The respondent above named prays before this Hon’ble Court


that the reasons sworn in the accompanying affidavit be pleased to
recall the stage of Cross-examination of RW1, which was taken as
nil on 14/03/2023 in the above suit. Hence the respondent prays
before this Hon’ble Court to recall the stage of Cross-examination of
RW1 in the ends of justice and equity.

AFFIDAVIT

I, Anusha.S, W/o Praveen Kumar, aged about 35 years, residing


at no. 12/4/27, 3rd Cross, Vidyuth Nagar, Ananthapuramu, Andra
Pradesh. Today at Bangalore, do hereby state and solemnly affirm
an oath as follows:

1. I submit that am the respondent in the above case and I know


the entire facts of the case.

2. I submit that on 14/03/2023 the case was posted for cross-


examination of RW1 and the Hon’ble Court was pleased to close
the stage of Cross-examination due to my absence. I could not
be present in person due to my ill health and I could not travel
from my home town. Further, my counsel on record was on
maternity leave hence the counsel could not be present on the
last hearing date. Hence this application.

3. I submit that the reason stated is bonafide and certainly not to


drag the matter.

4. I submit that if this application is allowed then no great hardship


will be caused to the petitioner.

Wherefore I pray before this Hon’ble court may kindly be pleased


to recall the stage cross-examination of RW1 in the ends of justice
and equity.
