BARANGAY ORDINANCE NO.01

Series of 2018

AN ORDINANCE ADOPTING THE CALAPE DANGEROUS DRUGS ADMINISTRATIVE BOARD OF

THE MUNICIPALITY OF CALAPE, PROVINCE OF BOHOL IN THE BARANGAY OF LUCOB

Section 1. TITLE – This Ordinance shall be known as THE BARANGAY BENTIG

DANGEROUS DRUGS ADMINISTRATIVE BOARD of 2019;

Section 2. COMPOSITION – The Barangay Lucob Dangerous Drugs Administrative Board is

hereby composed of the following:
A. Henry B. Calotes - Chairperson / Adviser of Barangay
B. Junrey S.Orilla - Vice Chairperson /Chair.of SB Committee on Peace and Order
C. Amado T. Samijon - Member / Punong Barangay / Chair. On BADAC
D. Janice J. Rulona - Member / SB chair.on Committee on Health
E. Janjun I. Halawig - Member / SK chairman
F. Jill C. Cambagay - Member / NGO COOP Chairman

Section 3. POWERS AND DUTIES – The following are the powers and duties of the Barangay
Lucob Dangerous Drugs Administrative Board:
A.) Receive complaints for the abatement of drug related public nuisances;
B.) Conduct hearings in connection of the barangay;
C.) Declare a place or premises in question as drug related public nuisance if the
circumtances so needed; and
D.) Abate drug related public nuisances.
Section 4. ABATEMENT OF DRUG RELATED PUBLIC NUISANCES – Pursuant to Section 52 of
Republic Act 9165 and its implementing Rules and Regulations, otherwise known as the
Comprehensive Dangerous Drugs Act of 2002, any place or premises which have been used on
two more occasions as the site of the unlawful sale or delivery of dangerous drugs and other
similar activities may be declared to be a public nuisance and such nuisance may be abated
under the following procedures.
A.) Any employees, officers, or resident of Barangay Lucob, Calape, Bohol may bring a
complaint before the Calape Dangerous Drugs Administrative Board after giving not
less than three days written notice of such complaint to the owner of the place or
premises at his /her last known address;
Within three days from receipt of the complaint, hearing shall then conducted by the
Board with notice to both parties and the board may consider any evidence
submitted, including evidence of general reputation of the place or premises.
B.) The owner / manager of the place or premises shall also be given an opportunity to
present any evidence in his / her defense;
C.) After hearing, the Board may declare the place or premises to be a public nuisance;
and
D.) The hearing shall be determined within ten days from commencement.

Section 5. EFFECT OF THE ADMINISTRATIVE BOARD DECLARATION – Pursuant to Section

53 of Republic Act 9165 and its implementing Rules and Regulations,if the Board declares a
place or premises to be a public nuisance, it shall issue an order immediately probihiting the
conduct operation or maintenance of any business or activity which is conductive to such
nuisance.The Punong Barangay shall implement the order of the Administrative board within
fifteen days from receipt thereof and shall assume full responsibility in seeing to it that order is
immediately complied with.

The order issued by the Board shall expire after one year of the date issuance, or at such
ealier time as stated the order.The administrative Board may bring a complaint seeking a
permanent injunction against any nuisance described under Republic Act 9165 and its
Implementing Rules and Regulations.

The Board, upon showing that the place is no longer a public nuisance, may conduct
hearing with the complainant duly notified for possible lifting of the order.

Section 6. WITHOUT PREJUDICE TO THE FILING OF CRIMINAL CASE, AND THE

DECLARATION AND / OR ABATEMENT OF THE ANY NUISANCE UNDER THE CIVIL CODE
AND THE LOCAL GOVERNMRNT CODE OF THE PHILIPPINES. This Ordinance is without
prejudice to the filing of a criminal case against the owner of the place or premises declared as
drug related public nuisance pursuant to Section 6 R.A. 9165.This does not restrict the right of
any person to proceed under the Civil Code on public nuisance.Neither shall this restrict the
power of the Sangguniang Barangay to declare and / or abate any nuisance under Section 447
(a) (4) (i) of the Local Government Code of 1991.
Section 7. AWARDING / INCENTIVE FOR PUROKs/SITIOS DRUG FREE – Every declared
drug-free barangay shall be given an award in the form of project as its incentive;

Section 8. APPROPRIATION –The amount of ₱5,000.00 shall be budgeted annually by the

Barangay Local Government Unit of Barangay Benitg for the operational expenses of the
Barangay Dangerous Drugs Administrative Board;

Section 9. SEPARABILITY CLAUSE – Any provision of this adopting ordinance found to be

unconstitutional shall not affect the other provisions which remain to be in full force and effect.

Section 10. REPEALING CLAUSE – Any ordinance found to be inconsistent with this shall be
deemed repealed or modified accordingly;

Section 11. TRANSITORY PROCISION- The amount appropriated in the year 2019 the Barangay
Development Plan for Anti-Drug Abuse Council shall also cover expenses for the implementation
of this ordinance until such that a regular appropriation be enacted under Section 8 hereof;

Section 12. EFFECTIVITY – This ordinance shall take effect immediately after approval by the
Sangguniang Bayan;
