CONSTITUTION AND BY-LAWS


PREAMBLE
We, the students of Mindanao State University – General Santos City Senior High School,
believing in the need for a better organized Supreme Student Government and in the
development of the youth as future leaders of the nation, do hereby promulgate and adopt this
Constitution and By-Laws of the Supreme Student Governments in Secondary Schools that
shall advance, implement, and maintain our goals and aspirations, embody the ideals and
principles of freedom, equality, justice and democracy, and promote the welfare of all
students and academic standards of our Alma Mater.

Article I. GENERAL PROVISIONS


Section 1. This Constitution and By-Laws shall be known as the Constitution and By-Laws of
the Supreme Student Government of Mindanao State University – General Santos City Senior
High School which shall be referred to as the SSG.

Article II. NAME, COLORS, AND DOMICILE


Section 1. The name of this Supreme Student Government shall be known as the Mindanao
State University – General Santos City Supreme Student Government which shall hereinafter
be referred to as the SSG.
Section 2. The official colors of the SSG and Senior High School shall be pink, white, and
gray. Section 3. The seat of the SSG shall be located inside the premises of the school.

Article III. DECLARATION OF PRINCIPLES, OBJECTIVES AND POLICIES


Section 1. Principles
a. The SSG shall have the power which emanates from the students body. It shall be an
autonomous, unified, and the highest democratic representative of the student body.
b. The SSG shall uphold and adhere with the Mission Statement of the Department of
Education “to protect and to promote the right of every Filipino to quality, equitable,
culture-based and complete basic education” where “students learn in a child friendly,
gender-sensitive, safe and motivating environment.”
c. The Mission Statement of the Department of Education shall serve as the guide of the
SSG in working to serve the best interest of the student body.
d. The SSG is founded on the principles of participatory democracy, responsible servant
leadership, collaboration, unity, accountability, and efficiency in serving the student
body.
e. The SSG shall be committed in putting these values, principles, and ideals into action
through academic, socio-civic, leadership programs and activities.

a. The SSG shall be the forefront of the students’ rights and welfare,
and shall be the model of students’ excellence, grounded on good character, and deep
sense of moral values.
b. The SSG will help students develop passionate love of country, values, and
competencies that will enable them to realize their full potential and to contribute
meaningfully in building the nation
c. The SSG will represent the students in the policy-making body of the school
concerning the students’ rights and welfare
d. The SSG will help develop a student-friendly, safe, and motivating learning
environment
e. The SSG will nurture an inclusive, service-oriented, gender-sensitive, and
environment conscious community
f. The SSG will help develop self-confidence, critical thinking, problem-solving,
decision-making, and learning among the students body and to utilize these skills in
contributing towards nation-building
g. The SSG will empower the students to strive for excellence in the academics,
leadership, and social responsibility and to encourage the students to be proactive
members of the society
h. The SSG will uphold the values, principles, and ideals of the Department of
Education;
i. The SSG will serve, to protect, and to promote the rights and welfare of every student.
Section 3. Policies
a. The SSG shall be the highest governing body of the students.
b. The SSG shall pursue at all times, the values of honesty and integrity in service,
renouncing all forms of corruption and acts which are contrary to the rules and
regulations of the school and the Department of Education.
c. The SSG shall encourage an open communication and dialogue with other student
organizations, movements, and other sectors of society not inconsistent with its
principles and purposes.
d. The SSG shall remain at all times, accountable and transparent with all of its
transactions involving the interest of its constituents who they must serve with
outmost responsibility, integrity, loyalty, efficiency, and professionalism.
e. The SSG shall strive to pursue an independent stand, not dictated by any other sector,
other than the students, as long as these are not contrary to the Mission – Vision
Statement and Core Values of the Department of Education.

Article IV. MEMBERSHIP


Section 1. All members of the SSG are bona fide students of Mindanao State University –
General Santos City Senior High School.

Section 2. The Executive Board of the SSG shall be composed of student


representatives from the different sections of Mindanao State University – General Santos
City Senior High School.

Article V. BILL OF RIGHTS


Section 1. Every student has the right to learn in an inclusive, child-friendly,
gender-sensitive, safe and motivating environment.
Section 2. Every student has the right to enjoy responsible freedom of speech and expression.
Section 3. Every student has the right to avail of all the services offered by the SSG which
includes but not limited to organizing, joining, and actively participating in clubs,
organizations, groups, and other associations for purposes not contrary to existing policies.
Section 4. Every student has the right to conduct and to actively participate in all school
activities and programs.
Section 5. Every student has the right to information of the programs, rules, policies,
regulations, and other matters concerning them.
Section 6. Every student has the right to suffrage, to apply for a position, to nominate, and to
be elected into office, and to exercise other electoral practices.
Section 7. Every student has the right to responsible and independent operation of the student
elections and student publications.
Section 8. Every student has the right to proper representation and participation in different
meetings and assemblies of the school on issues affecting the welfare of the student body.
Section 9. Every student has the right to recall their SSG representatives.
Section 10. Every student has the right to due process.
Section 11. Every student has the right to professional competence from the teachers and
school administration.
Section 12. Every student has the right to be academically evaluated based on equal and
objective criteria.
Section 13. Every student has the right to an open and regular student-teacher and student
school administration dialogue.
Section 14. Every student has the right to freely and responsibly express their concerns,
views, and grievances through the SSG Concerns Desk via Google Forms.
Section 15. Every student has the right to equal, legitimate, and responsible use of adequate,
safe, clean, and efficient school facilities.
Section 16. All other rights as specified in DepEd Order No. 40, s. 2012 entitled DepEd Child
Protection Policy but are not specified herein are included as rights of the students.

Article VI. DUTIES AND OBLIGATIONS OF STUDENTS


Section 1. Every student has the responsibility to observe and to uphold the laws of the
Republic of the Philippines, the rules and regulations of the School, and this Constitution at
all times.
Section 2. Every student shall exercise his/her rights responsibly and in good faith.
Section 3. Every student shall support and promote the ideals, principles, thrusts, and
objectives of the SSG, the School, and the Department of Education. Section 4. Every student
shall uphold the values of honesty and integrity.
Section 5. Every student shall endeavor to achieve academic excellence and shall abide by the
rules and regulations governing his/her academic responsibilities.
Section 6. Every student shall pursue to nurture an inclusive, serviceoriented,
gender sensitive, and environment conscious community.
Section 7. Every student shall abide by the Supreme Student Government Constitution and
ByLaws.
Section 8. Every student shall support the activities and programs of the SSG and the
Department of Education as approved by the appropriate DepEd issuances.
Section 9. Every student shall strive to become a proactive member of the society and to
contribute in the development of his/her community.

Article VII. POWERS, DUTIES AND RESPONSIBILITIES OF THE SSG


Section 1. The SSG shall be the highest governing body of the students.
Section 2. The SSG shall have the following functions and responsibilities:
a. To uphold and enforce the provisions of the Supreme Student Government By-Laws
and Constitution;
b. To support and to promote the ideals, principles, thrusts, and objectives of the SSG,
the
School, and the Department of Education;
c. To ensure fair, efficient, and effective delivery of services to student body;
d. To formulate and to recommend programs that will address relevant issues and
concerns of the students;
e. To plan, to implement, and to enforce policies designed to protect and promote the
students’ rights and welfare;
f. To monitor and to evaluate the students’ activities in the school and in the community;
g. To create committees as may be necessary to address the needs of the students;
h. To make recommendations to school authorities regarding student matters, affairs, and
activities;
i. To serve as a representative of the students in voicing their opinions, suggestions and
grievances;
j. To participate in the crafting and formulation of School Improvement Plans (SIPs);

k. To act as a Coordinating Council of all co-curricular organizations


in the School;
l. To have such powers and duties as the school authorities and the student body may,
from time to time, grant or delegate, consistent with stated principles, objectives, and
school policies;
m. To spearhead all DepEd driven thrusts, projects, programs, and activities of the SSG;
n. To monitor and to coordinate with the Supreme Student Government Commission on
Elections every election period;
o. To monitor and to coordinate elections of other recognized campus co-curricular
organizations;
p. To recommend to the School Head the granting, renewal or revocation of accreditation
of campus students organizations;
q. To turn over financial assets, papers, documents, properties, and other responsibilities
to the incoming SSG Officers;
r. To provide transparency and liquidation reports to the student body at the end of every
semester; and,
s. To submit financial and accomplishment reports to the school authorities on a monthly
basis. A terminal report must be submitted to the school authorities and the incoming
SSG Officers during the turn-over of responsibilities.

Article VIII. DISCERNMENT OF OFFICERS


Section 1. The officers or the Executive Board shall be composed of the Class Presidents and
Classroom Representatives of all sections from Grade 11 to Grade 12 of MSU Senior High
School. The Class President/s has the right to decline for the position; in this case, the class
shall vote for another Class Representative.

1.1 The members of the SSG has the right to:


a. Give suggestions and recommendations to the officers regarding the SSG’s activities.
b. Accept, reject, or amend the SSG’s general plan of activities during its presentation in
the general assembly or meeting.
c. Recommend the policies to the officers for the SSG to adapt.

Section 2. Members elected to the position of responsibility in the SSG shall be known as the
Executive Board. The Executive Board is composed of the President, Vice President,
Secretary, Assistant Secretary, Treasurer, Auditor, Public Information Officer, Peace Officer
and Committee Heads of the following:
a. Projects and Programs Committee
b. Internal Affairs Committee
c. External and Community Services Committee

2.1 The executive power shall be vested on the President of the SSG

2.2 President
a. Should be in 12th grade;
b. Shall be elected by the members;
c. Should gather the majority votes (half plus one) on the election process;
d. Shall preside meetings and assemblies of the members and the officers and shall call
the meeting to order and, if there is quorum and shall order the reading of the minutes
of the previous meeting;
e. Shall coordinate and implement the activities of the SSG;
f. The President normally serves for the duration of one (1) year elected every 1st Friday of
the academic year;
g. Shall have the power to create a committee and appoint a committee head with the
approval of the officers;
h. Shall officially represent the student body at any function on or off the campus;
i. Shall serve as ex officio member of all executive committees;
j. Shall enforce this Constitution and By-Laws, and other regulations that may be
promulgated;
k. Shall sign all the official minutes, project proposals, resolutions, correspondences, and
other official papers of the SSG;
l. Shall represent the SSG or designate his/her representative for any external or internal
affairs/functions;
m. Shall head the Coordinating Council of School Co-Curricular Organizations;
n. Shall perform other functions inherent and incidental to his/her office.

2.3 Vice President


a. Should be in 11th grade;
b. Shall take responsibility of the SSG in the absence, incapability, impeachment or
resignation of the President;
c. Shall have the power to impose, for a just cause, corrective, or disciplinary measures
of officers for culpable violation of the Constitution and By-Laws including a

recommendation to the Executive Board for their dismissal in the


manner provided in this Constitution and By-Laws.
d. Shall be the direct counselor of the President;
e. Shall be the major director of different committee heads under him/her;
f. Shall assist the President in accomplishing the plans and implementing the policies of
the SSG and in the enactment of the provisions of this document;
g. Shall assist the Internal Affairs Committee.

2.4 Secretary
a. Shall keep important documents of the SSG;
b. Shall be in-charge of the assessment of the members’ standings;
c. Shall be the keeper of all the properties of the SSG;
d. Shall provide immediate documentation and reports for every implemented project;
e. Shall call and prepare all notices of SSG meetings;
f. Shall handle the official directory of the SSG;
g. Shall be the Head of the SSG Secretariat;
h. Shall assist the Academic Matters Committee;
i. Shall prepare a letter of notice to officers who violated the Constitution and By-Laws
imposed by the Vice President.

2.5 Assistant Secretary


a. Should be in 11th grade;
b. Shall take responsibility for the important documents of the SSG in the absence of the
Secretary;
c. Shall assist the Secretary in accomplishing documentation and reports of meetings and
implemented projects;
d. Shall be an automatic nominee for the position of Secretary in his/her 12th grade.

2.6 Treasurer
a. Should be an ABM student;
b. Shall keep all financial records of the SSG and be the one responsible for any
information related to the student activity fund;
c. Shall serve as the disbursing officer of all the SSG’s funds;
d. Shall handle the budget allocation of the SSG’s various projects and activities;
e. Shall prepare accurate and transparent liquidation reports after every activity or school
events, and at the end of the term;
f. Shall serve as an ex-officio member of any and all Financial Committee for the
purpose of considering budgetary and/or financial matters of the SSG;

g. Shall conduct an inventory of SSG property and submit a report, in


writing, of its condition and state;
h. Shall assist in the fundraising and income-generating activities of the SSG.

2.7 Auditor
a. Should be an ABM student;
b. Shall work together with the Treasurer and the Finance Committee in ensuring
transparency in the budget allocation of the SSG;
c. Shall prepare the Bi-annual Financial Report;
d. Shall certify the legitimacy and correctness of the disbursement of funds;
e. Shall audit all expenditures of the SSG;
f. Shall keep and update the inventory of all the SSG’s properties;
g. Shall act as the Assistant Head of the Financial Committee;
h. Shall be an automatic nominee for the position of Treasurer in his/her 12th grade.

2.8 Public Information Officer


a. Shall update the members of the SSG with the weekly activities through text, official
group chat/s or any available forms of communication;
b. Shall announce the meetings and activities of the members two (2) days prior to the
set date;
c. Shall disseminate and promote the thrusts and objectives of the SSG to the student
body;
d. Shall build and maintain a credible image for the SSG;
e. Shall take charge in the promotion of SSG projects and activities;
f. Shall Head the Publicity Committee of the SSG as well as the Multimedia Group of
the
SSG;
g. Shall take responsibility for the strict compliance of the officers’ duties.

2.9 Peace Officer


a. Should be in 12th grade;
b. Shall help the presiding officer in maintaining peace and order during meetings,
activities and full events;
c. Shall act as Disciplinary Officer;
d. Shall maintain peace and order within the premises of the school;
e. Shall act as Chief Peace Officer and over-all Sergeant-at-Arms of subordinate
organizations and classes;

f. Shall Head the Student Police of MSU Senior High School;


g. Shall choose Student Police Officers from the Peace Officers of all sections from
Grade 11 and Grade 12 to be automatic nominee/s, and shall undergo application and
interview headed by the Appointment Committee. If there are Classroom Peace
Officer/s that are not qualified, the Peace Officer shall choose Student Police Officers
from the application headed by the Appointment Committee .

2.10 Student Police


a. Shall be responsible for crowd control during school events, if needed;
b. Shall be impartial;
c. Shall assist in the preparation of SSG headed events.

2.11 Projects and Programs Committee


a. Shall create projects and initiate programs for the Senior High School;
b. Shall assist the different committees in the creation of projects;
c. Shall keep track of the different projects created by the different committees;
d. Shall make sure that the projects created by the committees align with their purpose;
e. Shall Head the creation of the annual Calendar of Activities of the Senior High
School;
f. Shall give weekly updates a month before an approved event or program through
official group chat/s or any available forms of communication.
g. Shall choose five (5) appointees from the application headed by the Appointment
committee.

2.12 Internal Affairs Committee


a. Shall manage the official SSG Facebook Page and Twitter Page and other digital
pages or groups of the SSG;
b. Shall communicate with the different clubs and organizations in the Senior High
School whenever the SSG deem it necessary;
c. Shall act as the Assistant Head of the Appointment Committee;
d. Shall choose two (2) appointees from the application headed by the Appointment
committee.

2.13 External and Community Services Committee


a. Shall communicate with external clubs, organizations and human resources whenever
the need arises;
b. Shall be in-charge of the formation of projects that strengthen the Senior High School
spirit of volunteerism and community service;

c. Shall be in-charge of the formation of projects specifically suited


for the development of the members of the SSG;
d. Shall propose at least 2 (two) community service per academic year in collaboration
with the Projects and Programs Committee and Internal Affairs;
e. Shall choose three (3) appointees from the application headed by the Appointment
committee.

2.14 Students’ Welfare Committee


a. Shall ensure the welfare of the Senior High School students;
b. Shall be in-charge of the creation of projects specifically suited for the advancement
of the students’ welfare;
c. Shall choose three (3) appointees from the application headed by the Appointment
Committee and the President of the RCY Club shall be an automatic ex officio;
d. Shall collaborate with External and Community Services Committee with certain
projects to ensure the welfare of the Senior High School students.

2.15 Academic Matters Committee


a. Shall be in-charge of the formation of projects that are beneficial to the Senior High
School students’ academics;
b. Shall ensure that the Senior High School students are of good academic standing;
c. Shall communicate with struggling students and develop programs that are helpful to
them;
d. Shall choose one (1) representative from each club (ICT Club, Math Club, and
Science Club) as an automatic appointee.

2.16 Sports, Literary and Cultural Affairs Committee (presidents from each clubs)
a. Shall communicate with school clubs and organizations that are inline with the
committee’s objectives (e.g. IGSO, Humanities and
Social Sciences Club,
Communication Arts Club, and Filipino Club);
b. Shall be the SSG’s point person during the Intramurals together with IGSO;
c. Shall be in-charge in the formation of projects specifically suited for boosting the
students’ interest in sports and literature, as well as strengthening the students’
cultural ties;
d. Shall have the presidents of the following clubs as the appointees of the said
committee: Communication Arts Club, Filipino Club, Indak Galaw Sayaw
Organization, and Humanities and Social Sciences Club.

a. Shall prepare accurate and transparent liquidation reports after


every activity or school events, and at the end of the term;
b. Shall formulate pertinent financial guidelines for the SSG;
c. Shall assist the Treasurer with the budget allocation of the SSG’s various activities and
projects;
d. Shall spearhead the formation of income-generating projects of the SSG;
e. Shall choose one (1) appointee from the application headed by the Appointment
Committee.

2.18 Appointment Committee


a. Shall be in-charge of the application process for the appointees needed by the different
SSG committees;
b. Shall be in-charge of making evaluation sheets for the different committees with
regards to the efficiency of the different appointees;
c. Shall be in-charge of all the appointees from the different committees;
d. Shall provide an evaluation report of the appointees’ performance after every event
and shall formulate recommendations to better the appointees’ work for their
committees.

2.19 Ways and Means Committee


a. Shall be in-charge of the crowdsourcing of logistics and resources needed by the SSG
for the realization of different activities;
b. Shall head the crowdsourcing for different potential partners and solicitors for the
realization of the SSG activities;
c. Shall choose five (5) appointees from the application headed by the Appointment
Committee.

2.20 Multimedia Committee


a. Shall be in-charge of creating publication materials needed by the
SSG for information dissemination;
b. Shall take part in photo and video documentation in any organizational or school
activities;
c. Shall choose six (6) appointees that possess qualities in layout editing, photo editing,
video editing, photography and videography from the application headed by the
Appointment Committee.

Article IX. PERMANENT COMMITTEES IN THE SSG


Section 1. There shall be ten (10) permanent committees in the Student Government, namely:
Multimedia Group, Student Police, Projects and Programs Committee, Internal Affairs

Committee, External Affairs and Community Service Committee, Ways


and Means Committee, Student’s Welfare Committee, Academic Matters Committee, Sports,
Literary, and Cultural Affairs Committee, Finance Committee, Multimedia Committee and
Appointment Committee. The members of each committee shall be chosen via an application
process spearheaded by the Appointment Committee Head from which the different
committee heads can choose their appointees.
Section 2. The Multimedia Group shall be headed by the Public Information Officer and shall
create graphics needed by the SSG, and take photo and video documentation during school
events.
Section 3. The Student Police shall be headed by the Peace Officer and shall be responsible of
keeping the order in the school.
Section 4. The Projects and Programs Committee shall be headed by the Projects and
Programs Committee Head and shall be in-charge of the formation of different projects that
the Senior High School needs.
Section 5. The Internal Affairs Committee shall be headed by the Internal Affairs Committee
Head and shall be assisted by the Vice President. The committee shall be responsible for the
good publicity of the SSG. The committee is also in-charge of the communication of the SSG
with the different school clubs and organizations. The committee is also responsible of the
maintenance of all the digital media that the SSG uses as well as take charge of all the matters
regarding the members of the SSG and its functions.
Section 6. The External Affairs and Community Service Committee shall be headed by the
External Affairs and Community Service Committee Head and shall be responsible for the
communication of the SSG with external human resources and organizations, should the SSG
deem it necessary for different projects. The committee shall also be in-charge of the
formation of community service projects that the SSG may partake or facilitate.
Section 7. The Ways and Means Committee shall be headed by the Ways and Means
Committee Head and shall be responsible for the crowdsourcing of funds, resources, and
sponsors that are necessary for the realization of SSG projects.
Section 8. The Student’s Welfare Committee shall be headed by the Gripes and Grievances
Committee Head and shall be in-charge of the students’ welfare. The committee shall also
serve as the concerns desk of the SSG and shall be in-charge of the concerns form. Section 9.
The Academic Matters Committee shall be headed by the
Academic Matters Committee Head and shall be assisted by the Secretary. The committee
shall be in-charge of the formation of projects necessary for the maintenance of the students’
good academic standing.
Section 10. The Sports, Literary, and Cultural Affairs Committee shall be headed by the
Sports, Literary and Cultural Affairs Committee Head and shall be responsible for the
formation of projects relating to sports, literature and, culture.

Section 11. The Finance Committee shall be headed by the Finance


Committee Head and shall be assisted by the Auditor. The committee shall be responsible for
all the monetary matters and properties of the SSG.
Section 12. The Appointment Committee shall be headed by the Appointment Committee
Head and shall be assisted by the Internal Affairs Committee Head. The committee shall be
responsible for all the appointees in the different committees.
Section 13. Other committees, permanent or ad hoc in nature, may be created by the SSG
should the need arises.

Article X. ELECTORAL PROCESS


Section 1. The conduct of any election, plebiscite, or referendum shall be done with strict
adherence to the SSG Election code to be crafted by the founding members.
Section 2. The officers of the SSG are the duly elected President, Vice President, Secretary,
Assistant Secretary, Treasurer, Auditor, Public Information Officer, Peace Officer, Projects
and Programs Committee Head, Internal Affairs Committee Head, External Affairs and
Community Service Committee Head, Ways and Means Committee Head, Gripes and
Grievances Committee Head, Academic Matters Committee Head, Sports, Literary, and
Cultural Affairs Committee Head, Multimedia Committee and Appointment Committee.
Section 3. Two (2) duly-elected representatives from each class sections will be candidates
for office in the SSG.
Section 4. Candidates for office in the SSG must:
a. Be a bona fide student of the Mindanao State University General Santos City Senior
High School Program;
b. Be of good academic standing without any failing grade during the 1st to 3rd grading
period of the current school year;
c. Be of good moral character;
d. Have not been subjected to any disciplinary sanction;
e. Be the Student Representative of his/her current section.
Section 5. All SSG elections shall be conducted at the first Friday of the academic year.
Section 6. Once elected, all SSG officers shall be considered resigned, and ineligible from all
major elective or appointive positions in other clubs and organizations. Major elective or
appointive positions shall refer to the President, Vice President, Secretary, Treasurer, and
Auditor, Public Information Officer, Peace Officer or equivalent positions, including Editor
in-Chief, Managing Editor and Associate editor of the School Paper or Publication.
Section 7. No residency shall be required of the candidates for all the SSG elective positions.
Section 8. The officers of the SSG shall hold office for one (1) school year.

Article XI. HOMEROOM CLASS ORGANIZATIONS


Section 1. There shall be a homeroom class organization in every section composed of
officers parallel to the organization structure of the SSG.

Section 2. The homeroom class organization shall be responsible in


implementing programs and projects of each class.
Section 3. The homeroom class organization shall assist the SSG in implementing its
programs and projects.
Section 4. The homeroom class organization shall be guided by the designated class adviser
who must be part of the teaching staff of the school.

Article XII. COORDINATING COUNCIL OF CAMPUS CO-CURRICULAR


ORGANIZATIONS
Section 1. The Coordinating Council shall be headed by the President of the SSG as the
Chairperson.
Section 2. The Coordinating Council shall be composed of the different Presidents of all
recognized legitimate campus co-curricular organizations.
Section 3. The Coordinating Council shall have the following functions:
a. Coordinate school-wide activities, which need the participation and involvement of
the whole student body;
b. Create an annual calendar of activities for advanced dissemination of information to
the student body;
c. Provide and support a consultative mechanism for the implementation of the various
programs and projects of all co-curricular organizations;
d. Plan programs and synchronize student activities in the campus;
e. Serve as the venue to present accomplishment reports, financial reports and other such
reports of the SSG and other organizations; and,
f. Set rules and standards for the collection of membership fees or contributions by
recognized campus co-curricular clubs or organizations for the approval of the School
Head.
Section 4. The Coordinating Council shall meet at least once every quarter or upon notice of
the Chairperson upon the request of any of its members as often as the council may deem
necessary.
Section 5. The School Head shall serve as the Adviser of the Coordinating Council. As such,
all resolutions and agreements arrived at by the Coordinating Council shall be noted by the
School Head.
Article XIII. ADVISER
Section 1. The SSG Adviser shall be endorsed to the School Head from among the three (3)
teacher-nominees submitted by the newly-elected SSG officers through a resolution.
Section 2. The SSG Adviser shall have the following qualifications:
a. Have experience in organizational management;
b. With good character and reputation in the school and community;

c. Competent, able, and willing to work with the student leaders from
planning to implementation of projects, programs and activities.
Section 3. The SSG adviser shall monitor all programs, projects, activities, and meetings of
the SSG at all times.
Section 4. The Advisory in the SSG shall be equivalent to one teaching load as per Republic
Act No. 4670

Article XIV. THE GENERAL ASSEMBLY


Section 1. The General Assembly of the SSG shall be composed of all the elected Homeroom
Class Organization Presidents, Vice Presidents, and Secretaries of the School.
Section 2. The General Assembly shall be a forum for information and consultations, from
which decisions shall be significantly considered.
Section 3. The General Assembly shall be convened by the SSG President once every two
months and as the need arises.

Article XV. MEETING AND QUORUM


Section 1. The SSG shall conduct regular meetings every first Wednesday of the month or as
agreed upon by the officers in the SSG.
Section 2. Special meetings of the SSG may be called upon by the SSG President or by a
majority of the SSG officers.
Section 3. Majority of the officers of the SSG (50%+1) shall constitute a quorum.
Section 4. Each member of the SSG is entitled to only one vote.
Section 5. If the votes end up in a draw, the SSG President or the Acting Chair of the
meetings shall cast the vote to break the tie.
Section 6. No proxy shall be allowed when voting.
Section 7. The officers shall be prohibited from casting abstain votes.
Section 8. An excuse letter for the last class shall be prepared for the officers for meetings
that need more extended time.
Section 9. Meetings of the SSG should follow the parliamentary procedure.

Article XVI. FINANCE


Section 1. All receipts of moneys from all sources shall be evidenced by acknowledgment
receipts.
Section 2. A semestral report on the receipts and/or collections made duly
signed by the Treasurer and the President, and noted by the SSG Adviser shall
be posted on the SSG bulletin board and be submitted to the School Head.
Section 3. The SSG shall deposit all funds received collected and shall maintain banking
connection for the regular deposit and savings account of the SSG.

Section 4. The organization may accept cash donations from any member
or any public or private person or institution, as long as it will not affect or compromise the
integrity of the SSG.
Section 5. The SSG may undertake fund-raising activities to subsidize its projects and
activities as long as it will not affect or compromise the integrity of the SSG.
Section 6. The SSG shall enjoy the freedom to determine its priorities in the disbursement of
its funds, provided that it shall be actually, directly, and exclusively used to support and/or
finance SSG programs, projects, and activities.
Section 7. All disbursement and bank withdrawals shall be made in accordance with the
programs, projects and activities of the SSG embodied in the yearly action plan endorsed by
the SSG Adviser and duly approved by the School Head.
Section 8. The SSG President and the Treasurer shall be the signatory of all fund
disbursements and bank withdrawals of the SSG. All fund disbursements and bank
withdrawals must be accompanied with an SSG resolution duly noted by the SSG Adviser.
All expenses must be supported by official receipts. The School Head shall be provided a
copy of all the resolutions relative the disbursements made.
Section 9. The SSG through the Treasurer, Auditor, and Finance Committee shall promulgate
financial guidelines for proper financial management.
Section 10. At the end of every activity, the SSG shall liquidate expenses before another
disbursement. Without this, succeeding bank withdrawals shall not be authorized. Funds of
the SSG shall be audited at the end of the term of the SSG and at the end of every activity.
Section 11. Financial statements shall be posted in the SSG bulletin board and Facebook page
every month, printed in every issue of the School Paper and, the School Head must be
furnished with a copy.

Article XVII. SANCTIONS Section


1. The following are the sanctions given to an SSG member:
a. Failure of any bona fide officer(s), committee head(s), and the appointee(s) to perform
duties of which he/she/they was/were elected/appointed without reasonable cause;
b. Failure to attend three (3) meetings and three (3) tardiness without reasonable cause.
Section 2. Three (3) sanctions from any SSG member(s) may lead to demotion and/or
grounds to impeachment as provided for in Section 3 (a) of Article XVIII.
Section 3. Due process must always be observed in the sanction of any members of the
Executive Board.
a. Assessment and filing a sanction against an officer from the Executive Board shall be
performed by the Adviser and fellow officers in the Executive Board.
b. Assessment and filing a sanction against a Committee Head shall be performed by the
appointees under them, Executive Board, and the Adviser.

c. Assessment and filing a sanction against an Appointee shall be


performed by fellow appointees, the Committee Head, and the Adviser.

Article XVIII. VACANCIES, RESIGNATIONS, AND IMPEACHMENT


Section 1. Vacancies
a. Any vacancy in any positions for the reason of death, resignation, impeachment, shall
be filled, subject to the recommendation of the SSG;
b. Any vacancy in the SSG, except the position of the President, shall be filled by voting
through nominations from among the qualified members of the SSG.
Section 2. Resignations
a. A letter of resignation shall be submitted to the President or Vice President by any
elected officer who wishes to resign from the Executive Board at least one (1) week
before the next meeting.
b. The resignation of an elected officer shall take effect five (5) days after the approval
of the majority of the members.
c. A letter of resignation shall be submitted to the President or Vice President and
Appointment Committee Head by any appointed officer who wishes to resign from the
Committee Board at least one (1) week before the next meeting.
d. The resignation of an appointed officer shall take effect immediately after the approval
of the Appointment Committee Head.
e. During a meeting when a resignation is presented, nominations will be taken to fill the
office and voting procedures will be conducted as stated above.
Section 3. Impeachment
a. The members of the SSG may be impeached on the following grounds: culpable
violation of the Constitution-and-By-Laws; gross misconduct, violation to person in
authority, negligence, and disloyalty to the cause of the SSG and the school;
nonattendance in both regular and special meetings for three (3) times without valid
cause; academic failure during the 1st to 3rd grading of the current school year; and,
abuse or misuse of power and authority.
b. Any member can call upon the Executive Board for a special meeting to present
substantial evidence on the lack of duty of an officer;
c. The investigated officer shall be informed twenty days (20) prior to his/her
impeachment case proceedings, of the charge/charges against him/her, to afford him/
her the opportunity to be heard with or without a counsel in his/her defense.
d. During the impeachment proceedings, the case will be presented where the officer
under investigation will be given the opportunity to present his/her defense before the
members of the SSG;

e. A half-plus-one (50% + 1) vote, excluding the investigated officer,


is needed for the impeachment to be carried out;
f. In the event that the impeachment is carried out, a new candidate will be nominated
and elected as aforementioned above.

Article XVIX. AMENDMENT AND RATIFICATION OF THE BY-LAWS


Section 1. Amendment
a. Every proposal to adopt, amend, or rescind the Constitution and By-laws of the Student
Government shall be in writing, properly presented and shall set forth the nature of the
proposal. Such proposals may be initiated and presented to the Executive Board. Proposals
to adopt, amend, or rescind the Constitution and By-laws may be voted during the general
assembly or upon meeting called for by the President of the SSG and majority of the
members. The Executive Board cannot be compelled to submit to the members for
ratification an amendment that they feel to be improperly made, incomplete and/or cannot
be properly deliberated due to lack of time. The proposed amendment(s) shall not be
considered until its properly submitted and completed by the proponent(s) and that
members be afforded time to deliberate and/or consider said proposed amendments(s).
b. Unless the Executive Board orders a mail ballot, the Secretary shall include in the call for
the general assembly and/or meeting called by the President all properly presented
proposal(s) to adopt, amend or rescind the Constitution and By-laws of the Student
Government. A majority affirmative vote of regular members of the Student Government
who are present in the meeting called for the ratification and amendment is required to
adopt, amend, or rescind the Constitution and By-laws. The Executive Board shall exert
due diligence and/or effort that the members of the Association who are entitled to vote be
informed of the amendment and participate in the ratification of the proposed
amendment(s).
Section 2. The amended Constitution and By-laws shall go into effect immediately upon
approval.
Article XX. TRANSITIONARY PROVISIONS
Section 1. With the modification resulting from this Constitution and By-laws, the existing
Bylaws shall remain in force until the new By-laws are approved. The incumbent Executive
Board shall remain in the office until the end of the term as stated in Section 8 of Article X.
Section 2. This Constitution and By-laws shall take immediately after a quorum (50% + 1) of
the members shall have ratified it.
Section 3. Any provision of the Constitution and By-laws of the Society violate of any
provision of the Constitution and By-laws of SSG shall be considered void and in no force and
effect, ab initio.
Section 4. Complete abrogation of this Constitution and By-laws with the consequent
dissolution of the student government can be effected only upon unanimous approval of all
members in good standing in a meeting called by the Executive Board.
