10 I understand that the federal government has refused to allow Mr Donald J Trump Jr to enter
11 the Commonwealth of Australia and it appears to me that this is unconstitutional.

18 Mr. WISE.-I do not think so. I beg to move- That the words "each state" be omitted, with the view of
19 inserting the words "the Commonwealth."
20 I apprehend the Commonwealth must have complete power to grant or refuse citizenship to any citizen
21 within its borders. I think my answer to Sir John Forrest was given a little too hastily when I said that every
22 citizen of the British Empire must be a citizen of the Commonwealth. The Commonwealth will have power
23 to determine who is a citizen. I do not think Dr. Quick's amendment is necessary. If we do not put in a
24 definition of citizenship every state will have inherent power to decide who is a citizen. That was the
25 decision of the Privy Council in Ah Toy's case.

27 Mr. WISE.-The Privy Council decided that the Executive of any colony had an inherent right to
28 determine who should have the rights of citizenship within its borders.

32 It appears upon this that the Commonwealth of Australia may have every rights to deny a person
33 to enter the Commonwealth of Australia, just that it is not that simple.

41 The part “(xix) naturalization and aliens;” related to aliens who were and remained within the
42 Commonwealth of Australia.

44 The part “(xxviii) the influx of criminals;” related to keeping undesired people who had criminal
45 convictions out of the Commonwealth of Australia. As such the Framers of the Constitution
46 narrowed the powers of the Commonwealth to merely convicted criminals, not people the
47 Federal Government may have a different political view with.

1 We know too well that a convicted murderer nevertheless was allowed by the High Court of
2 Australia to remain in the Commonwealth of Australia even so previously having been deported.
3 We also know that the High Court of Australia allowed 2 convicted criminals from New Zealand
4 to remain in Australia merely because they were Aboriginals.
5 In my view in those cases the High Court of Australia exceeded its jurisdiction as it is not to be
6 some social court to take over Parliament legislative powers.

8 When it comes to Mr Donald J Trump Jr, as I understand it he has no criminal record and merely
9 was to be on a speaking tour.

21 While Mr Donald J Trump Jr might not be a citizen of the Commonwealth of Australia,
22 nevertheless where the Federal Government makes a decision to invoke its constitutional powers
23 then it must do so appropriately. While Mr Donald J Trump Jr may not be in political alliances
24 with the Federal Government nevertheless our constitution does provide for “political liberty”
25 and it would be utter and sheer nonsense to claim that his conduct would be a NATIONAL
26 SECURITY issue. Considering the ASIO alleged TRAITOR Ian George Peacock who really
27 can trust ASIO, when it I view betrayed Australians with their Weapons of mass Destruction in
28 Iraq, etc. In my view, based upon the limited information available to me the Federal
29 Government exceeded its constitutional powers and should immediately correct any
30 inappropriate made decision! The Government is not above the rule of law!
