Sub: NHAI, PIU-Amaravati - 6-laning of Vijayawada Bypass from Gollapudi (Km.30+000)


to Chinnakakani (Km.47+881) including Major Bridge across river Krishna in
Vijayawada-Gundagolanu section of NH-16 in the state of Andhra Pradesh under
Bharatmala Pariyojana on Hybrid Annuity Mode (Pkg.IV)– Concessionaire’s
Submission of Normative Cost due to Change of Scope as per Article 16 of the
Concession Agreement – Recommandations submitted – Approval of the
Competent Authority – Requested - Reg.

1.0 Please find herewith enclosed a copy of Concessionaire, M/s VBPPL letter no.
VBPPL/IE/SAICPL/1199 dated 13.06.2023 addressed to IE with a copy marked to PIU,
therewith requesting for COS approvals based on Normative Cost due to Change of Scope
as per Article 16 of the Concession Agreement and NHAI Circular no 11 46 2023 dated
21.02.2023. The same was evaluated by the Independent Engineer and recommendation
for obtaining Competent Authority was submitted vide IE letter no. SAICPL-UIC/Golla-
Chinn/Pkg-IV/NH-16/VBPPL/2023/1022 dated 21.06.2023.

2.0 In this connection, it is submitted as follows:

2.1 The project “6-laning of Vijayawada Bypass from Gollapudi (Km.30+000) to


Chinnakakani (Km.47+881) including Major Bridge across river Krishna in Vijayawada-
Gundagolanu section of NH-16 in the state of Andhra Pradesh under Bharatmala
Pariyojana on Hybrid Annuity Mode (Pkg.IV)” was awarded to Concessionaire, M/s
Vijayawada Bypass Project Pvt. Ltd., (Consortium comprising M/s Adani Enterprises Ltd.,
and M/s Navayuga Engineering Co. Ltd.,), for which Agreement was concluded on
09.07.2020.

2.2 After a series of exchange of correspondence among Concessionaire, PIU/RO/HQ, a


Settlement Agreement was concluded on 20.10.2021 between NHAI and the Concessionaire
before the mutually agreed neutral conciliator Shri M.K.Rahman, former Engineer-in-
Cheif, AP as per the provisions of Section 73(4) of Arbitration and Conciliation Act, 1996
and as per Cl.4.1 of Terms of Settlement of Settlement Agreement dated 20.10.2021,
Appointed Date for the subject project was acknowledged as 07.07.2021.

2.3 Accordingly, Concessionaire is progressing with the construction activities on lands


made available by NHAI.

2.4 It is to be noted that, based on the instructions from the Competent Authority,
PIU-Amaravati vide letter no 122 & 136 dated 27.01.2022 & 28.01.2022, suspended the
works on existing alignment from Km 33.723 to Km 40.678. Accordingly, the
Concessionaire stopped the works from Km 33.420 to Km 40.678, w.e.f. 27.01.2022.

2.5 NHAI has accepted the request for swapping in alignment and same was
communicated by the PIU-Amaravti vide its letter no 576 dated 12.04.2022 and handed
over the lands in the new alignment except in transition portion of 2.28 Km.

2.6 As cited by the IE in COS recommendation letter no. 1022 dated 21.06.2023,
due to constraints at site from Km.33.420 to Km.35.700, we have finalised the best fit
alignment on 28.04.2022 along with AMRDA/IE and Concessionaire. Accordingly, best fit
alignment was proposed by the Concessionaire vide letter no. 692 dated 13.05.2022 and
the same was reviewed by the IE and recommended to the Authority vide its letter no 433
dated 13.05.2022.

2.7 The Concessionaire had commenced works from Km.35.700 to Km.40.678


w.e.f.15.06.2022 and communicated the same vide their letter no. 771 dated 23.06.2022.

2.8 Due to the said Change in Alignment from Km 33+420 to Km 40+678 (totaling
to 7.258 Km), the Scope was changed with respect to the Scope detailed in the Concession
Agreement.

2.9 Further, due to the site conditions and other requirements there is change
of scope requirement in other than Change in Alignment stretch which was recommended
by IE vide letter no. SAICPL-UIC/Golla-Chinn/Pkg-IV/NH-16/VBPPL/2021/403 dated
23.04.2022.

2.10 Upon preliminary review of the COS recommendation made by IE, PIU-
Amaravati vide letter no. NHAI/PIU-AMARAVATI/11022/04/VOL.1/2021/664 dated
29.04.2022 has sought cost workings pertaining to COS for recommending to the
Competent Authority for approval of Change of Scope Notice.

2.11 The Concessionaire has submitted the normative cost workings for approval
of COS in line with the discussions held in NHAI, RO-Vijayawada with CGM(Tech), NHAI-HQ
dated 03.06.2023.

3.1 PIU-Amaravati has reviewed the Concessionaire submissions on COS &


pertaining Normative Cost and recommendations of IE on the submitted IE. Accordingly,
our recommendations are as follows,

4.0 The Concessionaire has prepared normative cost as per NHAI circular 11.46
dated 21.02.2023 for the above COS works and the same was got scrutinised by IE. The
normative cost due to the Change of Scope is (-) 5,55,87,793/-, the cost details, relevant
drawings and documents are attached for your ready reference.

In light of the above, it is requested to communicate the approval of Competent


Authority for Change of Scope for the above listed COS works as per provisions of the
Article 16 of the Concession Agreement.
