1. General Information About the PESO-Certification

1.1. The PESO-Certification


To import products for the Oil and Gas industries into India you have to consider a
variety of special regulations and mandatory certifications for oil and gas processing
machines or storage equipment, applicable to both imported and Indian products.

The PESO certification was previously known as the Chief Controller of Explosives
(CCoE) approval and is based on a set of laws that are based on the Explosives Act
of 1884 and the Petroleum Act of 1934, namely the Explosives Rules of 2008 and the
Petroleum Rules of 2002.

1.2. PESO-certification regulations Law and Fines


It is not allowed to use, sell, trade, import or distribute products that fall under Indian
certification regulations without proper certification.

2. The Certification Procedure

2.1. Introduction

Process Overview:

1. Preparation of the documents


Since the PESO certification is a pure document check and neither product
tests nor factory inspections are required, the documents must be able to
sufficiently certify the safety of the products. Therefore it is absolutely
necessary to be able to present current (not older than 2 years) ATEX or
IECEx test reports.

2. Disclosure of commercial data concerning the product


To further ensure the safety of the product, international sales figures and
proof of sales for the past 3 years as well as sales forecasts for the Indian
market for the next 12 months must also be submitted.

3. Submission of the application documents


If all the above mentioned documents are available, the application documents
can be filled with all technical data of the products. The application cannot be
made by the manufacturer himself; an Authorized Indian Representative (AIR)
is required, who must have a commercial license for the products. He must
also be able to demonstrate sufficient technical knowledge of the product, e.g.
through proof of training on the part of the manufacturer.

4. Issuance of the product certificate


Once all documents have been submitted, there are usually some further
inquiries from the PESO authorities, but no documents can be submitted

subsequently or the deadline is too short to submit more recent documents, if
necessary. Therefore, it is absolutely necessary to submit the documents as
complete and up-to-date as possible at the beginning.
After all questions have been answered satisfactorily, the certificate will be
issued either for the product or for all individual parts.

Any modification to a machine or pressure vessel must be submitted for verification.


To avoid revisions, it is extremely important that the information on all documents is
exactly the same.

2.2. Certification Procedure FAQs

How do I know if my products are subject to the PESO certification?


You can find a comprehensive list of products that require a certification for the Indian
market on the websites of the Indian certification authorities. If needed, we can
support you with that.

Is it possible to complete the PESO certification process alone?


Anyone can apply for the PESO certification themselves, however the task of
completing the certification without help can be daunting. Without the proper
relationships with the test lab and the authorities, the certification process is difficult
and can drag on costing both time and money. The certification authority does not
indicate any application errors or give council on filling out forms. They will either be
accepted or rejected without any explanation as to why if rejected. Language barriers
can also cause difficulties.

Do I need to travel to India during the certification process?


No, it is not necessary to travel to India. Sometimes, however it can be advisable to
send someone to coordinate product testing with the test labs to simplify the procedure,
and possibly leading to fewer tests and save additional test costs.

What is the best way to prepare myself for the certification?


Testing for certification follows certain standards, therefore the best way to prepare is
to check the appropriate product standard to understand the relevant Indian
regulations and read through the corresponding checklists.

Do I need to worry about my intellectual property during certification?


If you follow a few rules you do not have to worry about your proprietary process being
tapped. With good preparation you can direct the tests in such a manner that your
intellectual property in not compromised. By submitting a rough draft-like product
drawings and savvy handling of application documents, the risk can be further
minimized.

3. Change Management
3.1. The Need for good Change Management

Manufacturers with PESO certificates for their products must comply with the
applicable Indian regulations for PESO approval compliance. Among those are
the related laws and regulations in India.
The applicant/certificate holder is responsible to announce any planned relevant
changes by submitting the required applications and to implement changes only
after approval by the Indian authorities.
Notifiable changes include the following items:

• Changes regarding the product design


• Changes regarding the product structure (e.g. adding a material layer on a
part)
• Changes regarding a “key component” (e.g. changing the tank cap of an
automotive fuel tank)
• Changes of a raw materials

The applicable laws and regulations explicitly state that only the
responsible certification body will decide if an official change application
must be filed and what the corresponding consequences for the certificate
holder will be.

3.2. Respond to Changes

In case there are major changes regarding the certified product itself, the
applicant may be required to send samples for testing in accredited test labs.
The Indian authorities constantly work on improving the regulations. As soon as a
new law becomes in effect, all changes in certificates and new PESO
certifications need to comply with the new requirements. Holders of PESO
certificates that are in compliance with the old requirements will have to apply for
a change within the deadline specified by the Indian certification authority and
might be required to do product re-tests according to the new regulation.
Valid certificates are required to comply with the most current regulations. If
certificate holders do not apply for a change of their certificate within the allotted
timeframe, they run the risk of non-conformance and possibly even suspension or
revocation of their certificate.

4. After the Certification Procedure

4.1. The PESO Certificate and the marking of products


After the evaluation of the product documents, the certificate is issued.

Every change on a machine or pressure vessel needs to be reported and approved.

At this time there is no factory inspection needed, but this could change in the
future.

4.2. Post-Certification FAQs

Will my certificate lose its validity?


A PESO certificate has a validity of 2 years and needs to be renewed then. PESO
approvals for static pressure vessels can only be applied for with a maximum validity
of 3 years before it needs to be renewed.

Once my product is certified, can the marked products simply be exported to


India?
Yes, with your PESO Certificate the Indian market is completely open for you to ship
your products.

Will Indian authorities inform PESO Certification holders about changes in the
regulatory system?
The short answer is no. Companies are obligated to conduct their own research
regarding changes if they do not hire an advisory firm to monitor changes that would
affect product compliance. Many changes can be found shortly after publication in our
“News” section on our website.

Is it a good idea to push the Indian authorities to shorten the certification period?
In business, time plays a key role. PESO certification projects take time, but it is
important to push only when absolutely necessary, since pushing can influence the
process negatively.
