PETITION

COMES NOW petitioner, duly assisted by the undersigned Senior Agrarian Reform
Program Officer (SARPO) and unto this Honorable Provincial Adjudication Board, most
respectfully states that:

I.
The petitioner is the Municipal Agrarian Reform Program Officer (MARPO) of
Manukan, Zamboanga del Norte with office address at Department of Agrarian Reform
(DAR), Manukan, Zamboanga del Norte this province where she may be served with
summons and other processes from this Honorable Provincial Adjudication Board;

II.
BALDOMERO LIMJOCO is the owner of a certain parcel of agricultural land
situated in Madalag, Jose Dalman, Zamboanga del Norte, known as Lot No. 144,
covered by OCT No. P-3516, with an area of Thirty Two Thousand Six Hundred
Nineteen (32,619) square meters, machine copy of OCT No. P-3516 is hereto attached
as Annex “A” and made as an integral part hereof;

III.
The above-described parcel of land was purchased by RHEANNA JANE T.
LETRAN, et al. from Lorna Limjoco Gumtang, the sole child and heir of the late
Baldomero L. Limjoco and Gaudencia Lamoren. Machine copy of the Affidavit of Self
Adjudication and Deed of Absolute Sale are hereto attached and marked as Annex “B”
and “C” hereof;

IV.
The subject land is duly tenanted by LONITA A. CASIPONG, of legal age, Filipino
and a resident of Madalag, Jose Dalman, Zamboanga del Norte;

V.

RHEANNA JANE T. LETRAN and LONITA A. CASIPONG have decided to enter into
a leasehold agreement with the assistance of the Municipal Agrarian Reform Program

Officer of Jose Dalman, Zamboanga del Norte in accordance with A.O. No. 6, series of
2003 of the Department of Agrarian Reform;

VI.

That the leasehold agreement of RHEANNA JANE T. LETRAN and LONITA A.


CASIPONG was evidenced by a Leasehold Contract (Kasabutan sa Abang sa Yuta)
executed by the parties before Notary Public Rey P. Janolino, Jr. Machine copy of the
Leasehold Contract, marked as Annex “C” hereof;

VII.

That it is the ministerial function of the Municipal Agrarian Reform Program


Officer (MARPO) of DAR Zamboanga del Norte to file a Petition for Confirmation of
Leasehold Contract before the DAR Adjudication Board (DARAB);

PRAYER
WHEREFORE, premises considered, it is most respectfully prayed before this
Honorable Adjudication Board to order for the confirmation of the Leasehold Contract
executed into between RHEANNA JANE T. LETRAN and LONITA A. CASIPONG.

Petitioner further prays for such other relief and remedies just and equitable
under the premises.

I, JENNELYN B. MAGAWAY, the incumbent Municipal Agrarian Reform Program


Officer (MARPO) of DAR Jose Dalman, Zamboanga del Norte, under oath hereby depose
and say that:

I am the petitioner in this instant case;

I have read the foregoing Petition and the allegations therein are true and
correct as of my own knowledge and/or based on the records on hand;

I attest to the authenticity of the annexes thereof;

I further certify that I have not commenced and/or am not aware of any other
action or proceeding involving the same land, or a portion thereof, or issue in any court,
tribunal or quasi-judicial agency; and to the best of my knowledge, no such action or
proceeding is pending in any court, tribunal, or quasi-judicial agency, and if I should
thereafter learn that the same or similar action or claim has been filed or pending, I
shall report that fact within five (5) days from such notice.
