REPUBLIC ACT OF 9003


 Also known as the:
ECOLOGICAL SOLID WASTE MANAGEMENT ACT OF 2000
 States the policies and penalties or certain prohibited acts that can harm the environment.
 An act providing for an ecological solid waste management program, creating necessary
institutional program mechanism and incentives, appropriating funds and for other purposes.

 Republic Act No. 9003 was passed by the Philippine Congress on December 20, 2000
 It was approved on January 26, 2001 by the Philippine President, Gloria Macapagal-Arroyo

COMPREHENSIVE SOLID WASTE MANAGEMENT


1. Waste Characterization and Segregation
 The Solid Waste generation within the area of jurisdiction shall be characterized for initial source
of waste reduction and recycling element of the local waste management plan.
Types of Waste for on-site collection
a. compostable
b. non-recyclable
c. special waste
 Conduct at the source including household, commercial, industrial and agricultural source.
2. Source Reduction
 Methods by which the LGU can reduce a sufficient amount of solid waste disposed within 5
years.
 Divert 25% of all solid waste from waste disposal through reuse, recycle and composting
activities.
 Rate of waste diversion is set to increase every 3 years.
3. Collection and Transport of Solid Waste
 The geographic subdivision are taken into account in coverage of the solid waste collection area
in every Barangay ensuring 100% collection efficiency within 24 hours from all sources.
4. Recycling Program
 The department of Trade and Industry in coordination with concerned agencies, is directed to
publish an inventory of existing markets for recyclable materials, product standards for
recyclable and recycled materials, and proposal to stimulate demand for the production of
recyclable materials and products.
 Non-environmentally acceptable product shall be allowed within (1) year after public notice as
alternatives available to consumers
5. Material Recovery Facility (MRF)
 LGU are mandated to establish Material Recovery Facility in each Barangay or cluster of
Barangay designed to receive, sort, process and store compostable and recyclable materials
efficiently.
6. Composting
 The Department of Agriculture shall publish an inventory of existing markets and demands for
composts that is updated annually.
 This compost intended for commercial distribution should conform to the standard set by DA for
organic fertilizers.

NATIONAL SOLID WASTE MANAGEMENT COMMISSION (NSWMC)


 Mandated to publish guidelines for identification of areas with common waste management
problems and appropriate units for clustering solid waste management services
 Local Government Code for all Provinces, Municipalities and Barangays to coordinate efforts,
services, and resources to establish common waste treatment and disposal facilities.
The government sector shall be represented by the heads of the following agencies in their ex officio
capacity:
DENR MMDA
DILG League of Provincial Governors
DOST League of City Mayors
DPWH League of Municipal Mayors
DOH Association of Barangay Councils
DTI TESDA
DA Philippine Information Agency

Private Sector:
 Representative from non-government organizations (NGOs) whose principal purpose is to
promote recycling and the protection of air and water quality
 Representative from the recycling industry
 Representative from the manufacturing or packaging industry

INCENTIVES:
Rewards, monetary or otherwise, shall be provided to individuals, private organizations and entities,
including non-government organizations that have undertaken outstanding and innovative projects,
technologies, processes and techniques or activities in re-use, recycling and reduction.

FISCAL INCENTIVES
Provisions of E.O 226, otherwise known as the Omnibus Investment Code, the following tax incentives
shall be granted:

Tax and Duty Exemption on Imported Capital Equipment and Vehicles


Within 10 years upon affectivity of this Act, LGUs, enterprises or private entities shall enjoy tax
and duty-free importation of machinery, equipment, vehicles and spare parts used for collection,
transportation, segregation, recycling, re-use and composting of solid wastes.

FINANCING SOLID WASTE MANAGEMENT

SOLID WASTE MANAGEMENT FUND


 Created, as a special account in the National Treasury to be administered by the Commission.
FUND SOURCES:
 Fines and penalties, donations, grants contributions, endowments and proceeds of permits and
liscenses.
 Amounts specifically appropriated for the fund.

Fund shall be used to finance the following:


 products, facilities, technologies and processes
 awards and incentives
 research programs
 information, education, communication and monitoring activities
 technical assistance
 capability building activities

PENAL PROVISIONS AND PROHIBITED ACTS

1. Littering, throwing, dumping of waste materials in public places


Penalty: P300-1,000 (Fine) or 10-15 days community service in LGU where violations was made

2. Operating, collecting or transporting equipment in violation of sanitation operation.


Penalty: P300-1,000 (Fine) or 1-15 days of imprisonment.

3. Open burning of solid waste


Penalty: P300-1,000 (Fine) or 1-15 days of imprisonment

4. Causing or permitting the collection of non-segregated or unsorted wastes.


Penalty: P1,000-3,000 (Fine) or 1-15 days imprisonment.

5. Squatting in open dumpsite and landfills


Penalty: P1,000-3,000 (Fine) or 15 days – 6 months of imprisonment or both.

6. Dumping, burying of biodegradable or non-biodegradable materials in flood prone area.


Penalty: P1,000-3,000 (Fine) or 15 days – 6 months of imprisonment or both.

7. Unauthorized removal of recyclable material intended for collection by authorized persons.


Penalty: P1,000-3,000 (Fine) or 15 days – 6 months of imprisonment or both.

8. Mixing of source-separated recyclable material with other solid waste in any vehicle, box,
container or receptacle used in solid waste collection or disposal.
Penalty: P500,000 + not less than 5% and not more than 10% of his net annual income during the
previous years

9. Establishment or operation of open dumps as enjoined in this Act or closure of said dumps in
violation of Section 37
Penalty: P500,000 + not less than 5% and not more than 10% of his net annual income during the
previous years

10. Importation of consumer products packaged in non-environmentally acceptable materials


Penalty: P500,000 + not less than 5% and not more than 10% of his net annual income during the
previous years
