An Ordinance Abrogating the Number Coding Scheme and it’s
Application for all tricycle for-hire in the Municipality of Iba.
Whereas, the Sangguniang Bayan of Iba, Zambales enacted
Municipal Ordinance no. 21 Series of 2020 entitled ‘ Amending the tricycle number coding scheme in the Municipality of Iba, Zambales in the Time of COVID-19 Pandemic’ last July 03, 2020. Whereas, with the decline of COVID-19 Cases and the observance of minimum Health Restrictions in the Municipality of Iba, gradual reverting back to pre-pandemic state is being experienced as manifested by the start of Face to face classes in all School levels. Whereas, with the increase in demand of public transport for the riding public and to facilitate the movement of products and services in the Municipality of Iba, there is a need to increase the number of operating public transport, hence the need to abrogate number coding scheme restrictions for Tricycle-for- Hire.
Section 1. Application – All registered Tricycle-for-Hire with franchise to operate within
the Municipality of Iba, shall be allowed to operate all throughout the week with the observance of other rules and restrictions provided for by other existing ordinances regulating the operation of the same. Section 2. Number of Passengers allowed – the number of passengers allowed for a tricycle-for-hire shall the prescribed number provided for in the MTFRB Ordinance of the Municipality of Iba. Section 3. Prohibition – NOWHERE in this Ordinance shall allow tricycle who are classified as private vehicle, no franchise to operate, expired franchise, not registered as For-Hire in the Land Transportation office, to engage as Tricycle-For-Hire within the territorial Jurisdiction of the Municipality. Section 4. Violation- Any violation of the provisions of this Ordinance shall suffer the penalty prescribed by other Existing Ordinance regulating the same. Section 5. Repealing Clause – This Ordinance shall repeal Municipal no. 21 Series of 2020 entitled ‘ Amending the tricycle number coding scheme in the Municipality of Iba, Zambales in the Time of COVID-19 Pandemic, in its entirety. Likewise, any existing ordinance not consistent with this Ordinance shall be deemed repealed. Section 6. Separability Clause- any provision of this Ordinance which may be considered as unconstitutional by any competent court or deemed inconsistent with existing laws shall not affect the validity of the entire Code. Section 7. Effectivity Clause – This Ordinance shall be effective immediately upon its approval, unless repealed, revoked or declared as unconstitutional.
