DECLARATION OF HEIRSHIP WITH

DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This instrument made and executed in the municipality of

San Francisco, Agusan del Sur, by and among ;

VICTORIA M. LOBO, widow of the late Ignacio Lobo, of

legal age, Filipino and a resident of Gamut, Barobo, Surigao
del Sur ;

MORIETO LOBO, of legal age, Filipino, married and a

resident of Gamut, Barobo, Surigao del Sur ;

CRESENTE LOBO, of legal age, Filipino, married and a

resident of Gamut, Barobo, Surigao del Sur, all hereinafter
called as the VENDORS ;

-and-

MR. & MRS. CATALINO R. IMPAS, husband and wife, of legal

ages and residents of Gamut, Barobo, Surigao del Sur,
hereinafter called as the VENDEE ;

WITNESSETH

Whereas, the above-named vendors are the only persons

referred to as the heirs of the late Ignacio Lobo I O.C.T.
No. 25131, identified as Lot No, 90, GSS 170, situated at
Gamut, Barobo, Surigao del Sur, and more particularly
described as follows :

“A parcel of land containing a total area of FORTY THREE THOUSAND EIGHT

HUNDRED FORTY SEVEN (43,847) Sq. Meters, bounded on the NE: along lines
9-11-1 by lot 66, Gss 170, NE, along line 1-2, by lot 249, Gss 170, SE, along line
2-4 by lot 96, line 4-5 by lot 401, Gss 170; SW along line 5-6 by lot 91, NW, along
lines 6-9 by lot 37, all of Gss 170 which same property has not been tenanted nor
worked by an agricultural lessee as contemplated by the Code of Agrarian Reform
of the Philippines,a s amended, since October 21, 1972 until the present”

WHEREAS, the above-named Vendors, being the co-owners of

the aforesaid land, hereby agree to sell the portion of the
above-described bed property, and shall divide the proceeds
thereof share alike ;

That for and in consideration of the sum of FORTY

THOUSAND (P40,000.00) Pesos, receipt whereof in full is
hereby acknowledged from the Vendee to the entire
satisfaction of the Vendors, Vendors do by these presents
hereby SELL, CEDE, CONVEY and TRANSFER in a manner of
absolute sale unto the said VENDEE, their heirs and assigns
that certain portion of the aforementioned land, with an area
of FOUR HUNDRED (400) Sq. Meters (or 20m x 20m) which sold
portion is more particularly bounded as follows:

BOUNDARIES OF SOLD PORTION:

North - Remaining portion South - Remianing portion

East - Remaining portion West - Remaining portion

Of which portion sold is free from all liens, encumbrances

whatsoever.

WHEREAS, the co-owners-vendors warrant peaceful

possession and enjoyment of the subject sold portion and
conveyed, and will forever defend the same unto the vendee,
their heirs, against any lawful claim of all persons
whomsoever.

That this instrument supercedes the previous document

entered into by the parties, per Doc. No. 327, Page No. 66,
Book No. XLII, Series of 2007, by Notary Public Atty. Leon O.
Montilla, Jr.

IN WITNESS WHEREOF, we have hereunto set our hands this

ACKNOWLEDGMENT
