THIS DEED OF SALE executed on this day of February, Two thousand


Twenty three by Mr.S.K. DEVARJAN (PAN: ADXPD8436F) (Aadhaar Card
No.2313 2481 9655) (Mobile No. ) son of Mr. Kasthurisamy residing at 200,
Avinashi Road, Civil Aerodrome Post, SITRA, Coimbatore 641014 (hereinafter
called the VENDOR which term wherever the context so requires shall mean and
include his Legal heirs, executors, administrators and assigns.)
TO AND IN FAVOUR OF
1) Mr. AMARNATH S. (Aadhaar Card No. 9119 3665 3810) (PAN: AHDPA6581A)
(Mobile No.9242049844) and 2) Mrs. SUBATHRADEVI A. (Aadhaar Card No.9108
8388 1048) wife of Mr.S.Amarnath both residing at Door No.180, Kovai Road,
Kangayam, Tirupur – 638701 (hereinafter called the “PURCHASERS” (which term
shall mean and include their legal heirs, representatives, executors and
assignees)

WHEREAS the Vendor Mr. S.K.Devarajan and his family members made one
Partition Deed vide Document No. 12440/2021 registered at Sub Registrar office,
Gandhipuram, Coimbatore Registration District on 14 th day of December, 2021.and
whereas the Vendor Mr.S.K.Devarajan and his family are absolute owners of landed
property of A Schedule hereunder engaged a real estate developer M/s. Nivasan
Homes Private Limited, Coimbatore for the developing the property into residential
Apartment and commercial complex in the Schedule “A” and gave power on various
stages vide Power of Attorney Nos.9614/2014, 9046/2016 and the same was cancelled
vide document Nos.9382/2019, 9383/2019 and 1431/2021 respectively. After
completion of the Project fresh power was executed to the developer on 09.02.2021
vide document No.1432/2021 at SRO, Gandhipuram, Coimbatore for selling some flats
and commercial spaces keeping the balance for self use by the land owners as per
Schedule B . The building plan was approved by The Coimbatore Corporation vide their
Approval Nos. BA/0642/2018/MH2/E and BL/0624/2018/MH2E dated 23.07.2018,
L.P.A. ROC No.5395/2016/LPA-2 dated 22.06.2018. The entire Project was approved
by RERA under TNRERA Act 2016 vide their Project Registration
No.TN/11/Building/0280/2018 dated 07.09.2018.

WHEREAS the above Mr.S.K.Devarajan and his family members agreed that the
Schedule B properties will be divided and partitioned in such way that namely;
The Property described in the First Schedule as per Partition Deed No.12440/2021 shall
be allotted and belongs to the Party of the First Part i.e. Vendor Mr.S.K.Devarajan
exclusively.
WHEREAS the Vendor offered to sell the Flat No.104 in First Floor in ECHO
POINT complex, more fully described in the Schedule B hereunder the
Purchasers free from all encumbrances for a sum of Rs.1,12,00,000/- (Rupees
One Crore twelve lakhs only) and the purchaser also agreed to purchase the
under mentioned property for the said price.

NOW THIS DEED WITNESSETH that in consideration of the sum of


Rs.1,12,00,000/- (Rupees One Crore twelve lakhs only) paid by the Purchaser
to the Vendor in the following manner:

And the receipt of which the Vendor do hereby admit and acknowledge and
CONVEY, ASSIGN and TRANSFER and handed over the possession of the
Scheduled property to the Purchasers today by way of ABSOLUTE SALE free
from all encumbrances of whatsoever nature unto the Purchasers with all rights,
privileges, easements, right of way and appurtenances pertaining thereto and all
the rights, title and interest of the Vendor in and upon the Scheduled Property
and TO AND TO HOLD the same unto the Purchasers absolutely and forever
free from all encumbrances and claims.

The Vendor covenant with the Purchasers that the said property and every part
thereof shall remain and be to the use of the Purchasers in the manner aforesaid
and shall be quietly entered into upon and held and enjoyed by the Purchasers
without any interruption, dispute, claim or demand whatsoever from the Vendor
or any person claiming through him

The Vendor further covenant with the Purchaser that the said property is free
from all encumbrances, attachments or Court Proceedings and undertakes to
indemnify the Purchaser against any loss or damage that the Purchasers may
incur or suffer by reason of defect in title or Court proceedings if any.

The Vendor hereby declare that the Undivided share in the property setout in
Schedule ‘A’, hereunder which is more fully described in Schedule ‘B’ property
along with super built up area hereunder and in consequence the title and/or
possession of the Purchasers are affected or disturbed the Vendors agreed to
keep the Purchasers indemnified against all losses, damages compensation
together with costs and interest thereon.

The Vendor has delivered possession of the scheduled property to the


Purchasers on this day.

The Vendor declared that he is paid up to date House tax, Electricity charges
and other rates and taxes in respect of the scheduled property.

All taxes payable in respect of the scheduled property from this date shall be
borne by the Purchasers.

The Vendor has also signed in the necessary forms to change the property and
the House Tax, Electricity connection in the name of Purchasers.

In support of sale, the vendor has handed over the Photostat copy of the above
Partition Deed No. 12440/2021 and all other relevant documents regarding this
sale in photostat copies to the purchasers.

reserved for public purpose , the balance land available is 79967 sq.ft. or 183.41
cents.

The above property is situated in TAUTA NAGAR within the limits of


Coimbatore Corporation.

Schedule “A” Property .

called as “SREE DAKSHA’S SHRAVYA” with electricity and water tap
connections and respective deposits and right to use the common layout roads
and all other appurtenances thereon.
