Hereby acknowledge the following:

1. I/We were advised of the Holmwood Real Estate Limited in-house complaints process.

2. I/We were advised that we must provide proof to our solicitor of an Inland Revenue Department NZ (IRD)
tax number in my/our name; and a New Zealand bank account number in my/our name.
3. I/We confirm that we were advised to seek legal advice before entering into any agreement or contract.
4. I/We confirm that at the time we entered into this agreement we did so freely without influence or duress.
5. I/We have been made aware that any house built of monolithic cladding, either Polystyrene or Harditex
with a plastered finish and typically built between 1990 and 2006 may be prone to weather tightness
issues and we have been advised to seek independent expert advice.
6. I/We have been made aware that any house built in the 1970’s – 1980’s may have Dux Quest plumbing
systems. If you are concerned that a property may have Dux Quest plumbing systems, we recommend you
seek advice from a qualified specialist.
7. Asbestos was a common building material that may be present in houses. If you are concerned that a
property may contain asbestos, we recommend that you seek advice from a qualified specialist.
8. I/We acknowledge that the agent may receive a commission from the provider of any related service (for
example, but not limited to, Mortgage Express/Insurance Express) in the event of a referral.

OVERSEAS INVESTMENT ACT:
 I/we understand that residential property purchases are now subject to the provisions of the Overseas
Investment Act 2005 (OIA). Before any residential property is transferred to me/us, my/our lawyer will require
me/us to complete a Residential Land Statement certifying that I/we meet the eligibility criteria.

 If I/we require Overseas Investment Act 2005 (OIA) consent and do not obtain it or our application is declined,
we will not be able to settle the property transaction and may incur liability to the vendor.

If you are uncertain about your eligibility or whether the property is subject to the Overseas Investment Act
2005 (OIA) you must make your offer subject to obtaining Overseas Investment Office consent.

AUCTIONS:
You must not bid on a property at auction unless you are able to buy the property on an unconditional basis.
You may incur liability to the vendor if you purchase the property at auction in circumstances where you do
not meet the eligibility criteria in the Overseas Investment Act 2005 (OIA)

CUSTOMER DUE DILIGENCE:


 I/we understand and acknowledge that before my lawyer can act for me/us, they must complete customer
due diligence (CDD) on me/us under the Anti-Money Laundering and Countering Financing of Terrorism Act
2009 (AML/CFTA).
 If my/our lawyer cannot complete customer due diligence on me/us and cannot act for me/us as a result,
I/we may not be able to satisfy conditions under the agreement or settle the property purchase. This may
result in me/us incurring liability to the vendor.
