SUBJECT : Request for Legal Opinion/Recommendation re Letter from

RCDG Construction Corporation

DATE : February 17, 2023

1. Reference: Letter Request from Mr. Justin Dave Padilla, Project Engineer
of RCDG Construction Corporation dated March 08, 2023.

2. This pertains to the project: Construction of Perimeter Fence and Security

Tower (Last Phase) contracted to RCDG Construction Corporation under Contract
No. APCSLLP-09072022 dated September 21, 2022 with a contract price amounting
to Php6,160,922.46 with 150 calendar days (150cd) to accomplish the same upon
issuance and receipt of Notice to Proceed.

3. Relative thereto, Mr. Justin Dave Padilla, Project Engineer of the

abovementioned company requested for the amendment of target date of
accomplishment from the original terms of the contract due on January 23, 2023 to
March 30, 2023 or additional 30cd extension to accomplish the said project.

4. The company stipulated the following reasons which caused the delay in
the accomplishment and delivery of the aforementioned infrastructure project, to wit:
a. The construction methodology consisting demolition of the stairs to the
second floor;

b. Modification on the existing rebar for the second floor to roof slab for
structural stability; and

c. The work behind the fence on another premises resulting to

submission of request and approval of mobilization on site.

5. In connection thereto, the contractor submits the request attach

document proving the cause of the delay, the undersigned respectfully request for
legal opinion/recommendations on the attached letter request for proper disposition.
