RENTAL AGREEMENT

This Rental Agreement is made and executed at Bangalore on this the


07th Day of November 2022.

By and Between

Mr Venkata Ramchandrarao Kuppannagari S/o Sh Venkata Ramanamurti


Kuppannagari, residing at #302 Manjunatha Arcade Kaggadasapura main road, Near SCT
Collage Vignan Nagar, New Thippasandra, Karnataka 560075, hereinafter referred to as the
“OWNER” (which term shall mean and include his /her heirs, executors, administrators and
assigns) of the ONE PART;
AND
Mr. Vaishak K (Aadhar Card No:6892 3086 8904, Pan No: BDQPK9114D), Contact No:
8884028266) S/o of Sh. Vasudevan Karakkad residing at C/o Vasudevan K, 17064 Sobha
Dream Acres, Panathur Main Road, Varthur, Bangaluru 560087, hereinafter referred to as
the “TENANT” (which term shall mean and include his/her heirs, legal representatives,
administrators and assigns) of the OTHER PART;

WHEREAS the Owner is the absolute owner, sufficiently seized and possessed of the
apartment No. 39096 in building SOBHA DREAM ACRES PHASE 2 situated at BALAGERE,
PANATHUR ROAD, VARTHUR, Bangalore 560087 (more fully described in the schedule
hereunder written) hereinafter called ‘said apartment’.

AND WHEREAS pursuant to the request of the Tenant, the Owner has agreed to give the
said apartment on rental basis to the tenant.

AND WHEREAS after due deliberation, the owner has agreed to give on rent to the tenant to
occupy and use the said apartment for residential purposes only, subject to the terms and
conditions agreed to between the parties hereto as hereunder:

NOW IT IS AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS:


1. In consideration of tenant agreeing to pay the monthly rent of Rs.28,170 /-
(Rupees Twenty-Eight Thousand One Hundred and Seventy Only) including

applicable society monthly maintenance charges, the owner doth hereby give on
rent to the tenant, to occupy and use the said apartment for residential purpose
only, for a period of 11 months commencing from 01 October 2022. The duration
may be extended for further period at the option of the owner subject to enhanced
rent, which shall be at the escalated rate of 5% p.a. and such additional
conditions, if any, as mutually agreed between the owner and the Tenant.

2. The advance rent shall be paid on or before 02nd day of every succeeding month.
3. Upon execution of this agreement the tenant has paid to the owner a sum of Rs.
90,000/- (Rupees Ninety Thousand Only) vide online transaction no:

a. Rs. 70,000/- (Rupees Seventeen Thousand Only) vide transaction No


130317176507 dated 30 October 2021.
b. Rs. 20,000/- (Rupees Twenty Thousand Only) vide online transaction No.
000285152684 dated 16 Oct 2021.
as interest free refundable Security Deposit for due performance of his/her
obligations under this agreement. The said Security Deposit will be refunded
upon vacating the said apartment by the tenant subject to adjustment of
arrears of rent / other money due / Painting Charges/ recovery for damages if
any and payable to the owner.

4. The Tenant shall be at liberty to install at his/her cost the furniture and fixtures in
the said apartment as may be required by the tenant. While fixing such furniture
and fixture or its removal thereof no damages shall be caused to the said
apartment.

5. All the Corporation Taxes etc. in respect of the said apartment shall be duly paid
by the Owner promptly without any default.

6. The electricity charges for the electricity and water consumption in the said
apartment shall be paid by the tenant to the concerned authorities promptly
as per the bills received & proof of such payment shall be furnished to the
owner regularly. There is fixed monthly electricity charges i.e. Rs. 800/- per

month till the time Bescom meter is installed, the tenant shall pay this amount
to the owner on monthly basis. Any changes to the fixed monthly electricity
charges of Rs. 800/- per month will be borne by the tenant. Any arrears
raised for changes to this amount will be borne by the tenant from the date of
execution of this agreement. Post installation of the electricity meter the
electricity bills shall be paid as per the meter reading/uses to the concern
authority directly and bill payment proof shall be furnished to the owner
regularly.

7. The Tenant shall not deemed to be in possession or in exclusive occupation of


the said apartment and the Owner shall have the right to enter upon the said
apartment with prior notice to the tenant to inspect the said apartment.

8. The Tenant shall maintain the said apartment in good condition and shall not
cause any damage to the said apartment or any part thereof. If any damage is
caused by the tenant, the same shall be made good by the tenant either by
setting right the damage or by payment of money as compensation.

9. The tenant shall not let, sub-let or underlet the said apartment and shall not carry
out any work or repair to structure or additions or alterations to the said
apartment. The said apartment shall be exclusive use of Mr. Vaishak K along
with occasionally visiting relatives or friends and it should be used for residential
purpose only.

10. The tenant shall not cause any nuisance or annoyance to the other occupants of
the building Sobha Dream Acres. The tenant shall not store any inflammable or
hazardous goods in the said apartment.

11. If the tenant fails to pay the rent or commits breach of any of the terms of this
agreement as agreed herein, then the owner shall be entitled to revoke this
agreement by giving 30 days advance written notice. If the breach is set right
during the notice period, the said notice shall stand waived.

12. Notwithstanding what is stated hereinabove, the parties hereto shall terminate this
agreement by giving 30 days advance written notice by one party to the other.

13. Upon termination / determination of this agreement, the tenant shall vacate the
said apartment within the time stipulated and shall not raise any dispute of
whatsoever in this regard. The tenant shall ensure that the said apartment is
returned to the owner in the same condition that the tenant received at the time of
taking the apartment on rent. Before vacating, the tenant will leave the apartment
clean and in good condition with the exception of ordinary wear and tear.

14. Both parties hereto hereby irrevocably agree to confine the jurisdiction exclusively
to the Courts at Bangalore.

15. The Tenant agreed to pay painting and cleaning charges at the time of vacating
the house or one month rent.

16. No tacks, screws, or other such materials shall be placed in the walls without
the Landlord’s permission. Screw’s hooks, nails, holes, and adhesives are not
permitted on any wooden or metal surface including doors, windows or wood
works.

All that apartment no. 39096 admeasuring about 1200 sq.ft. approx. (built up area) on the 9 th
Floor of the building SOBHA DREAM ACRES PHASE 2 situated at BALAGERE,
PANATHUR ROAD, VARTHUR, Bangalore 560087.

The apartment contains the furniture and fixtures and following electrical items. At the time
of vacating the premises these furniture’s and fixtures and mentioned electrical items should
be in working condition and in place as it was while taking the possession of the premises.
