism and Gandhism, leaning towards Gandhian socialism. India
in its initial years had followed a mixed economy i.e. where both public and private sectors existed
side by side. However, after the new economic policy 1991 of LPG i.e. Liberalisation, privatisation
and Globalisation has diluted the socialistic credentials of India.
● Present status: The present state of the Indian economy reflects that India is moving towards a
social democracy. This system aims to mix parts of socialism with capitalism. In this system, private
property exists, however the government generates tax revenue, typically from the wealthiest in
the society and corporations, and distributes it to the poor or backward sections of society. This
is done in the form of social welfare programmes such as nutritional programmes, housing
programmes etc. The intentions of social democracy and socialism can be shared, but the key
difference is that social democracy keeps the capitalist system intact and does not take steps to
remove it. In strict socialism, the capitalist system is done away with.
● Court Judgment: The Supreme Court in D.S. Nakara v. Union of India (1983) held that the primary
purpose of socialism is to provide a better standard of life and social security to people.
SECULAR
Citizens have complete freedom to follow any religion. But there is no official religion. The state treats
all religious beliefs and practices with equal respect.
● Meaning: The term "secular" essentially means being "separate" from religion or having no
religious basis. Though the concept has a rich history and has evolved over time, the term itself
was coined by the British reformer George Jacob Holyoake only in the 19th century. The term
secularism is similar to the Vedic concept of ‘Dharma Nirapekshata’ i.e. 1) State and Religion
should be separate from one another 2) People of all religions are equal before the law,
constitution and government policy.
● Concept of Secularism: To get a better understanding one should know about concepts of
Secularism
o Negative Concept of Secularism: The Western concept of secularism is a negative one. It
suggests a full separation between the State (the politics) and the church (religion). It holds
the belief that the government should neither formally acknowledge nor favour any particular
religion. The state will not interfere in any religious matter and religion will not interfere in
any state matters.
o Positive Concept of Secularism: In the positive concept of secularism all religions are given
equal respect and protection. The state is neutral in religious matters i.e., it protects all
religions and at the same time guarantees religious rights to every citizen.
● India’s position: India is a secular country. The concept of Secularism which was implicitly
mentioned in the Indian constitution was made explicit by the 42nd constitutional amendment act
by adding the term ‘’secular’’ to the Preamble. Also India follows the positive concept of
secularism i.e. no strict separation between state and religion exists. All religions are given equal
respect and protection and have the same status and support from the state. Various provisions
in the constitution reveal the secular character of the Indian state i.e. Article 15 which prohibits
discrimination on the basis of religion, race, caste, sex or place of birth. Articles 25 to 28 which
guarantees the fundamental right to freedom of religion.
● Meaning: The word democracy comes from the Greek words "demos", meaning people, and
"kratos" meaning power; so democracy can be thought of as "power of the people": a way of
governing which depends on the will of the people. Democracy is of two different forms – direct
democracy and indirect democracy.
● Types of Democracy: In Direct democracy, the electorate decides on policy initiatives directly
without elected representatives as proxies. This differs from the majority of currently established
democracies, which are representative democracies. Representative democracy is the example of
Indirect democracy. It is a democracy where elected people represent a group of people in
contrast to direct democracy. The representatives elected by the people exercise the supreme
power and thus carry the government and make laws. There are two types of representative
democracy i.e. Parliamentary and Presidential.
● India’s position: Indian constitution provides for representative Parliamentary democracy under
which the executive is responsible to the legislature for all its policies and actions. The
manifestations of democratic character of Indian polity include Universal adult franchise, periodic
elections, rule of law, independence of judiciary, and absence of discrimination on certain grounds
etc.
REPUBLIC
The head of the state is an elected person and not a hereditary position in a republican form of
government.
● Meaning: It is a form of government where citizens have the right to choose the head of the state
directly or indirectly. A republic means two more things: one, political sovereignty is vested in the
people and not one individual like a king; second, the absence of any privileged class. Thus, all
public offices being opened to every citizen without any discrimination.
● India’s position: India is a republic where the elected head of the state is known as the President.
The president is elected through an indirect election for a five year term.
JUSTICE
● Meaning: Citizens should not be discriminated against on the grounds of caste, religion and
gender. Social inequalities should be reduced. Government should work for the welfare of all,
especially of the disadvantaged groups.
● Explanation: The preamble to our constitution mentions three dimensions of justice - Social,
Economical, and Political.
o Social justice: It refers to the equal treatment of all citizens without regard to their social
distinction based on caste, colour, religion etc. Thus, privileges are absent in favour of any
particular section of society. However, at the same time, the state takes positive efforts to
improve the conditions of backward classes and women.
o Economic justice: It refers to the absence of discrimination between persons based on their
economic status. It also includes removal of high inequality in wealth, income and property.
Social and economic justice together constitute distributive justice, i.e., fairness in allocating
rewards and costs.
o Political justice: It entails that all citizens have equal political rights, equal access to all political
offices, and equal voice in government. Thus, the vote of an ordinary citizen in an election has
an equal weightage as the vote of the Prime Minister. Similarly, any citizen can stand for any
office of government in elections.
LIBERTY
● Meaning: There should be no unreasonable restrictions on the citizens in what they think, how
they wish to express their thoughts and the way they wish to follow up their thoughts in action.
● Explanation: The term 'liberty' refers to the absence of restrictions on an individual's activities. It
also means providing opportunities for the development of individual personalities. However, an
individual cannot misuse this and has to exercise this freedom within the limits prescribed by the
Constitution of India. Thus, it is not absolute but qualified.
EQUALITY
● Meaning: All are equal before the law. The traditional social inequalities should be ended. The
government should ensure equal opportunity for all.
● Explanation: The term equality as conceived by the Preamble embodies equality of status and
opportunity to all or any Indian citizens. Privileges are absent for any particular section of society
and at the same time, adequate opportunities without discrimination are to be provided for all
individuals. The constitution envisages three aspects of equality: civil, political, and economic.
o Civic equality essentially means that all individuals have equal rights and freedoms. This
principle is embodied in: Equality before law (Article 14), Prohibition of discrimination on
religion, race, caste, sex or place of birth (Article 15), Abolition of Untouchability (Article 17),
etc.
o Economic equality means providing fair and equal opportunity to all for work. Article 16
provides equality of opportunity to citizens in matters of public employment.
o Political equality guarantees to all persons an equal opportunity for participation in the
political process. This idea is reflected in the provision of universal adult suffrage in all
elections in India and Article 325. Article 325 prohibits any person from being declared
ineligible for inclusion in electoral rolls on grounds of religion, race, caste or sex.
FRATERNITY
● Meaning: All should behave as if we are members of the same family. No one should treat a fellow
citizen as inferior.
● Explanation: Fraternity refers to a sense of brotherhood. The Constitution contains various
provisions to promote this sense of fraternity:
o Single citizenship: A system of single citizenship has been provided by the constitution.
o Fundamental duty: Under Article 51A, it is the duty of every citizen to uphold and protect
sovereignty, unity and integrity as it is essential for the nation's social and economic
development. It is also a duty of every citizen to promote harmony and spirit of brotherhood
amongst all people of India transcending religious, linguistic, regional or sectional diversities.
o Provision in Preamble: The 42nd Amendment Act of 1976 replaced the term "Unity of the
Nation'' with "Unity and Integrity of the Nation." This idea encompasses both psychological
and territorial dimensions of national integration. Fraternity mentioned in the preamble
focuses on 2 parts-1) Assuring the dignity of an individual; and 2) Unity and integrity of the
nation.
IMPORTANCE OF PREAMBLE
● Embodies spirit of the constitution: The Preamble is the spirit and backbone of the Indian
Constitution.
● Basic principles: It contains principles that the constitution aspires to fulfil. It enumerates the
Constitution's overall goals. It provides basic principles and Fundamental values of the
constitution.
● Unravel minds of Constitutional forefathers: The constitution reflects the vision of India's
freedom struggle and that of the founders of the Constitution.
KM Munshi, a member of the drafting committee of the Constituent Assembly, mentions the
Preamble as a "Political Horoscope" of the Constitution of India. This description helps us
understand that the Preamble is not just the countenance of our Constitution but also worthy of
predicting past and future events. All the words in the Preamble significantly explain each feature
of an Indian identity
उद्दे शिका में सं शिधान का समग्र दिश न समाशिष्ट है । यह संशिधान के मूल मूल्यं के संशिप्त शििरण की तरह है ।
कई मूल्यं ने भारत के स्वतं त्रता संग्राम कय प्रेररत और शनदे शित शकया तथा इसके द्वारा पयशित हुए। ये मूल्य
भारतीय लयकतंत्र की नींि का शनमाश ण करते हैं । इन मू ल्यं कय भारतीय संशिधान की उद्दे शिका में िाशमल शकया
गया था। िे भारतीय संशिधान के सभी अनु च्छेदयं का मागशदिशन करते हैं ।
● अमेरिकी संशवधान से शिया गया: उद्दे शिका के साथ िुरू हयने िाला पहला संशिधान अमेररकी संशिधान
था। भारत ने अमेररकी संशिधान से उद्दे शिका की अिधारणा उधार ली।
● उद्दे श्य प्रस्ताव से प्रेरित: हमारी उद्दे शिका उद्दे श्य प्रस्ताि पर आधाररत है , शिसे पंशित नेहरू ने तैयार और
पेि शकया तथा संशिधान सभा ने इसे अपनाया।
● उद्दे शिका में संिोधन: 42िें संशिधान संियधन अशधशनयम (1976) द्वारा भारतीय संशिधान की उद्दे शिका में
केिल एक बार संियधन शकया गया है , शिसमें तीन नए िब्द ियडे गए हैं – समाििादी (socialist),
पंथशनरपे ि (secular) और अखंिता (Integrity)।
अपने ितश मान स्वरूप में भारतीय संशिधान की प्रस्तािना कय इस प्रकार पढ़ा िाता है :
“हम, भारत के लयग, भारत कय एक संपूर्ण प्रभुत्त्व-संपन्न, समाजवादी, पंथशनिपेक्ष, िोकतंत्रात्मक
गर्िाज्य बनाने के शलये तथा इसके समस्त नागररकयं कय:
सामाशिक, आशथशक और रािनीशतक न्याय,
शिचार, अशभव्यक्ति, शिश्वास, धमश और उपासना की स्वतंत्रता,
प्रशतष्ठा और अिसर की समता
प्राप्त कराने के शलये तथा उन सब में
व्यक्ति की गररमा और िाष्ट्र की एकता
तथा अखंडता सुशनशित करने िाली
बंधुता बढ़ाने के शलये
दृढ़ संकक्तित हयकर अपनी इस संशवधान सभा में आि शदनां क 26 नवंबि, 1949 ई. कय एतद् द्वारा इस
संशवधान को अंगीकृत, अशधशनयशमत औि आत्माशपणत करते हैं ।”
● अथण: उपरयि िब्दयं से पता चलता है शक भारत के लयग संशिधान के अशधकार के स्रयत हैं । "हम लयग" यह
स्पष्ट करता है शक उद्दे शिका और संशिधान न शसर्श संशिधान शनमाश ताओं का बक्ति लयगयं की सामूशहक इच्छा
का पररणाम है ।
● न्यायािय का शनर्णय: मदन गयपाल काबरा बनाम भारत संघ (1953) में, सिोच्च न्यायालय ने "हम लयग"
िाक्ां ि का उल्लेख शकया और कहा शक संशिधान कय नागररकयं से अपना अशधकार प्राप्त हयता है ।
समाजवादी (SOCIALIST)
● परिभाषा: धन सामाशिक रूप से उत्पन्न हयता है और समाि द्वारा इसे समान रूप से साझा शकया िाना
चाशहए। सरकार कय सामाशिक-आशथश क असमानताओं कय कम करने के शलए भूशम और उद्ययग के स्वाशमत्व
कय शिशनयशमत करना चाशहए।
● अथण: समाििाद समाि कय व्यिक्तस्थत करने का एक तरीका है । यह ज्यादातर अथश व्यिस्था या समाि के
उस शहस्से से संबंशधत है िय धन का सृिन करता है । समाििाद का मु ख्य उद्दे श्य सभी लयगयं के साथ उशचत
व्यिहार करना और समान रूप से धन का शितरण करना है । समाििादी समाि के लक्ष्य कय कैसे प्राप्त
शकया िाना चाशहए, इस पर शिशभन्न शिचार म िूद हैं । लेशकन इस बात पर आम सहमशत है शक सं पशत्त और
व्यिसाययं पर सरकार का शनयंत्रण हयना चाशहए न शक व्यक्तिययं का। यशद हम समाििादी अथशव्यिस्था की
बात करें तय िस्तुओं और सेिाओं के उत्पादन और शितरण से संबंशधत सभी शनणशय राज्य लेता है । इस
प्रकार, उत्पादन के सभी साधन/कारक राज्य के स्वाशमत्व में हैं । एक समाििादी राज्य का शिचार
उपभयिाओं की िरूरतयं कय पूरा करना और पू रे समु दाय के धन का अशधकतमकरण सुशनशित करना है ।
● पूूँजीवाद के साथ तुिना: एक पूाँिीिादी अथशव्यिस्था में मााँ ग और आपूशतश की बािार िक्तियााँ िस्तुओं और
सेिाओं के उत्पादन और शितरण से संबंशधत सभी शनणशययं कय शनधाश ररत करती हैं । चूाँशक मुख्य शनणश य बािार
की ताकतयं द्वारा शनधाश ररत शकए िाते हैं , इसशलए यह सबसे अमीर कंपशनययं और व्यक्तिययं के लाभयं कय
अशधकतम करता है ।
● भाित की क्तथथशत: राज्य के नीशत शनदे िक शसद्ां तयं में समाििादी तत्व थे। 42िें संियधन द्वारा उद्दे शिका में
'समाििाद' िब्द ियडा गया। इस प्रकार, संियधन में स्पष्ट रूप से उल्लेख शकया गया था शक संशिधान में
शनशहत समाििाद की प्रकृशत क्ा हयगी। कां ग्रेस ने 1955 में अपने अिािी अशधिेिन में 'समाििादी
स्वरुप' स्थाशपत करने के शलए एक संकि अपनाया और उसी कय प्राप्त करने के शलए उपाय शकए।
भारत सख्त (कठयर) समाििाद अथाश त ''साम्यिादी समाििाद'' का पालन नहीं करता है , शिसमें उत्पादन और
शितरण के सभी साधनयं का राष्ट्ीयकरण और शनिी संपशत्त का उन्मूलन िाशमल है । भारतीय समाििाद
मार्क्शिाद और गााँ धीिाद का शमश्रण है , शिसका झुकाि गााँ धीिादी समाििाद की ओर है । भारत ने अपने
िुरुआती ििों में शमशश्रत अथशव्यिस्था का अनुसरण शकया था अथाश त िहााँ सािशिशनक और शनिी दयनयं िेत्र साथ-
साथ म िूद थे। हालााँ शक, 1991 में नई आशथशक नीशत के बाद अथाश त उदारीकरण, शनिीकरण और िैश्वीकरण
यह आमत र पर िेत्रीय शििादयं कय हल करने के शलए उपययग शकया िाता है । उदाहरण के शलए, कश्मीर कय
भारत या पाशकस्तान का शहस्सा बनना चाशहए या स्वतंत्र रहना चाशहए, यह एक िनमत संग्रह द्वारा तय शकया
िाना था।
न्याय (JUSTICE)
• अथण: िाशत, धमश और शलंग के आधार पर नागररकयं के साथ भेदभाि नहीं शकया िाना चाशहए। सामाशिक
असमानताओं कय कम शकया िाना चाशहए। सरकार कय सभी के कल्ाण के शलए कायश करना चाशहए,
शििेि रूप से िंशचत समूहयं के शलए।
• प्रावधान: उद्दे शिका में, न्याय का तात्पयश सामाशिक, रािनीशतक और आशथशक न्याय से है ।
❖ सामाशजक न्याय: यह िाशत, रं ग, धमश आशद के आधार पर उनके सामाशिक भेद पर ध्यान शदए शबना
सभी नागररकयं के समान व्यिहार कय संदशभशत करता है । इस प्रकार, समाि के शकसी शििेि िगश के
पि में शििेिाशधकार अनुपक्तस्थत हैं । हालााँ शक, राज्य शपछडे िगों और मशहलाओं की क्तस्थशत में सुधार के
शलए सकारात्मक प्रयास करता है ।
❖ आशथणक न्याय: यह व्यक्तिययं के बीच उनकी आशथशक क्तस्थशत के आधार पर भे दभाि की अनुपक्तस्थशत कय
संदशभशत करता है । इसमें धन, आय और संपशत्त में उच्च असमानता कय दू र करना भी िाशमल है ।
सामाशिक और आशथशक न्याय शमलकर शितरणात्मक न्याय का सृजि करते हैं , अथाश त प्रशतर्ल और
लागत के आिं टन में शनष्पिता।
❖ िाजनीशतक न्याय: यह आिश्यक है शक सभी नागररकयं कय समान रािनीशतक अशधकार हयं, सभी
रािनीशतक पदयं में समान पहुाँ च हय और सरकार में समान आिाि हय। इस प्रकार, एक चुनाि में एक
सामान्य नागररक के ियट (मत) का प्रधानमं त्री के ियट के बराबर महत्त्व हयता है । इसी प्रकार, कयई भी
नागररक चुनाि में सरकार के शकसी भी पद के शलए खडा हय सकता है ।
स्वतंत्रता (LIBERTY)
• अथण: नागररकयं पर कयई अनुशचत प्रशतबंध नहीं हयना चाशहए शक िे क्ा सयचते हैं , िे अपने शिचारयं कय कैसे
अशभव्यि करना चाहते हैं और शकस तरह से िे अपने शिचारयं कय शक्रयाओं/कायों में अनुसरण करना चाहते
हैं ।
• प्रावधान: 'स्वतंत्रता' िब्द का अथश शकसी व्यक्ति की गशतशिशधययं पर प्रशतबंधयं की अनु पक्तस्थशत से है । इसका
अथश व्यक्तित्व के शिकास के शलए अिसर प्रदान करना भी है । हालााँ शक, कयई व्यक्ति इसका दु रुपययग नहीं
कर सकता है और भारत के संशिधान द्वारा शनधाश ररत सीमाओं के भीतर इस स्वतंत्रता का प्रययग करना हयगा।
इस प्रकार, यह शनरपे ि नहीं बक्ति ितों के अधीन है ।
बंधुत्व (FRATERNITY)
• अथण: सभी कय ऐसा व्यिहार करना चाशहए िैसे हम एक ही पररिार के सदस्य हैं । शकसी कय भी अपने साथी
नागररक कय हीन नहीं समझना चाशहए।
• प्रावधान: बंधुत्व का अथश भाईचारे की भािना से है । बंधुत्व की इस भािना कय बढ़ािा दे ने के शलए संशिधान
में शिशभन्न प्रािधान हैं :
❖ एकि नागरिकता: संशिधान द्वारा एकल नागररकता की व्यिस्था प्रदान की गई है ।
❖ मौशिक कतणव्य: अनुच्छेद 51ए के तहत, संप्रभुता, एकता और अखंिता कय बनाए रखना और उसकी
रिा करना प्रत्येक नागररक का कतशव्य है क्यंशक यह दे ि के सामाशिक और आशथश क शिकास के शलए
आिश्यक है । धाशमशक, भािाई, िेत्रीय या िगीय शिशिधताओं से ऊपर उठकर भारत के सभी लयगयं के
बीच सद्भाि और भाईचारे की भािना कय बढ़ािा दे ना भी प्रत्येक नागररक का कतश व्य है ।
❖ उद्दे शिका में प्रावधान: 1976 के 42िें संशिधान संियधन अशधशनयम ने "राष्ट् की एकता" िब्द कय
"राष्ट् की एकता और अखं िता" से बदल शदया। यह शिचार राष्ट्ीय एकीकरण के मनयिैज्ञाशनक और
िेत्रीय दयनयं आयामयं कय समाशहत करता है । उद्दे शिका में िशणशत बंधुत्व में किम्नकिखित 2 भाग पर ध्यान
केंशित शकया गया है । - 1) व्यक्ति की गररमा सुशनशित करना और 2) राष्ट् की एकता और अखंिता।
करती है ।
• संशवधान शनमाणताओं के शवचािों की अशभव्यक्ति: उद्दे शिका भारत के स्वतं त्रता सं ग्राम और संशिधान के
संस्थापकयं के दृशष्टकयण कय दिाश ती है ।
संशिधान सभा की प्रारूप सशमशत के सदस्य के.एम. मुंिी ने प्रस्तािना कय भारत के संशिधान की "रािनीशतक
कुंिली" के रूप में उल्लेख शकया है । यह शििरण हमें यह समझने में मदद करता है शक प्रस्तािना न केिल
हमारे संशिधान का चेहरा है बक्ति अतीत और भशिष्य की घटनाओं की भशिष्यिाणी करने के ययग्य भी है ।
प्रस्तािना के सभी िब्द महत्त्वपूणश रूप से भारतीय पहचान की प्रत्येक शििेिता की व्याख्या करते हैं
अन्य मामिे:
यहााँ कुछ और मामले हैं िहााँ सिोच्च न्यायालय ने संशिधान की उद्दे शिका का उपययग शकया या उस पर शटप्पणी
की।
• ए.के. गोपािन बनाम मद्रास िाज्य: इस मामले में यह तकश शदया गया था शक हमारे संशिधान की उद्दे शिका
भारत कय एक लयकतां शत्रक संशिधान दे ने का प्रयास करती है और इसकी व्याख्या में मागशदिश क िु रुआत
हयनी चाशहए।
• एसआि बोम्मई बनाम भाित संघ: एसआर बयम्मई बनाम भारत संघ (1994) मामले में, सिोच्च न्यायालय
ने शर्र से पुशष्ट की शक उद्दे शिका संशिधान का एक मूलभू त शहस्सा है ।
