Week 5 Activity

1. The major difference in Careless driving and dangerous driving is the


dangerous driving has criminal charges and careless driving is not a
criminal offence. But I think this line is not very clear as both the
driving’s can cause injuries to driver and other people also damages to
public or private properties. Identification is blurring as a person using
drugs and driving is that he is careless and at the same time it is
dangerous.
2. As per Page 44, Chapter 2 of textbook, Willful act or omission causing
the death of new born baby is a criminal offence. In Jeffery Baldwin
case, he died at the age of 6 due to starvation, this causes as per court due
to neglect by the parents.
3. As per Page 34, Chapter 2of textbook, a general duty of care is something
we need to be aware in our daily life and also when we take responsibility
of someone we are under the duty of care. In the case mentioned on this
page, a person was accused as he took voluntary duty to protect victim
who died as he took her to hospital rather than calling 911. The common
charges for negligence or not being careful can be paying the
compensation or damages done to person or property or criminal offence
if person dies.
4. A- Government decided to take down this law, as it contradicts with the
Charter rights and freedom which says everyone have a right to have fair
trial and defense.
B- I think this law should not have been taken down as people who abuse
substance willfully and then assault other people can be defended
saying they were highly intoxicated and this made them do the
wrongful. This can lead to people use encourage using drugs and other
materials and assaulting others especially women and children as they
know they can be defended.
